Bob Blaich opened the regular meeting at 4:30 p.m. Commissioners Ron Erickson,
Roger Hunt, Steven Buettow, Jasmine Tygre and Bob Blalch were present. Tim
Semrau arrived at 4:50 p.m. and Tim Mooney was excused. City staffin
attendance: David Hoefer, Assistant City Attorney; $oyce Ohlson, Sarah Oates,
Community Development; Jackie Lothian, Deputy City Clerk.
COMMISSIONER, STAFF & PUBLIC COMMENTS
Jasmine Tygre stated that she would not be back until the last week of May. Bob
Blaich and Roger Hunt will be gone until the end of May also.

MOTION: Roger Hunt moved to adopt the minutes of April 6, 1999.
Jasmine Tygre second. APPROVED 5-0.

PUBLIC HEARING:
BRIEN CONDITIONAL USE FOR AN ADU & VARIANCE FROM
RESIDNETIAL DESIGN STANDARDS, LOT 44 WEST ASPEN
SUBDIVISION
Bob Blalch opened the public hearing. Rochelle Bouchard introduced herself and
stated that she represented Alice Brien. $oyce Ohlson explain the property was a
vacant parcel 05,734 square feet in the R-15 zone district) located at the
intersection of Cemetery Lane and Silver King Drive. The proposed single family
dwelling (3,408 square feet) included a 439 square foot ADU requiting conditional
use review. Ohlson stated that the notice was received. David Hoefer requested
the list of mailing. John Muir replied that he did not have it with him. Hoefer
requested that Muir supply the list to the City Clerk's Office. Hoefer noted the
criteria sheet for the Review Standards was distributed to the commissioners.
Ohlson noted that the site was very steep and was developed across this property;
Alice Brien has worked with the City to relocate that trail. There was an
agreement between the city and Brien on the Wail being developed. She noted the
other department comments have been written into the conditions for approval.

Ohlson said that the ADU would be deed-restricted, meeting the homing
guidelines of rental periods of not less than 6 months; the criteria for the ADU
have been met with it's own access and parking space. She said there were several
ADUs and existing duplexes in the neighborhood.
Ohlson stated that there were 2 variances to the Residential Design Standards
volume standard and ® garage placement standard. Bouchard noted the north
arrows on the plans were incorrect. Ohlson read the Design Review Standards: (ar)
greater compliance with the goals of the Aspen Area Community Plan; (b) a more
effective method of addressing the standard in question (c) clearly necessary for
reasons of fairness related to unusual site specific constraints. She noted the site-
specific constraints were problematic with the steep site and a more effective way
to address the garage standard met the criteria for the garage placement variance.
Ohlson stated that the volume standard required th-at any windows between 9' and
12'(drawing A 3.1 and 3.2) above the height of the floor plate result in a doubling
of the floor area calculation for the respective room. Ohlson noted there would
need to be a change to the plans if the Review Board denied the variance. She
noted there were a series of conditions attached to the approval.
Jasmine Tygre asked why there was access to the main house from the ADU. John i
Muir replied that it was for access to the laundry room. Roger Hunt asked if there
would be double doom for the ADU or single entrance on either side of the laundry
room. Muir replied that either could be considered.
Steven Buettow asked if the parking space required a hammerhead mm and where
the access was to the ADU from that parking space. Muir replied that the width of
that space might have to be expanded and the ADU was on the east side of the
building. Muir said 2 sides of the ADU were fully exposed to light and ventilation.
Muir said that they would provide the turn around space in addition to the ADU
parking; added as condition "2k".
Roger Hunt requested that there be one vote and one resolution.
Ron Erickson asked why the commission was always dealing with this same issue
for windows between 9' and 12' requesting a variance from the Residential Design
Standards, volume standard. Mitch Haas responded that the reasons stemmed from
window being placed next to doors and above doom to give the grandiose effect
with lights shining out. Blaich stated that Ordinance 30 came about because of
these windows. Erickson asked how high this building was from the ground level

at the garage. Muir answered that the top of the roof was lowered because there
was a height problem and the transom windows were eliminated.
Muir stated that this was the most difficult site that he had ever designed a house
for without having the home seem perched on top of the hill plus making the
driveway to the garage work. He said that they tried to tier the elements to work
with the slope. He said they wanted to create a home with a positive impact and
presence using windows as part of the attractiveness of the house. He said there
was a landscape plan to screen the house fi.om the street and none of the elements
were two-story, but rather a story and a half. Muir stated there was a break after
of wood or stone for a foot or two.
No public comments.
Tim Semrau stated that he like how the garage faced away and suggested breaking
up the one large window as the other ones were broken up on the east elevation.
Muir agreed and stated the overall height of the window would be reduced, leaving
the head where it was and bringing the windows to 9' with a one foot band.
The conunissioners reworded the resolution as amended in the motion and final
resolutiol~ The applicant did not have to return to the commission or appear
before DRAC because these conditions were accepted.
MOTION: Roger Hunt moved to adopt Resolution #99-11 to approve
a conditional use allowing an Accessory Dwelling Unit, to approve a
variance to the Design Standard for the garage placement and a
variance to the Design Standard regarding volume/windows on Lot 44
West Aspen Subdivision with the conditions #1-14 plus the addition of
21~ that will expect the hammerhead parking to include a designated
space for the ADU as well as turn around space, 21. recommending (non-
binding) separating the inner unit suite doors to single doors on either
side of the laundry. Condition #14. added: The plans be amended to
show window on the east elevation plan (page A3.1) on the masonry face
to be changed to include a one foot wooden band to practically separate
the transom windows from the large face windows and (plan A 3.2) the
transom windows be eliminated. Ail plans were subject to review by the
community development staff. Ron Erickson second. Semrau, yes;
Buettow, yes; Tygre, yes; Erickson, yes; Hunt, yes; Blaieh, yes.
APPROVED 6-0.

The commission adjourned into a work session with housing and resumed the
public hearings at 6:45 p.m.

PUBLIC HEARING:
2 WILLIAMS WAY ADDITION TO HISTORIC SITES AND STRUCTURES
INVENTORY I
Bob Blaich opened the public hearing on 2 Williams Way. David Hoefer stated foi'
the record the notice was provided and met the requirements. Steven Bnettow
stepped down for this public hearing.
Sarah Oates explained that the property was currently rezone& Oates provided the
history of the property dating from when the Warkentine family bulk the house in
the 1880's. Oates said Scott Hicks and Maureen Kinney currently owned the
property. Oates said that this structure contained 2 parts the west side of the house
which was original to the site with significant changes adding triangular windows
to the gables. The east side of the building was a house built in the 1880's but
moved to the site in the 1960's and joined with the center part ofthe house that was
built in the 1960's. She noted that this was the only house remaining from a
neighborhood that was platted in 1893.
Oates stated that the applicant was the City of Aspen for historical designation but
current owners of the house chose not to attend the meeting tonight. The owners
made a presentation to HPC opposing being added to the Historic Inventory.
(HPC recommended the addition of this property to the Historic Sites and
Structures Inventory with a vote of 7-0.) Oates noted the criteria for a property to
be included on the inventory: the structure must be at least (50) fifty years old
and have special value and be unique to the community. Oates said there were
three tiers for a grading system for historic houses: (I) significant ~) contributing
and ® supporting. She noted that the house had lost the original integrity but that
it was retrievable with substantial alterations; staff recommended approval of
adding 2 Williams Way to the Historical Sites and Structures Inventory.
David Hoefer stated the open space in front of the house was purchased by the city
and will be made into a neighborhood park.
Ron Erickson asked if the owners were not in favor of this Historic designation,
why was the city pursuing the designation. Oates replied that the property was not
annexed into the city until 1992 and the last comprehensive survey of historic
inventoried sites was done in 1991. Oates stated that City Council requested this

property be added to the inventory; the inventory list was scheduled for update this
fall. Erickson asked why not wait until fall. Hoefer responded that it was to
protect the property.

MOTION: Roger I-Innt moved to adopt Resointion #99-10
recommending approval of adding 2 Williams Way to the Itistorie Sltei
and Strnetures Inventory to City Conneil finding that the criteria of
supporting structure have been met. Jasmine Tygre second.
APPROVED 5-0.
