REVIEW PROCEDURE:
Insubstantial amendments to an approved PUD and SPA may be approved, approved with
conditions, or denied by the Community Development Director, pursuant to Land Use Code
Section 26.440.090(A), SPA Insubstantial Amendments, and Section 26.445.100(A), PUD
Insubstantial Amendments.
BACKGROUND:
The City of Aspen Parks and Recreation Department has requested approval of a PUD and
SPA amendment to allow for the installation of a thirty (30) foot tall mast as part of the
batting cages that are being erected within the Iselin PUD/SPA. A batting cage footprint was
shown in the Final PUD application that was approved pursuant to City Council Ordinance
No. 6, Series of 2001. However, the Applicant did not specify in the PUD/SPA application
the height of the batting cages. The Applicant has now realized that the batting cage will
require a mast of thirty (30) feet from grade to support the batting cage netting.
STAFF COMMENTS:
Staff believes that the batting cages were anticipated to be constructed as part of the PUD.
Additionally, it has been represented by the Applicant that thirty (30) feet is the shortest mast
that can be installed without disrupting the batting cage's operations (please see e-mail
message attached as Exhibit `B"). Therefore, because the batting cage was anticipated to be
built in the PUD and the height limit that was established in the PUD is sixty (60) feet, staff
feels that the installation of the proposed thirty (30) foot tall mast for the batting cage is
consistent with the representation made in the PUD approvals and meets the review
standards for approving an insubstantial amendment. Therefore, staff would recommend that
the Community Development Director approve the proposed PUD amendment pursuant to
Land Use Code Sections 26.440.090(A) and 26.445.100(A).

RECOMMENDATION:
Staff believes that the proposed application meets the review standards for approving an
insubstantial PUD and SPA amendment. Therefore, staff recommends that the Community
Development Director approve the proposed amendment to allow for the Applicant to erect a
thirty (30) foot tall mast as part of the batting cages that are being installed within the Iselin
PUD and SPA.
APPROVAL:
I hereby approve this insubstantial PUD and SPA amendment to the Iselin PUD/SPA to
allow for a thirty (30) foot mast to be installed as part of the batting cages at Iselin Park with
the following condition:
1. Any lighting that is installed shall meet the City of Aspen Lighting Code
pursuant to Land Use Code Section 26.575.150.

Review Criteria & Staff Findings
An insubstantial amendment to an approved development order for a final development
plan may be authorized by the Community Development Director if the following review
standards are met.
1. A change in the use or character of the development.
Staff Finding:
Staff does not believe that the proposed amendment is a change in use or a change in the
character of the PUD/SPA. The batting cage was approved as part of the PUD and a
thirty (30) foot tall mast is necessary for the batting cage's operation according to the City
Recreation Director. Staff finds this criterion to be met.
2. An increase by greater than three (3) percent in the overall coverage of structures on
the land.
Staff Finding:
The batting cage was approved as part of the Iselin Park PUD. Therefore, the Applicant
is not requesting to increase the overall coverage of the structures within the PUD over
what was approved in the original PUD. Staff finds this criterion not to be applicable to
the proposed amendment.
3. Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:
Trip generation and demand for public infrastructure are not affected by this change.
Staff finds this criterion not to be applicable to the proposed amendment.
4. A reduction by greater than three (3) percent of the approved open space.
Staff Finding:
The batting cage was approved as part of the Iselin Park PUD. Therefore, the Applicant
is not requesting a reduction in the approved open space. Staff finds this criterion not to
be applicable to the proposed amendment.
5. A reduction by greater than one(]) percent of the off-street parking and loading
space.

The Applicant is not requesting an amendment to the existing or required number of
parking spaces. Staff finds this criterion not to be applicable.
6. A reduction in required pavement widths or rights -of -way for streets and easements.
Staff Finding:
The Applicant is not proposing changes to right-of-way widths. Staff finds this criterion
not to be applicable.
7. An increase of greater than two (2) percent in the approved gross leasable floor area
of commercial buildings.
Staff Finding:
The Applicant is not proposing an increase in the approved leasable floor area. Staff
finds this criterion not to be applicable.
8. An increase by greater than one (1) percent in the approved residential density of the
development.
Staff Finding:
The applicant is not proposing a change in the residential density. Staff finds this
criterion not to be applicable.
9. Any change which is inconsistent with a condition or representation of the project's
original approval or which requires granting a further variation from the project's
approved use or dimensional requirements.
Staff Finding:
The proposed amendment is consistent with the project's original approval. Additionally,
the Applicant is not requesting to vary from the approved use or dimensional
requirements that were established in the Iselin Park PUD. Staff finds this criterion to be

Joyce,
I would like to request a PUD amendment for the Iselin Park Batting Cage. The Cage is
shown on the PUD application, but at the time of submission we did not realize that the
facility would host a 37' mast to lower and raise the netting covering the cage. We have
spoken with the manufacturer to see how this may be mitigated and he has informed us
that we may (without concern to operations) lower the mast to 30' on grade level of the
surrounding grounds. Any lower will compromise the operations of the Batting Cages.
Please consider this adjustment and let me know if there are any further concerns. Thanks,
