HomeMy WebLinkAboutordinance.council.043-96 ORDINANCE NO. -~'1~ Series of 1996 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF ASPEN BY AMENDING SECTIONS 2.12.010, 2.12.020, 2.12.030, 2.12.040, 2.12.050(b), 2.12.050(d), 2.12.050(g), 8.12.3'/0, 8.20.020(k), 8.36.020(d), 8.44.020(c), 24.08.020, 26.04.060, 26.04.0'/0, 26.04.080, and 25.08.090(d) TO INCREASE LAND USE APPLICATION FEES, HISTORIC pRESERVATION APPLICATION FEES, BUILDING PERMIT FEES, PLUMBING AND MECHANICAL PERMIT FEES, UTILITY HOOKUP FEES, ZONING PROCESSING AND ENFORCEMENT FEES, ASPEN MUNICIPAL GOLF COURSE USER FEES, ASPEN ICE GARDEN USER FEES, JAMES E. MOORE POOL USER FEES, MISCELLANEOUS LEISURE AND RECREATION DEPARTMEbrf' USER FEES, ANNUAL ALARM AND FALSE ALARM FEES, MISCELLANEOUS DOG LICENSING FEES, AND TOWING FEES. WHEREAS, the City Council has adopted a policy of annually reviewing the Community Development DeparUnent's fee structure to insure that revenues raised through the fee structure are sufficient to pay for the attendant costs of the DeparUnent; and WHEREAS, the City Council has determined that the current fee structure for the processing of land use applications, historic landmark and reviews, zoning application processing and enforcement fees, plumbing and mechanical permit fees, and building permit fees d° not accurately reflect the current cost of providing the necessary level of services associated with administering the land use provisions of the Municipal Code; and WHEREAS, the City Council has adopted a policy of requiring consumers and users of the City's Ice Garden, Municipal Golf Course, and miscellaneous Recreation Depamnent programs to pay fees that fairly approximate the costs of providing such recreational opportunities; and WHEREAS, the City Council has determined that certain user fees currently in effect do not raise revenues sufficient to pa,¥ for the attendant costs of providing said recreational and leisure services; and ' WHEREAS, requests for services by alarm companies, including false alarms, require significant police department resources to adequately respond to such requests and ttnneceSgBJ-i, ly divert financial resources and law enforcement personnel from other community needs; and WHEREAS, statistical data maintained by the Aspen Police Department of the number of false alarms responded to by Police Depathnent personnel reveal that some emergency alarm users suffer disproportionate numbers of false alarms; and WHEREAS, the City Council desires to increase fees charged for annual emergency alarm user permits and for responding to false alarms fees; and WHEREAS, the City Council deems it to be in the best interest of the City of Aspen, its residents and visitors to amend the Emergency Alarm Systems and Protection Services ordinance as herein provided; and WHEREAS, the City Council desires to increase fees charged for annual dog licensing tags to raise revenues sufficient to pay for the attendant costs of such licensing activity; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 2.12.010 of the Municipal Code of the City of Aspen, Colorado, which section sets the applicable fees for the Aspen Municipal Golf Course, is hereby amended to read as follows: Sec. 2~L2.010. Custom Contour Information 2 foot contours can be generated for areas around the metro ar~. 10 foot contours can be generated for areas outside the metro area. The minimum charge is $350 for areas under 40 acres, on one aerial photograph. Areas larger than this will need to be priced individually. Areas that fall on the edges of the photography or on more than one photo will cost more. The base charge is only for the generation of the contours. Additional programming will be charged at $125 per hour. Analysis Analysis can be done for population impacts (census data), slope analysis (contour information), special impact areas (EPA site, zoning requirements, historical areas, etc.). $125 per hour programming time. Section 12 That Section 24.08.020 of the Municipal Code of the City of Aspen, Colorado, which section establishes charges for the release of towed vehicles, shall be amended to read a follows: Sec. 24.08.020 Charges for release; penalty. It shall be unlawful for any person to move or take possession of any vehicle moved,,' removed, stored, or impounded as provided for in this article without first securing a cerfifica~ of no probable cause issued in accordance with Section 24.08.030(0 or paying the charge for towing, removing, storing or impounding such vehicle plus a processing fee as set forth at Section 2.12.050(b). 16 That Section 26.04.060 of the Municipal Code of the City of Aspen, Colorado, which section establishes ][and use application and processing fees, is hereby amended to read as follows: Sec. 26.04.060. (b) The Community Development Department staff shall keep an accurate record of the actual time required for the processing of each land use application and Additional Billings shall be made commena~rate with the additional costs incurred by the City when the processing of an application by the Community Development Depat hnent takes more time than is covered by the Base Fee. In the event the processing of an application by the Community Development Department takes less time than provided for in subsection (a), the Department shall refund the unused portion of the Base Fee. 17 (c) The following guidelines shall be used for the administration of the fee structure set forth above: (1) Fees charged for the processing of applications which fall into more than one category shall be cumulative; while the fees charged for the processing of applications within the same category shall not be cumulative. In the event that the fees which result from cumulation are found by the Community Development Department to be e×eessive in relation to the number of hours it is anticipated to require to process the application, the Community Development Department may waive the cumulation requirement. (2) Additional Billings shall be based solely on processing time spent by members of the Community Development Department or it's designee in the pro~ssLng of an application. (3) Additional Billings shall be computed at the rate of one hundred eighty ($180.00) per hour of additional Community Development Dep~utu~ent staff time required. Refunds of unused hours shall be made at the rate of one hundred eighty ($180.00) per hour of time. (4) The Community Development Director shall establish appropriate guidelines for the collection of Additional Billings as required. (5) This fee structure shall be reviewed annually as part of the City of Aspen's budget hearing process and should any adjustments be necessary, they shall be changed to become e e tive on (6) The Community Development Department shall identify, prior to or at the time of submission of a land use application, whether an application is to be referred to the Engineering, Housing, or Environmental Health DeparUnents. The Community Development Department shall also identify whether an application constitutes a minor or a major referral, based on the number of hours which will be required to review the application, and charge die applicant for each referral accordingly. Additional Billings and Refunds shall not apply to the computation of referral fees. Section 14 That Section 26.04.070 of the Municipal Code of the City of Aspen, Colorado, which section establishes historic preservation application and processing fees, is hereby amended to read as follows: Sec. 26.~4.070. Minor Development .................................................... $ 120.00 Exmnple: Exterior changes (in combination of no more than three) that do not alter the character of landmarks or structures located within historic districts, and/or additions of less than 250 square feet to landmarks or structures located within historic districts, and minor' changes to designated sites. These are considered one-step applications and go before the HPC. A public hearing is not required. IlL Significant Development (Under 1,000 sq. ft.) ....................... $ 300.00 Example: Multiple exterior changes, additions of less than 1,000 square feet (between 250-1000sq. ft.), and some partial demolitions. These are two-step applications that require a public hearing before the HPC at Conceptual Development (first step). Publication, posting and mailing are required for all HPC public hearings. Significant Development (Over 1,000 sq. ft.) ......................... $ 600.00 Example: Major remodels involving partial demolition, additions over 1,000 square feet and on-sim relocations.
