HomeMy WebLinkAboutresolution.apz.042-99RESOLUTION OF THE PLANNING AND ZONING COMMISSION APPROVING AN APPLICATION FOR VARIANCES FROM THE RESIDENTIAL DESIGN STANDARDS RELATING TO BUILD-TO LINE, SECONDARY MASS, AND BUILDING ELEMENTS FOR 518 W. FRANCIS STREET, LOTS P AND 0, BLOCK 27, CITY AND TOWNSITE OF ASPEN, COLORADO RESOLUTION NO. 42, SERIES OF 1999 PARCEL ID NO, 2735-124-10-006 WHEREAS, the applicant, Christopher Hewett, represented by Start Mathis, has requested variances from the "Residential Design Standards" for the property located at 518 W. Francis; and WHEREAS, all applications for appeal from the Residential Design Standards of Section 26.410.030 must meet one of the following statements in order for the Design Review Appeal Committee or other decision making administrative body to grant an exception, namely the proposal must: a) b) yield greater compliance with the goals of the Aspen Area Community Plan; more effectively address the issue or problem a given standard or provision responds to; or be clearly necessary for reasons of fairness related to unusual site specific constraints, and WHEREAS, Amy Guthrie, in her staff report dated December 14, 1999, recommended approval of the variances from the "build-to line," "secondary mass," and "building elements," based on a finding that "Criteria C" is met; and WHEREAS, a public hearing, which was legally noticed, was held at a regular meeting of the Planning and Zoning Commission on December 14, 1999, at which the Commission considered and approved the variances by a vote of 6 to 0. NOW, THEREFORE, BE IT RESOLVED: That variances have been granted from the "build-to line," "secondary mass," and "building elements" standards based on criteria c for the building at 518 W. Francis Street, Lots P&O, Block 27, City and Townsite of Aspen, Colorado, as presented to the Planning and Zoning Commission on December 14, 1999, without conditions. APPROVED BY THE PLANNING AND ZONING COMMISSION at its regular meeting on the 14th day of December, 1999.
