Jasmine Tygre opened the regular Planning and Zoning meeting at 4:30 p.m. in
Sister Cities Meeting with Jack Johnson, Bert Myrin, Roger Haneman and Ron
Erickson present. Ruth Kruger and Eric Cohen arrived at 4:40 p.m: Dylan Johns
was excused. Staffin attendance: David Ho&er, Assistant City Attorney; Chris
Bendon, Community Development; Jackie Lothian, Deputy City Clerk.

CONTINUED PUBLIC HEARING (09/03/02, 09/17/02, 9/24/02, 10/01/02,
10/08/02, 10/15/02):
INFILL LAND USE CODE AMENDMENTS
Jasmine Tygre opened the continued public hearing on the Infill Land Use Code
Amendments.
Ct~s Bendon stated that Pedestrian Amenity was a concern with the impact fees
on open space overall. Bendon uhlized power point graphs, formulas for square
footage of the open space required and the parking requirement on and off site.
The commissioners discussed rooftop restaurants and restaurants not on ground
levels requiring service elevators. The commissioners questioned if the city should
continue to require a pedestrian amenity. They questioned the affects as an
exaction; they said that the fee must be spent on something tied to the impacts.
The commission struggled what to call the open space/pedestrian amenity
requirement.
The Lodge Zone District was talked about regarding the fact that this was an out
dated product in Aspen and needed to be updated for short-term accommodations.
The commissioners asked how revitalization could encourage re-development to
keep lodges as lodges; they looked at the success of the condo rentals at the Aspen
Alps redevelopment. There was discussion on how to allow the developer to
respond to the market; how to structure and not dictate what the market wants.
The commission discussed smaller number of units but did not favor smaller
square footage; they also talked about permanent residential and a density
incentive. The conmaissioners favored the impact fees based on a combination of
the number of units and the number of bedrooms with greater density in the lodge
area. A 20% pedestrian amenity was favored 6-1 by the commission; Myrin
wanted to keep the 25%. There was mixed use in the lodge zone district. There
was a need for non-unit space in the lodge for self-sustaining the work force and
anything but lodge units.

The Commercial Lodging was located in the Commercial Core with mixed uses in
that zone district: Tax incentives were suggested to mitigate some of the financial
Concerns with regards t6 the development of commercial properties and these
concerns would be best addressed at the end of the infill public hearings. The
Commission agreed 5-1 to move the Commercial Lodge to the Commercial Core
Zone District review criteria.
The Eodge Overlay Zone had no large changes. The commissioners talked about
lodges and the generation of sales taxes verses time-share and single-family
homes~
VieTM planes were presented by Chris Bendon with a power point presentation and
discussed by the commission. The commissioners voted to keep the Courthouse,
view plane 2(yes)~4(no); Cooper Street Pier 3(yes)-5(no); Main Street-Jerome
3(yes)-5(no); Wheeler 6(yes)-2(no); Street level Wheeler- more information
requested; Wagner 4-4 and the second Wagner - more information was needed.
The commission discussed no increase in building heights from Wagner Park, to
protect the views of Mill Street to Wagner Park. They voiced concern over spot
zoning for view planes.

MOTION: Ron Erickson moved to continue the public hearing on the
lnfill Land Use Code Amendments to October 29, 2002; seconded by
Bert Myrin. APPROVED 7-0.
