Mayor Bennett called the special meeting to order at 4:35 in the
second floor Council Chambers with Councilmembers Reno, Richards,
Pendleton and Peters present.
ORDINANCE #46, SERIES OF 1992 - Ballot Questions
Jed Caswall, city attorney, presented two alternates to the bond
question for the purchase of the Red Brick school. Councilmembers
Reno, Peters and Mayor Bennett preferred the simpler and less
confusing language. Mayor Bennett asked if Council wanted to add a
sentence, "These bonds will not result in any further tax increase
to the citizens of Aspen". Councilman Peters said he is not sure
it is true the property taxes will not go up.
Councilwom an Pendleton said she does not want to put this sentence
in; she wants it kept simple. Councilwoman Pendleton said the
question should state exactly what the city is going to do; ask for
$3.6 million for the Red Brick school to be used by the arts and
non-profits. Councilwoman Pendleton said the rest of the discus-
sion can be in the campaign. Mayor Bennett said he likes a full
disclosure and it seems like something is being left out.
Councilman Peters said he does not want the voters to be mislead
that Council in 1996 will not raise property taxes to fund
additional city expenses.
Amy Margerum, city manager, noted when Council set the mill levy in
1992, an amount was allocated for purchase of the Red Brick school.
Councilman Peters said he understands the Mayor's point of view
that this sentence will help pass the ballot question; however, it
is not an uncontrovertible fact. Caswall told Council he looked at
past ballot questions and they do not make references to whether
the taxes will go up or down.
Mayor Bennett opened the public hearing.
Someone asked if this ballot question would preclude additions to
the building in the future. Councilman Peters said this will not
fund it. Si Coleman suggested adding "for rental to arts and non-
profits". Ms. Margerum pointed out this will be used by the
recreation depart ment and other community u ses that it will not be
rented to.
Mayor Bennett said there are two Charter amendments on the ballot
also. Coleman asked if the Council could pass a project like the
Ritz without a public hearing. Caswall pointed out the Land Use
Code spells out the public hearing requirements.
Mayor Bennett closed the public hearing.

Councilman Peters moved to adopt Ordinance #46, Series of 1992, on
second reading amended to reflect the language in alternative B;
seconded by Councilwoman Richards. Roll call vote; Councilmembers
Reno, yes; Pendleton, yes; Peters, yes; Richards, yes; Mayor
Bennett, yes. Motion carried.
Councilwoman Pendleton moved to adjourn at 5:00 p.m.; seconded by
Councilman Peters. All in favor, motion carried.
