These plats were used of prepare our Iselin Park P.U.D. and Maroon Creek Road Annexation Plats. If you review the Annexation Plat's calls along and adjacent to Maroon Creek Road you will see a boundary corner is the S1/4 corner of Section 11 and on the survey plat the S1/4 is not a corner and this boundary line is west of the depicted road: Sopris Engineering, LLC's work confirmed that the Drexel Barrell Annexation Plat includes the Maroon Creek Road and the labeling should be west of that boundary call. This plat annex's the road inside the Book.119, Page 40 Deed to the southerly line of Section I 1 and this section line is where our Annexation -Plat begins. In conclusion between the two Annexation. This matter is before you for Second Reading and a public hearing. The petition for annexation was filed with the City Clerk on July 9, 2002. On August 12, 2002, City Council adopted a resolution finding substantial compliance with Section 31-12-107(1), C.R.S. A public hearing was held on September 23, 2002, at which time Council determined that the proposed annexation was in compliance with §§ 31-12-104 and 31-12-105, C.R.S. First reading of this ordinance was approved by Council on January 13, 2002. Attached please find a letter from Brian Pettit of the County setting forth the resolution of certain issues that City staff had prior to recommending approval of the proposed annexation. Ed Sadler has reviewed the letter and is in agreement with the terms set forth therein. Accordingly, staff recommends approval of the annexation of the portion of the Maroon Creek road into the City boundaries. City staff will be present at the public hearing to answer any questions you might have on the proposed annexation and potential impacts the annexation will have on City operations. The technical date is summarized from a report prepared by CTL/Thompson, Inc. of June 12, 2001. The particular section of road in question is from Moore Drive to the upper end of Iselin Park (just above the tennis courts). This portion of the road was rebuilt as part.of the Aspen Consolidated Sanitation District Maroon Creek Trunk Line project in the summer of 2000. The main purpose of the project was to install a new sewer line in Maroon Creek Road from near Glen Dee Road to the roundabout at SH 82. The original plan called for the trench to be cut and then backfilled and repaved. During the pre - construction phase of the project, it became apparent that all the utility companies with services in the area needed to look at making any upgrades, relocations, road crossings or other work at the same time. As consequence of their decisions for additional utility work, the pavement in this particular section at least 11/2 the road was obliterated on the Iselin side and utility work was done on the opposite shoulder. -When the sewer and utility work was complete, the contractor completed the paving of the road in late summer of 2000. The specification for the areas to be rebuilt called for the contractor to provide 4" of Hot Bituminous Pavement (HBP) over 4" of class 6 aggregate base course (ABC). The details for this specification are called out in the "Standard Specifications for Road and Bridge Construction' 1999, from the Colorado Department of Transportation. What actually was built was different due to field conditions. In some areas the existing asphalt exceeded 4" and the base course was far in excess of 4". In fact, the contractor matched the existing conditions for asphalt thickness and depth of base course material. In addition, the section in front of the new recreation center up to the tennis courts was overexcavated by 2 to 4 feet to remove unconsolidated material from the old landfill in the area. This was replaced with pit run material 2 to 4 feet beep, approximately 18" of ABC class 6 and 4" of HBP. The actual material used to backfill the sewer trench (except for the overexcavation area) was native material from the trench. This material has an R value (Hveem Stabilometer test) of 62 or better which exceeds the Colorado Department of Transportation specification of R59 for high volume roads. Consequently, the road was constructed with at least 4" of pavement, with 15 to 18 inches of base material. When all of the work on the sewer line project was complete Elam Construction placed a 1'/2 inch overlay over the whole road from Highlands to Moore Drive. This was done October 181h and 19`h-of 2000. The overlay was originally intend to go from Highlands to SH 82 but because of the upcoming work -on the Aspen High School and the Iselin Recreation Center, the lower portion was postponed for a year. The HBP thickness in the Iselin area is 5 'h " to 6". The ABC Class 6 is in the 15" to 18" range and a subgrade material in excess of 4 feet in depth (R 59). In summary, this section of Maroon Creek Road far exceeded the County Standards for a Main Collector. For example, the typical section for SH 82 on the AABC to Buttermilk Project that was being constructed at the same time called for 5'/2" of HBP with 4" of Class 6 ABC and 2' of Special Embankment material (R 59). In summary, Maroon Creek Road in the Iselin area was built to a high standard. It met the specifications of the project and the County Road Standards. It was tested and inspected at every step along the way by H-P Geotechnical for the Aspen Consolidated Sanitation District. CTL/Thompson provided additional testing and geotechnical investigations in the summer of 2001 for the County. All of this investigation and testing concludes that the road was built correctly and meets or exceeds all applicable standards and specifications. The County assures the City that they will be able to cut Glen Eagles Road to expose the end of the buried culvert. The County believes the culvert falls within the Maroon Creek Road right of way that was annexed into the City in July of 1998. However, if it is proven that that portion of Glen Eagles Drive remains in the county, the County will issue a Right of Way work permit to the'City with no fee. The county will provide $3,000 to the City upon the completion of the pending annexation of ,Maroon Creek Road. These plats were used of prepare our Iselin Park P.U.D. and Maroon Creek Road Annexation Plats. If you review the Annexation Plat's calls along and adjacent to Maroon Creek Road you will see a boundary corner is the Sl/4 corner of Section 11 and on the survey plat the S1/4 is not a corner and this boundary line is west of the depicted road. Sopris Engineering, LLC's work confirmed that the Drexel Barrell Annexation Plat includes the Maroon Creek Road and the labeling should be west of that boundary call. This plat annex's the road inside the Book 119, Page 40 Deed to the southerly line of Section 11 and this section line is where our Annexation Plat begins. In conclusion between the two Annexation Plats, Maroon Creek Road will be within the City limits from the southerly boundary of Iselin Park P.U.D. to the Highway 82 round -a -bout. Worcester DATE: September 23,1998 RE: Maroon Creek Road — Resolution Finding Compliance with Municipal Annexation Act Following a Public Hearing Attached for your consideration and review is a resolution which, if adopted, would find compliance with certain statutorily required findings of fact regarding the annexation of the property commonly known as the Maroon Creek Road. The statutorily required public hearing is to determine compliance with certain provisions of the Municipal Annexation Act of 1965 as part of the statutory required process for annexing unincorporated property into the City. If Council determines at the public hearing that compliance with these provisions exist, then an ordinance to annex will be prepared for Council's consideration at a later date. As with all ordinances, a public hearing will be scheduled as part of second reading of the annexation ordinance. The appropriate time for interested citizens to offer comments on issues, other than compliance with the Municipal Annexation Act, regarding the annexation of the parcel to the City would be during the second reading of the annexation ordinance. The public hearing scheduled for the 23rd can, therefore, be limited to the sole issue of compliance with the relevant provisions of the Municipal Annexation Act. At Council's regular meeting on August 12, 2002, Resolution No. 70, Series of 2002, was adopted. That resolution found substantial compliance with Section 31-12-107(1), C.R.S. (the technical requirements for a petition for annexation); established September 28, 1998 as the date for a public hearing to determine compliance with Sections 31-12-104 and 31-12-105, C.R.S., (described below); and authorized the institution of zoning procedures for land in the area proposed to be annexed. Because 100% of the property owners (the Board of County Commissioners) have consented to the proposed annexations, annexation elections are not required. However, at the public hearing, Council must make a determination that the proposed annexation is in compliance with Sections 31-12-104 and 31-12-105 of the state annexation statutes. Section 31-12-104, C.R.S., sets forth specific eligibility requirements which Council must find and determine at the scheduled hearing. These eligibility requirements are incorporated within the proposed resolution. The facts that support the determination of compliance will be presented by staff at the hearing. In addition, Section 31-12-105, C.R.S. imposes a set of limitations on every annexation. It is these limitations that Council must also consider at the public hearing scheduled for the 13th. I have also attached a copy of a proposed resolution which you may adopt as Council's written findings and determinations following the public hearing. The proposed resolution summarizes the limitations of Section 31-12-105 in the form of factual statements that will need to be established at the public hearing.
