AN ORDINANCE OF THE CITY COUNCIL OIF THE CITY OF ASPEN, COLORADO,
IDENTIFYING AND DESIGNATING THOSE SITES AND STRUCTURES
CONSTITUTING THE CITY OF ASPEN INVENTORY OF NON-LANDMARK I-IISTORIC
SITES AND STRUCTURES (ROUND III) AS AUTHORIZED PURSUANT TO SECTION
24-7-709 OF THE MUNICIPAL CODE.
WHEREAS, Section 24-7-709B of the Municipal Code requires the Aspen Historic
Preservation Commission (HPC) to identify and evaluate the historic sites and structures
situated within the City of Aspen at least once every five (5) years, prepare an official
inventory of the same, and recommend revisions thereto for adoption by the City Council;
and
WHEREAS, management of the Inventory of Historic Sites and Structures is
considered to be a vital aspect of Aspen's historic preservation program and meets an
important goal of the HPC; to foster public awareness of Aspen's preservation program
and to work in harmony with the community to preserve, protect, and enhance Aspen's
historic resources and unique character; and
WHEREAS, HPC and Planning Staff completed field studies and inventory
documentation between September, 1990 and March, 1992, with the assistance of
professional consultants as contracted by the Planning Department; and
WHEREAS, the Inventory adoption process was broken down into three rounds,
and through duly noticed public hearings, the City of Aspen adopted the 1992 Inventory
of Historic Sites and Structures (Round I) on June 22,1992 and (Round II) on January

11, 1995; and
WHEREAS, in undertaking Round III of the Inventory re-evaluation, Planning Staff
met with property owners on June 21, 1995, to answer questions regarding the inventory
re-evaluation process and historic preservation program; and
WHEREAS, the HPC conducted a duly noticed public hearing on June 28, 1995 to
solicit citizen and property owner input in order to assist HPC in re-evaluating the
Inventory; and
WHEREAS, the HPC individually reviewed and evaluated the sites and structures
on the Inventory and has recommended additions, deletions, and classification changes
to the Inventory; and
WHEREAS, the HPC recommends that Council ratify and adopt the Inventory of
Non-Landmark Historic Sites and Structures (Round III), as proposed. These properties,
along with those adopted through Ordinance #34, Series of 1992, Ordinance #4, Series
of 1995, and those structures which have been designated historic landmarks shall
constitute the "Inventory of Historic Sites and Structures," pursuant to Section 24-7-709 of
the Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Of
ASPEN, COLORADO, THAT:

Section 1
The properties listed in "Exhibit 1," which is attached hereto and fully incorporated herein,
shall be and are hereby ratified and designated as the Inventory of Non-Landmark
Historic Sites and Structures (Round III).
Section 2
Pursuant to the review and re-evaluation of the Inventory as conducted by the Historic
Preservation Commission and Community Development Department, the following
properties have been added and included in the Inventory of Non-Landmark Historic Sites
and Structures (Round III) as ratified and approved herein:
The Meadows, generally described as a tract of land in Section 12,
Township 10 South, Range 85 West of the 6th P.M. The Aspen Meadows
property is bounded by Meadows Road, Gillespie Street, Roaring Fork
Road and the Roaring Fork River, in Aspen, Colorado. The specific areas
of this property which will be reviewed by HPC , as shown on "Exhibits 1
and 2," attached, are: the Meadows restaurant, the existing Trustee
housing, the Race Track, the Health Club, the sculpture gardens and all
other landscape elements associated with the Beyer/Benedict design,
Anderson Park and a 50' radius around it.
Section 3
Pursuant to the review and re-evaluation of the Inventory as conducted by the Historic
Preservation Commission and Community Development Department, the following
property is hereby retained on the Inventory of Non-Landmark Historic Sites and
Structures (Round III) as ratified and approved herein:
Red Butte Cemetery, a tract of land situated in the NW1/4 of Section 12,
Township 10 South, Range 85 West of the 6th P.M.
Section 4
Pursuant to the review and re-evaluation of the Inventory as conduGted by the Historic
Preservation Commission and Community Development Department, the following
properties are hereby deleted from the Inventory of Non-Landmark Historic Sites and
Structures (Round III) as ratified and approved herein due to demolition or
loss of integrity or historic significance:
437 W. Smuggler Street, Lots A and B, Block 34, City and Townsite of
Aspen.

325 N. Third Street, Lots H and I, Block 35, City and Townsite of Aspen.
925 King Street, as adopted through Ordinance #34, Series of 1992. 935
King Street, as adopted through Ordinanee #4, Series of 1995 shall remain
on the inventory.
Section 5
A map depicting the properties included in the Inventory of Non-Landmark Historic Sites
and Structures (Round III) shall be prepared by the Community Development Department
and made availablefor public inspection during regular business hours in the offices
of the Community Development Department.
Section 6
This ordinance shall not have any effect on existing litigation and shall not operate as an
abatement of any action or proceeding now pending under or by virtue of the ordinances
repealed or amended as herein provided, and the same shall be construed and
concluded under such prior ordinances.
Section 7
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any
reason held invalid or unconstitutional in a court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and shall not affectthe
validity of the remaining portions thereof.
Section 8
A public hearing of the ordinance shall be held on the 25th day of Mamh, 1996, in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED PUBLISHED as provided by law by
the City Council of the City of Aspen on the 22nd day of January, 1996.
