Series 1996
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, TO AMEND THE MUNICIPAL CODE BY THE ADOPTION OF
THE UNIFORM ADMINISTRATIVE CODE PROVISIONS FOR THE
NATIONAL ELECTRICAL CODE 1993 EDITION WITH AMENDMENTS.
WHEREAS, extensive constmction activities are taking place within the City of Aspen
and the Roaring Fork Valley; and
WHEREAS, thorough coordination of development-related codes is critical to the public
and staff to reduce confusion and error, and to improve compliance; and
WHEREAS, administrative provisions were not included in Ordinance 42, Series of
1993, which adopted the National Electrical Code (NEC); and
WHEREAS, upon further consideration, the Chief Building Official has detennined that
the Uniform Building Code does not provide appropriate enforcement authority between
the NEC and other development codes, therefore adoption of the Uniform Administrative
Code Provisions should be adopted via ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO:
Section 1.
That Section 7-156 of the Municipal Code of the City of Aspen, Colorado, adopting the
1993 Edition of the National Electrical Code, is hereby amended to read as follows:
Sec. 7-156. National Electrical Code and Uniform Administrative Code Provisions
for the National Electrical Code 1993 Edition adopted.
Pursuant to the power and authority conferred by the law of the State of Colorado and the
Charter of the City of Aspen, Colorado, there is hereby adopted and incorporated herein
by reference as if fully set forth those regulations contained in the National Electrical
Code, 1993 Edition, published by the National Fire Protection Association, Batterymarch
Park, Quincy, Massachusetts, 02269, and the Uniform Administrative Code Provisions
for the National Electrical Code 1993 Edition, published by the International Conference
of Building Officials, 5360 Workman Mill Road, Whittier, California, 90601-2298,
except as otherwise provided by amendment or deletion as contained in Section 7-157 of
Article VI of this chapter. At least one (I) copy of the National Electrical Code and the
Uniform Administrative Code Provisions for the National Electrical Code 1993 Edition

shall be kept on file in the office of the Clerk of the City of Aspen, Colorado, and shall be
made available for inspection during regular business hours.
Section 2.
That Section 7-157 of the Municipal Code of the City of Aspen, Colorado, which section
amends certain provisions of the National Electrical Code, 1993 Edition, is hereby
amended to read as follows:
Section 7-157. Amendment.
A. The following general amendment is made to the provisions of the National Electrical
Code, 1993 Edition, herein adopted by reference:
All 125 volt, single phase. 15 and 20 ampere receptacles to serve counter top space
installed within six (6) feet of a sink shall have ground-fault circuit intenupter protection
for personnel.
All storage areas and similar rooms in Residential Occupancies shall have surface
mounted lighting fixtures with a maximum lighting capability of 1 watt per square foot
and 1 duplex outlet per 100 square foot of floor area or fraction thereof.
B. The following general amendment is made to the provisions of the Uniform
Administrative Code Provisions for the National Electrical Code, 1993 Edition, herein
adopted by reference:
Chapter 2 Section 203 (a) Board of Appeals
General. In order to hear and decide appeals of orders, decisions or
determinations made by the building official relative to the application and
interpretation of this code, there shall be and is hereby created a board of appeals
consisting of members who are qualified by experience and training to pass on
matters pertaining to building construction and who are not employees of the
jurisdiction. The building official shall be an ex officio member of and shall act
as secretary to said board but shall have no vote on any matter before the board.
The board of appeals shall be appointed by the governing body and shall hold
office at its pleasure. The board shall adopt rules of procedure for conducting its
business, and shall render all decisions and findings in writing to the appellant
with a duplicate copy to the building official.
Chapter 2 Section 203 (c)
At the time of perfecting an appeal to the board of appeals, the appellant shall be
required to pay an appeal fee of seventy-five dollars ($75.00), which fee may be

returned to the appellant at the discretion of the board of appeals if the appellant is
substantially sustained.
The following shall be deleted from Chapter 3, Section 301 (b) Exempt Work:
12. Electrical wiring, devices, appliances, apparatus or equipment operating at
less than 25 volts and not capable of supplying more than 50 watts of energy.
13. Low-energy power, control and signal circuits of Classes II and III as defined
in this code.
Also deleted is Sec. 304.(a) Permit Fees and Table No. 3.A Electrical Permit Fees.
Section 3.
That if any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held invalid or unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and shall not affect
the validity of the remaining portions thereof.
Section 4.
That this ordinance shall not have any effect on existing litigation and shall not operate as
an abatement of any action or proceeding now pending under or by virtue of the
ordinances amended as herein provided, and the same shall be constlUed and concluded
under such prior ordinances.
A public hearing on the ordinance shall be held on the /d day Of~p96, in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
