HomeMy WebLinkAboutminutes.apz.20020820ASPEN PLANNING & ZONING COMMISSION Minutes - August 20, 2002 COMMISSIONER, STAFF and PUBLIC COMMENTS ........................................ 2 MINUTES ................................................................................................................. 3 DECLARATION OF CONFLICTS OF INTEREST ............................................... 3 115 NEALE AVENUE STREAM MARGIN REVIEW .......................................... 3 ASPEN PLANNING & ZONING COMMISSION Minutes - August 20, 2002 Jasmine Tygre opened the regular Planning and Zoning meeting at 4:30 p.m. in the Sister Cities Meeting Room with Bert Myrin, Roger Haneman, Ron Erickson, Eric Cohen; the two new members Jack Johnson and Dylan Johns were introduced and also present. Ruth Kruger was excused. Staff in attendance were: David Hoefer, Assistant City Attorney; Joyce Ohlson, Chris Bendon, James Lindt and Scott Woodford, Community Development; Jackie Lothian, Deputy City Clerk. COMMISSIONE1L STAFF and PUBLIC COMMENTS Be~t Myrin asked about the bright new clock tower at Wagner Park. Joyce Ohlson responded that it would be looked into for compliance. Myrin asked if the television in the from windows like the one in the Four Peaks Development Office has, would the new time-share offices be able to have the television in their windows. James Lindt responded that there was a complaint about the one in the Four Peaks window but there was nothing in the code for televisions. David Hoefer noted that neon was not allowed. Myrin stated that the code said the neon and gas filled tubes, which would be a television were prohibited as signs. Joyce Ohlson stated that would be researched and then reported back. Myrin asked for smaller maps so he could load them into his computer. Ohlson stated said that often the maps were given in 8½ by 11 or 11 by 14 but this one was a regular plat. James Lindt said that the stream margin included the surVey for the top of slope that was why the larger maps were provided. Jasmine Tygre extended the official welcome to the new P&Z members Jack and Dylan. Joyce Ohlson said that Burlingame parcel D was close to the AABC but connected to what was called Big Burlingame; the council wanted to put forth an affordable housing proposal using the COWOP process. There would be an eligibility hearing on September 9th to see if this was in fact eligible for COWOP. A member of the Planning Commission was requested for the COWOP. Ohlson said that Big Burlingame was once again reactivating; Ruth and Jack would represent P&Z. Parcel D (baby or little) Burlingame's representative would be Jasmine. Eric Cohen said that with regards to the new parking time being 4-hour time limits; it seems with less people in town it would be easier to find a parking space but parking is worse than ever, even after 5 pm. Cohen said that we have lost the ability for cars being moved with the 4 hour limits. Ohlson replied that she would provide the city council memo from Tim Ware about parking. 2 ASPEN PLANNING & ZONING COMMISSION Minutes - August 20~ 2002 Joyce Ohlson introduced the new planner; Scott Woodford who came to us from Steamboat Springs with a great deal of experience in resort community planning. Chris Bendon stated that the first infill public hearing with P&Z was scheduled for September 3rd with an overview of the infill program and discussion of offices on the first floor in the commercial core; there would be an opportunity to pull that office portion out if so desired. Bendon provided the schedule of every week. Bendon said that a growth management work session was set prior to drafting any language for the code. The commissioners agreed to meet every Tuesday night for the next 1-2 months on the infill language. MINUTES MOTION: Ron Erickson moved to approve the minutes from August 6, 2002; seconded by Roger Haneman. APPROVED 5-0. DECLARATION OF CONFLICTS OF INTEREST Dylan Johns disclosed that he had a conflict of interest on the Stream Margin Review. PUBLIC HEARING: 115 NEALE AVENUE STREAM MARGIN REVIEW Jasmine Tygre opened the 115 Neale Avenue Stream Margin Review. David Hoefer stated that notice was provided. James Lindt stated that the applicant David Fuente submitted an application for Stream Margin review to construct and interior floor that would bisect a two-story room into 2 one-story rooms. Lindt noted that stream margin review was needed because there was an addition to the street facing side of the house converted 9% additional living space, by adding this additional floor they go over the 10% threshold of living space, which required a stream margin review. Staff felt that all the criteria with the exception of criteria #9 were met, which was the top of slope that went right through the middle of the house. Lindt felt that this was an existing non-conformity without an expansion to that non-conformity. Bill Pollock and Steve Wilson of Zone 4 Architecture represented the applicant. Bert Myrin asked if there was a fisherman's easement on the property. Lindt replied that on the plat there was a trail easement, which gives fisherman access to the river. Ron Erickson asked about the matrix land use requirements. Lindt explained that the land use applications were condensed to the matrix for the applicant. Erickson 3 ASPEN PLANNING & ZONING COMMISSION Minutes - August 20, 2002 asked the current FAR, allowable, build to and after this addition. Bill Pollock replied that after this addition there would still be 350 square feet under the allowable. Hoefer replied that the current square footage was 2943 and the new would be 3167 square feet and allowable was 3348. No public comments. MOTION: Ron Erickson moved to approve P&Z Resolution #25, series 2002, approving a Stream Margin Review request to construct an interior floor that bisects a two-story room at 1 I5 Neale Avenue. Roger Itaneman seconded. Roll call vote: Cohen, yes; Myrin, yes; Itaneman, yes; Johnson, yes; Erickson, yes; Tygre, yes. APPROVED 6-0. Erickson stated that this request should have happened when the additional FAR was requested; he said that he had no problem With this proposal. Tygre stated that she had some of the same concerns that Ron did but without objection. Jack Johnson asked for clarification on how the fisherm~ easement would be made clear. Lindt replied that it was based on the recorded easements on the plat, which granted access to fishermen. Signs could not be placed and access could not be blocked.
