The following commissioners were present: Eric Cohen, P~oger Haneman, P~on Erickson, Jasmine Tygre and Bob Blaich. Steven Buettow was excused. Staff in attendance were: David Hoefer, Assistant City Attorney; Joyce Ohlson, Community Development; Jackie Lothian, Deputy City Clerk. COM3~ISSIONER & STAFF COMMENTS Ron Erickson asked i£the letter went out to the MAA regarding the music tern and special events. Joyce Ohlson replied that she would send the letter. Erickson asked about the Caribou Alley. Roger Haneman requested to be excused at 6:30 pm. Joyce Ohlson stated that there was a special brown bag meeting on time-shares. Ohlson stated that the Ordinance would follow the P&Z Resolution unless there were major changes requested by Council DECLARATION OF CONFLICTS OF INTEREST None. CONTINUED PUBLIC HEARING (03/06/01): BAVARIAN FINAL PUD Bob Blaich opened the public hearing on the Bavarian Final PUD. Joyce Ohlson stated the items for the final planned unit development for the Bavarian were subdivision, rezoning request proposed, GMQS for the affordable housing and special review for parking. The applicant was Savannah Limited Partnership with Sunny Vann as the planner. Ohlson provided the overview of the project with the re-development of the Bavarian Inn; the total project provided for sale 19 deed-restricted affordable housing units (40 bedrooms with 31 parking spaces). The proposed zoning was to R2ViF/PUD. Ohlson noted that there were a significant amount of trees on the property that would remain; the end unit was minimized to include the trees. Ohlson said that the 31 spaces were primarily located off of the alley. There was much concern about the alley (Exhibit #4); there would be right turn only from the alley to minimize traffic in the alley. Service and Emergency vehicles only were allowed on the south end. Ohlson stated that all the roofs would be ~lat and the architecture was reviewed by HPC without any comments. There was no commitment for the re-location of the 2 ASPEN PLANNING & ZONING COMMISSION March 20, 2001 cabins that were being removed at this time. The landscape plan was included, the curb and gutter was part of the improvements along with a lighting plan. Ohlson noted that there were changes to the resolution with the transfer from Savannah to Bavarian Affordable Housing LLC and P&Z was the final authority on the special review. There was a condition that allowed not required Grand Aspen Employees the ability to utilize this housing. Sunny Vann stated that the conditions were acceptable after many revisions that were discussed with the neighborhood. Vann said that there were requests from the neighbors for the placement of the dumpsters, changes in the fenestration on the windows, removal of the decks and prohibition of dogs. Ron Erickson asked how the surrounding properties treated allowing dogs. Most of the surrounding properties did not allow dogs. Erickson asked for the price range of the affordable housing units. Vann replied that the size of the unit dictated the pricing set by housing guidelines. David Brown, architect, stated that there were 17 existing units and the housing guidelines were on the housing website. Bonnie Murry, public, stated that the new owners did not contact them; this was a one-time offer to upgrade the outside of the existing Bavarian that should be taken advantage of at this time. Ms. Murry asked the commission to visit the Bavarian Inn site because much of thc fascia had deteriorated and needed replacement not just repainting. Murry said that they supported the project but would like to see more upgrades to the Bavarian building. Vann responded that the housing authority imposed certain standards for conversion of structures; he said that these minimum requirements were contained in condition #7 with acceptance of the deed-restriction. Nancy Hendricks, public, stated that she represented herself and 35 of the Villas of Aspen neighbors. Hendricks asked the time limits of construction. Vann replied that Savannah submitted the construction agreements, but the new owners have submitted new conceptual for Lots 3 & 5 therefore this project would also change the timeline. Gail Hughes, public, stated that there was a conflict in the application regarding the building code regulations. Vann responded that prior to acceptance of the units by the housing authority, the units must be brought in compliance with the uniform building code. 3 ASPEN PLANNING & ZONING COMMISSION March 20, 2001 Herb Klein, public, stated that his issues were details because staff and the applicant did a very good job with the neighborhood. Klein asked that the dnmpster be moved to the east of the parking because it would function better; keep the alley open but with limited access to emergency vehicles. He asked for more signage that the developer agreed to provide. Klein stated that there was no condition about long-term replacement of trees; he suggested that the homeowners association provide an assessment reserve be set up for long term landscaping. Klein said that there was a neighborhood issue about dogs; when Highway 82 was extended then there wouldn't be access to the Marolt area. He asked that the north side decks be eliminated because in the winter they wouldn't be usable and because of the proximity to his house; it was a privacy issue. David Hoefer stated that the tree removal permitting process required that if a tree died and had to be removed, it also had to be replaced in the city. Hoefer stated that there could be a condition that the fee for cutting down the tree be placed into a contingency plan for landscaping. Paul Murry, public, asked who in the city watched over the trees so someone didn't dig in the drip lines. Hoefer answered that there was a city forester who watches over the trees in the city. Blaich noted that the city forester was very good about coming out to check on projects. Bonnie Murry asked if there could be a condition stipulating that the large trees be fenced and protected. Vann responded that they were required to have a landscape plan but the developer couldn't be obligated forever to replace trees and landscaping on the project. Nancy Hendrick, public, stated that some owners were not taking care of their property, trees and landscaping. Bonnie Murry asked for a provision for construction parking. Ohlson replied that Condition #20 addressed construction parking. Ohlson wrote down the recommended conditions and the commissioners discussed the following: On Parcel 2 the dumpster site be moved to the east side parking lot; prohibit digging within the drip line of trees amended to condition #11; c!imin~ion Vann stated that the elimination of rooftop decks on the north side of the south building was placed into the record as a condition by the applicant. 4 ASPEN PLANNING & ZONING COMMISSION March 20~ 2001 Hoefer read the code construction hours were 7 am to 7pm Monday through Saturday with no construction on Sundays. Blaich and Tygre stated that making special construction times for this project would be trouble for the commission at a later date. Roger Haneman excused himself at 6:30. Vann said that the Bavarian Inn would be brought up to the UBC prior to the execution of certificate of occupancy and approved by the housing guidelines. Erickson stated that the project had a good conceptual plan followed by this final review; he said that this was a good project. MOTION: Eric Cohen moved to recommend that City Council approve P&Z Resolution #12, series 2001, for the Bavarian Inn Affordable Housing for the final PUD Agreement, Subdivision, Rezoning from R-15 to RMF/PUD for parcel 2 and Exemption from GMQS with the following conditions: a) The approved dimensional requirements for the property in a tabular format, b) The information required in Section 26.445.070(C). c) A parking management plan that details the marketing, taxi voucher, and free bicycle programs that will be implemented by the hotel operator. 2). A Final PUD Plan shall be recorded within 180 days of thc final approval granted by City Council and shall include: a) A final plat meeting the requirements of the City Engineer and showing easements, encroachment agreements and Hcenses with reception numbers for any physical improvements within City rights-of-way, and location of utility pedestals. If any utility mains are to be relocated, those new locations must be shown. If any utility mains exist in the vacated alley, easements shall be granted if not already established, b) An illustrative site plan of the project showing the proposed improvements, landscaping, parking, and the approved dimensional requirements in a tabular format, c) A drawing representing the project's architectural character, d) A lighting plan demonstrating compliance with the City Lighting Regulations. e) A geometric design of the Main Street loading pull-ont area with a signature line for the City Engineer. f) A drainage plan, including an erosion control plan, prepared by a Colorado licensed Civil Engineer maintaining drainage and sediment on-site during and after construction. If a ground recharge system is required, a soil percolation report will be required to correctly size the facility. A 2-year storm frequency should be used in designing any drainage improvements. 3.) Prior to application for a building permit being accepted by the Building Department the applicant shall: a) Record the PUD Agreement and the Final PUD Plans. b) Gain final approval from the Historic Preservation Commission. c) Deed restrict the two one-bedroom employee units to Category 2, or lower, with the Aspen/Pitkin County Housing Authority. d) Deed restrict the two one-bedroom employee units to employees of Hotel Aspen, or its successors or assigns, e) Review a PM10 mitigation plan with the City Environmental Health Department. 4.)The building permit application shall include:'a) A copy of the final PUD Ordinance, recorded PUD Agreement, and the applicable HPC approval documents, b) The conditions of approval placed on the project by for Planning and Zoning c) Commission, City Council, and the Historic Preservation Commission approvals printed on the cover page of the building permit set. d) A completed tap permit for service with the Aspen Consolidated Sanitation District. e) A tree removal permit as required by the City Parks Department. 0 A completed agreement to join any future improvement districts formed for the purpose of constructing improvements in 5 ASPEN PLANNING & ZONING COMMISSION March 20, 2001 adjacent public rights-of~way, g) Construction drawings for improvements to the Main Street right-of-way for approval by City Engineering. h) An encroachment license for the parking area within the Bieeker Street right-of-way for approval by the City Engineer. This encroachment may also require a lease agreement with the City. i) Encroachment licenses for existing unlicensed improvements in public right-of-way. ]) Construction drawings for improvements to the Garmisch Street right-of-way for approval by City Engineering. 5.) Prior to issuance of a building permit: a) The primary con~ractor shall submit a letter to the Community Development Director stating that the conditions of approval have been read and understood, b) All tap fees, impacts fees, and building permit fees shall be paid. 6.) The applicant shall encourage visitors to not rent a car when staying at the Hotel Aspen through marketing information, supply free taxi vouchers to guests, and the free use of bicycles to guests. The Hotel manager shah use day parking passes available through the City Parking Department for off-site guest parking. The details of this ongoing obligation shall be included in the PUD agreement. 7.) Two parking spaces shah be made available and signed for the employee units. 8.) All construction vehicles, materials, and debris shah be maintained on-site and not within public rights-of-way unless specifically approved by the Director of the Streets Department. All vehicle parking, including contractors' and their employees', shah abide by the 2 hour residential parking limitation of the area unless an exemption is granted by the Parking Department. The applicant shall inform the contractor of this condition. 9.) The applicant shall abide by ail noise ordinances. Construction activity is limited to the hours between 7 a.m. and 7 p.m. with no construction activity on Sundays. 10.) Prior to issuance of a Certificate of Occupancy or Certificate of Completion for the employee units, a member of the Aspen/Pitkin County. Housing Authority shall inspect the units to determine if the units comply with the representations made in the application. 11.) Before issuance of a building permit, the applicant shall record this Planning and Zoning Resolution with the Pitkin County Clerk and Recorder located in the Courthouse Plaza Building. There is a per page recordation fee. In the alternative, the applicant may pay this fee to the City Clerkwho will record the resolution, gon Erickson seconded. Roll call vote: Tygre, yes; Erickson, yes; Cohen, yes; Blaich, yes. APPROVED 4-0. Tygre stated that the good will of the neighbors and applicant helped this project but having the project go through the entire process of conceptual then final approval also aided in the process. She noted that the consolidated process seemed to have problems. Ohlson noted that some projects probably took longer when consolidated. OTHER BUSINESS: Burlingame Housing COWOP Michelle Bonfils, housing staff, provided the uPdate and named the task force team. She provided a brief summary of guidelines for the Bar~X/Burlingame plan.
