ORDINANCE NO. 30
(Series of 1996)
AN ORDINANCE OF THE ASPEN CITY COUNCIL WAIVING PARK
DEDICATION FEES FOR 935 E. HYMAN AVENUE, LOT 1, KENTCO LOT
SPLIT, EAST ASPEN ADDITION TO THE CITY OF ASPEN.
WHEREAS, Richard Kent, owner of 935 E, Hyman Avenue, Lot 1, Kentco
Lot Split, East Aspen Addition to the City of Aspen, requests waiver of park
dedication fees related to the proposed development of the site; and
WHEREAS, such waiver may be granted by City Council as a
preservation incentive for historic landmarks; and
WHEREAS, the property was designated a historic landmark through
Ordinance #44, Series of 1995,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL. OF THE CITY
OF ASPEN, COLORADO:
Section 1
Park dedication fees associated with the development proposal as approved by
HPC on June 26, 1996, are hereby waived pursuant to Section 26.44,060 of the
Municipal Code,
Section 2
That if any section, subsection, sentence, clause, phrase, or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the
remaining portions thereof,
Section 3
A public hearing on the Ordinance was held on the 26th day of August, 1996, at
5:00 p,m, in the City Council Chambers, Aspen City Hall, Aspen, Colorado,

fifteen (15) days prior to which hearing notice of the same was published once in
a newspaper of general circulation within the City of Aspen,
INTRODUCED, READ, AND ORDERED PUBLISHED as provided by law by the
City Council of the City of Aspen on the 22nd day of July, 1996,
