A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN A CERTAIN
QUESTION SEEKING AUTHORITY TO PURCHASE THE MOTHER LODE
RESTAURANT AND PROPERTY WITH FUNDS GENERATED FROM THE
WHEELER OPERA HOUSE REAL ESTATE TRANSFER TAXES.
WHEREAS. the electors of the City of Aspen approved the passage of Ordinance
No. 20, Series of 1979. that imposed a real estate transfer tax for the purpose of"renovation.
reconstruction and maintenance" of the Wheeler Opera House, among other stated purposes;
and,
WHEREAS, the original vision presented to the voters in 1979 for the renovation
and remodel of the historic Wheeler Opera House included plans for an expanded Wheeler
complex totaling 24,000 square feet with adequate support facilities, including expansion of
the Opera house to the adjacent parcel of land; and
WHEREAS, the Wheeler Opera House was designed in the 1880s to accommodate
a limited schedule focusing on community events, political debates, and the occasional
traveling show; and
WHEREAS, the Wheeler Opera House today facilitates a very active programming
schedule 362 days per year with sign};t an-r~teelmi~al and sophisticated 2ls~ century
production reqmrements; and
WHEREAS, the acquisition of two additional lots adjacent to the Wheeler Opera
House property has been determined to be essential for the future operation of the Wheeler
Opera House by the Wheeler Opera House Board, users, and City staff; and,
WHEREAS. the City Council has determined to ask the voters for authorization to
use funds from the Wheeler Opera House Real Estate Transfer Tax Fund for the purchase of
Lots P & Q of Block 81 in the City of Aspen, currently occupied by the Mother Lode
Restaurant.
NOW, THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
The following question, authorizing the City of Aspen to purchase Lots N & O of
Block 81 in the City of Aspen ant the Mother Lode Restaurant located on the property with
the use of Wheeler Opera House Real Estate Transfer Funds, shall be placed on the ballot at
the November 4, 2003, election:
Shall the City of Aspen be authorized to purchase the Mother Lode
Restaurant and Lots N & O of Block 81 in the City of Aspen for the
continued and expanded operation of the Wheeler Opera House with funds
fi.om the Wheeler Opera House Real Estate Transfer Tax Fund? If approved
by the voters, the City Council intends to pay $750,000.00 in cash at Closing
and execute a promissory note to the benefit of the Seller in the amount of
$2.500.000.00 with interest at five percent for a period often years. The full
purchase price of the property and restaurant is available from the existing
Wheeler Opera House Real Estate Transfer Tax Fund.
