Jasmine Tygre opened the regular Planning and Zoning meeting at 4:30 p.m. in
Council Chambers with Roger Haneman, Bert Myrin, Eric Cohen and Ruth
Kruger. Ron Erickson was excused. Staff in attendance were: Joyce Ohlson,
James, Lindt, Amy Guthrie, Community Development; Jackie Lothian, Deputy
City Clerk.
COMMISSIONER, STAFF and PUBLIC COMMENTS
Roger Haneman asked how the P&Z recruiting process was going. Jackie Lothian
replied that there were 2 applicants so far but Council has not begun the interview
process as yet.
Eric Cohen asked if P&Z was named in the Hyatt lawsuit; he asked what was
going to happen with the big hole in the ground for winter. Lothian responded that
the minutes from P&Z were requested. Joyce Ohlson suggested that Eric call the
city attorney. Cohen stated that there was an American Flag taking up %2 of the
sidewalk in front of the Four Peaks office. Cohen asked about the Highlands
Market last weekend (6/29-6/3 0) and if it was an on -going weekly event.

MOTION: Bert Myrin moved to approve the minutes from the GMC
June 4, 2002, P&Z June 4, 2002 and June 11, 2002.. Ruth Kruger
seconded. APPROVED 5-0.

CONTINUED PUBLIC HEARING (05/28/02):
BAVARIAN INN PUD AMENDMENT
Jasmine Tygre opened the public hearing for the Bavarian Inn PUD Amendment.
Notice had been provided at the May 28th meeting. Joyce Ohlson stated that the
applicants have requested that the issue be pulled from the schedule and no action.
be taken closing the public hearing. It would have to be re -noticed and
rescheduled.
MOTION: Bert Myrin moved to close the public hearing on the
Bavarian Inn PUD Amendment and remove it from the agenda. Roger
Haneman seconded. APPROVED 5-0.

PUBLIC HEARING:
LITTLE AJAX CONSOLIDATED CONCEPTUAL/FINAL PUD
Jasmine Tygre opened the public hearing and the public notice was provided.
Joyce Ohlson explained that the applicant requested a continuation of the hearing
because the filing requirement was not met on the final application. The planning
commission and city council conceptually reviewed this with a requirement for
geologic survey to evaluate and report on slope stability, potential for substance
and geologic impacts to this development. A representative from the Colorado
Geologist Survey was to complete the report by next week with concerns on the
unstable slopes, potential for landslide, rock fall and potential for land substance
because of the prior mining activity.
There was a letter from Donna Fischer dated July 1 St placed into the public record.
MOTION: Ruth Kruger moved to continue the public hearing for the
Little Ajax Consolidated Conceptual/Final PUD to July 16, 2002;
seconded by Bert Myrin. APPROVED 5-0.
PUBLIC HEARING:
LOT 5 RIO GRANDE SUBDIVISION SPA AMENDMENT
Jasmine Tygre opened the public hearing on Lot 5, Rio Grande Subdivision SPA
Amendment. The proof of notice was provided. James Lindt stated that the
Specially Planned Area Amendment for Lot 5 Rio Grande Subdivision was to
allow for the addition of 4 parking spaces and a new curb cut; an amendment to the
Rio Grande SPA required a 2-step review, planning & zoning was the
recommending body to city council.
Lindt utilized drawings to show the 4-asphalt parking spaces off of East Bleeker
Street with additional landscaping to screen it from the bike path. Lindt said Lot 5
was directly on the North side of the Pitkin County Jail; this was to be used as a
service entrance into the jail with new doors. Lindt said that there were no plans to
remodel the jail at this time. There was no conflict with the Obermeyer COWOP,
which he distributed a site plan with Obermeyer on it. Staff proposed a condition
of approval that allowed the community development director to approve minor
site plan amendments as needed if the Obermeyer COWOP was approved. Staff
felt that this proposal met the review standards for an SPA Amendment.
Stan Clauson, representative for Pitkin County, introduced Jody Smith the county
project manager and Jennifer Dolecki the landscape architect. Clauson said this
was part of a reorganization of the County's utility spaces. Clauson stated that this

was a congested area on Bleeker Street. The landscaping would provide additional
screening and was consistent with Rio Grande Place with the possibility of a slight
amount of shaving but won't affect the parking area.
Roger Haneman said that with the Obermeyer project he understood that it would
be more than just a slight cutting into the curb to straighten out Rio Grande and
Bleeker. Clauson said within the existing property line but no engineering had
been done and this was still in the conceptual stage. Lindt reminded the
commission that they could not approve or deny an application based upon another
pending proposal; the commission must base the approval or denial upon the
standards of this application.
Bert Myrin asked what types of trees would be used for the screening. Jennifer
Dolecki answered that there would be some berming and boulders for separation
and planting more deciduous trees reflecting what was in the area.
Haneman asked who would be using these parking spaces. Clauson replied that
presumably people going to and from the jail. Jody Smith said there was a
building grounds and maintenance shop in t he basement of the j ail; the parking
would be designated for county vehicles only. It would free -up 4 spaces for the
emergency vehicles in the back lot.
Jasmine Tygre stated that this parcel was owned by the county before the 6th and
7th penny and asked if no portion was affected by the 6th and 7th penny or
transportation funds. Lindt replied that it was not open space funds but it probably
was transportation funds. Tygre stated concern for this ever since the first Rio
Grande plan because many other uses have been creeping into space that was
purchased with very specific monies as approved by the voters. Tygre said that she
did not remember this property always being earmarked for jail expansion; she
requested documentation for the Rio Grande. Lindt responded that Exhibit A, page
5 in the application was Ordinance 10, 1993. Lindt explained that the parcel was
swapped for the Rio Grande Parking Garage parcel. Tygre said that she wanted to
make sure that anything affecting the Rio Grande had the specifics about where the
monies came from and what it was bought for.
Myrin stated that he shared the same concern as Roger with the upper side running
into Bleeker Street. Clauson reiterated that there wasn't an engineered proposal for
Obermeyer Place but the generalized concept was that something would go
roughly straight; the map showed some movement around the site. Myrin said that
was his concern that the commission approved this plan and an administrative
decision could be made to change that plan. Lindt asked the percent of asphalt to
landscape. Clauson replied that about 45% was in asphalt. Lindt stated that one of

the criteria for the insubstantial SPA amendment was that it had to maintain the
character of the original plan; in terms of landscaping it would have to retain the
character of the plan presented at this hearing.
Tygre said that the parking was for the maintenance vehicles and not the jail
vehicles. Clauson said there was a remodeling within the jail to produce this work
area and entry door. Smith said that the maintenance facility was relocated from
the basement of the courthouse plaza.

MOTION: Bert Myrin moved to approve P&Z Resolution #23, series
2002, recommending that City Council approve with conditions the
proposed amendment to the Rio Grande Specially Planned Area to
allow for the development of four parking spaces on Lot 5, of the Rio
Grande Subdivision/SPA. Ruth Kruger seconded. Roll Call vote:
Kruger, yes; Myrin, yes; Haneman, yes; Cohen, yes; Tygre, no.
APPROVED 4-1.
Board Reports
Roger Haneman reported on the Obermeyer COWOP. The project options were
5or 6 stories, avoiding stream margin, Concept 600 concerns, views from other
streets, additional 10,000 square feet for free-market.
