Mayor Bennett opened the continued meeting at 5:05 p.m. with Councilmembers
Waggaman, Pauls, Marolt and Richards present.
SWEARING-IN NEW COUNCIL AND MAYOR
Municipal Judge Brooke Peterson administered the oath of office to max Marolt and
Rachel Richards as Councilmembers and to John Bennett as Mayor.
COUNCILMEMBER COMMENTS
1. Councilman marolt said he appreciated his support to be elected Council.
Councilman marolt said he likes Aspenv ery much and is interested in the progress
into the future.
2. Councilwoman Richards thanked everyone who participated in her campaign.
Councilwoman Richards said she is convinced Aspen is the best place to livew.
3. Mayor Bennett thanked everyone who help to re-elect him Mayor. Mayor
Bennett said he will work to his utmost ability to maintain and enhance the character
of aspen.
ORDINANCE #29, 1995 - L’Auberge Housing Mitigation Vested Rights
Leslie Lamont, community development department, reminded Council they
received revised the growth management system for lodge and residential.
L’Auberge is requesting allocation of the 1994 lodge allotments. The 1994
competition was pushed to 1995. There was only a submittal from L’Auberge who
is requesting 12 units; 11 units from the 1994 allotment and one multi-year allotment
from 1995. Ms. Lamont told Council there is also a text amendment to the land use
code to allow lodges in the office district as a conditional use.
Ms. Lamont told Council this project has been to HPC for full review as Main street
is in the historic overlay district. P & Z recommended the text amendment and
reviewed the conditional use pending Council’s decision on the text amendment.
The city and county P & Zs reviewed amd scored the project as one of the first joint
scoring projects. The P & Zs found the project exceeded the threshold. Ms.
Lamont said Council’s acceptance of the growth management score is done by
resolution. Another issue for Council to deicde is the method of employee housing

mitigation. The housing office suggests that one unit on the property be deed
restricted to category 2.
Gideon Kaufman, representing the applicants, told Council they will either pay cash-
in-lieu 100 percent for employee housing mitigation or deed restricte one unit on
site. The housing office and building department are satisfied with unit 7. The
housing office and applicant have agreed to category 2 rental; however, if the person
is an employee of the lodge, they can have a category 3 income. Kaufman said one
problem is that these units generally have a 6 month lease. These do not necessarily
coincide with the season. Kaufman said they would like to be able to house
someone seasonally if they are not tied to lodge employment.
Mayor Bennett opened the public heaering. There were no comments. Mayor
Bennett closed the public hearing.
Councilwoman Richards said she sympathizes with the housing dilemma; however,
she would like the housing board to look at the seasonal housing versus 6 month
housing. Ms. Lamont said she would like a direction from Council so that if the
housing board approves, she does not have to come back and amend the ordinance.
Councilwoman Waggaman moved to adopt Ordinance # , Series of 1995, on second
reading with the following changes; Section 1 the applicant shall deed restricte unit
7 on parcel as identified on the proposed site plan; the unit shall be deed restricted
category 2 in the rental guidelines but the occupants, if employees of the lodge, may
meet the income guidelines of category 3; seconded by Councilwoman Richards.
Councilman Paulson asked about the trees. Dave Givson said very few trees will be
remove. An equal or greater number of trees will be replaced.
Roll call vote; Councilmembers Paulson, yes; Richards, yes; marolt, abstain;
Waggaman, yes; Mayor Bennett, yes. Motion carried.
ORDINANCE #31, SERIES OF 1995 - Code Amendment Office Zone
Leslie Lamont, planning office, told Council lodges are not a permitted use in the
office zone. The L’Auberg applicants have proposed an amendment to the office
zone district to allow lodges as a conditional use. The applicants originally
proposed allowing kitchens. P & Z felt the kitchen issue should be left for the small

lodge discussion. P & Z approved the conditional use of L’Auberge lodge on Main
street pending Council’s approval.
Ms. Lamont said staff also looked at rezoning. The LP zone district has a definition
of internal floor area in an attempt to make sure there were guest amenity areas.
The amenities for L’Auberge are external. L’Auberge felt they would be better as a
conditional use in the office zonee. Any changes to the lodge would be a conditonal
use review and would require a hearing before P & Z.
Mayor Bennett opene the public hearing. There were no comments. Mayor Bennett
closed the public hearing.
Councilwoman Richards moved to adopt Ordinance #31, Series of 1995, on second
reading, with the specific amendment that should the condition use of lodges in the
office zone district allow kitchens, this applicant does not need to go back through
the process; seconded by Councilwoman Waggaman. Roll call vote;
Councilmembers Waggaman, yes; Paulson, yes; Richards, yes; Marolt, abstain,
Mayor Bennett, yes. Motion carried.
Councilwoman Waggaman moved to move Resolution #35, Series of 1995,
L’Auberge GMQS Lodge Allocation, to the consent calendar; seconded by
Councilwoman Richards. All in favor, motion carried.
Councilwoman Waggaman moved to take Ordinances 26 and 30 from the table;
seconded by Councilwoman Richards. All in favor, motion carried.
ORDINANCE #26, SERIES OF 1995 - Aspen Center for Physics Final SPA Plan
Stan Clauson, community development director, provided Council with a list of
conditions drafted from the Council meeting last night. Clauson read these
conditions:
Councilman Marolt said this is a wonderful project and he supports it. Councilman
Marolt said 3 properties will be impacted and asked the ramifications of moving the
building 30 feet to the north. Harry Teague, architect, told Council they looked at
moving it north; however, as it is moved north, it has to go along the embankment
and there is a sewer easement which would have a significant financial impact.
Moving the building north would also cause a lot of trees to have to be cut down or
moved. Teague siad he feels this scheme affects the least number of people.
