AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
ADOPTING THE UNIFORM ELECTION CODE OF 1992, AS AMF2qDED, FOR ALL
COORDINATED ELECTIONS.
WHEREAS, Article 20 of Title X of the Colorado Constitution limits the days upon wlfich
elections may be held and requires certain administrative functions to be coordinated if multi-
jurisdictions hold elections on the same day; and
WHEREAS, Section 1-7-116, C.R.S., enacted by the General Assembly of the State of
Colorado, amends the state Uniform Election Code to include provisions to authorize county clerks
and recorders to conduct coordinated elections on behalf of all political subdivisions scheduled to
hold elections on the same date; and
WHEREAS, the City Council has determined that it is in the best interests of the electors of
the City of Aspen to participate in coordinated elections and thereby avoid the confusion of
participating in multiple elections at multiple ballot locations; and
WHEREAS, Section 1-7-116, C.R.S., requh'es that jurisdictions desiring to participate ~n
coordinated elections enter into an agreement with the county clerk and recorder no less than sixty
(60) days prior to the date of the election to address the allocation of responsib'flities between the
county and the political subdivision and a reasonable sharing of the costs of conducting the election;
and
WHEREAS, Section 2.1 of the Charter of the City of Aspen authorizes the City Council m
adopt an election code other than the Colorado Municipal Election Code prox4ded the alternate code
is adopted by ordinance; and
WHEREAS, the City Council desires that in the event the City Counc'fl desires to call a
special election to coincide with elections eligible to be conducted as coord'mated elections that said
municipal or special elections be coordinated with Pitldn County, Colorado, in accordance with the
Uniform Election Code of 1992 as amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COIJNCIL OF THE CITY OF
ASPEN, COLORADO:
Section 1.
That the Uniform Election Code of 1992, as amended, is hereby adopted in lieu of the
Colorado Municipal Code of 1965 for the purpose of participating in a coordinated elections with
Pitkin County, Colorado.
Section 2.
That the City Clerk of the City of Aspen is hereby authorized to take all steps necessary m
negotiate with the Pitkin County Clerk and Recorder for the preparation of an intergovernmental
agreement in accordance with Section 1-7-116, C.R.S., concenting the conduct of the coordinated
elections.
Section 3.
That if any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent provision and shall not affect the validity of the
remaining portions thereof.
Section 4.

That this ordinance shall not have any effect on existing litigation and shall not operate as an
abatement of any action or proceeding now pending under or by virtue of the ordinances amended
as herein provided, and the same shall be construed and concluded under such prior ordinances.
A public hearing on the ordinance shall be held on the-~Ta day of ~, 1996, in
the City Council Chambers, Aspen City Hall, Aspen, Colorado.
