HomeMy WebLinkAboutresolution.apz.005-03 Page: 1 or*' 2 02/13/2003 1, S.: 121: SILVIR D~VIS PITKIN COUNTY CO R 31,00 D 0.00 (SERIES OF 2003) RESOLUTION OF THE ASPEN'PLANNING AND ZO1NING ~MMiSSiON xcTiN~ AS TIlE DESIGN REVIEW APPE~S COMMITTEE DOUBLE STALL GARAGE DOORS AT 1390 AND 1392 SNOWBI~NY ~E, L0~i, BLOCK 2, SNOWBUNNY SUBDivISION, ?i~ ~;' COnOCo, Parcel No. 2735-013-11-007 WHEREAS, the Community Development Department received an application from Alice Brien, seeking a variance from Section 26.410, Residential Design Sfandards, requesting relief from the single stall garage door requirement for 1390 and 1392 Snowbunny Lane, Lot 1, Block 2, of the SnowbUnny Subdivision, Aspen, Colorado; and, WHEREAS, the subject property contains 16,662 sq. ft. and is improved with a duplex and two accessory dwelling units; and, WHEREAS, pursuant to Section 26.410.020 of the Aspen Municipal Code, Community Development Department staff reviewed the applicant's proposed application for compliance with the Residential Design Standards Section of the Aspen Municipal Code and found the submitted development application to be inconsistent with the residential design standard set forth in Land Use Code Section 26.410(C)(2)(f), Garage: and, WHEREAS, Section 26.410.020(C) of the Aspen Municipal Code provides that if an application is found by Community Development Department staff to be inconsistent with any item of the Residential Design Guidelines~ ~he apPlicant may either amend the application or appeal staff's findings to the Design Review Appeal Committee pursuant to Chapter 26.222, Design Review Appeal Committee; and, WIIEREAS, pursuant to Section 26.410.020(B) of the Aspen Municipal Code, the applicant submitted a request for a variance from Standard 26.410040(B)(1) of the Aspen Municipal Code to the Design Review Appeal Committee as it applies to garages; and, WHEREAS all applications for appeal from the Residential Desig~ Standards of Section 26.410.040 must meet one of the following review standards in order for the Planning and Zoning Commission acting as the Design Review Appeal Committee or other decision making administrative body to grant an exception, namely the proposal must: a) Yield greater compliance with the goals of the Aspen Area Community Plan; and, b) More effectively address the issue or problem a given standard or provision responds to; or c) Be clearly necessary for reasons of fairness related to unusual site specific constraints; WHEREAS, the Community Development Director, after review of the requested variance, recommended approval of the requested variance from the residential design standards to allow for double stall garage doors; and, Page: 2 of* 2 02/13/2003 1 !: 12,c SILV[~ ~¥IS PZTKIN COUNTY CO R 2~ .00 0 0.00 WHEREAS, during a duly noticed public hearing ar a regular meeting on January 21, 2003. the Planning and Zoning Commission acting as the Design Review Appeal Committee, approved variances from the sin.,~le stall garage door standard of Section 26.410.040(C)(2) of the Aspen Municipal Code as it applies ro Residential Design Standards for Lot 1, Block 2, of the Snowburmy Subdivision by a vote of four to one I4-1). NOW, THEREFORE BE IT RESOLVED by the Commission: Section 1 That the proposed variance from the single stall garage door residential design standard for the duplex located ar 1390 and 1392 Snowbunny Lane, ~s hereby approved pursuant to Land Use Code Section 26.410.040(C)(2), to allow for the double stall garage doors to be maintained on both duplex units. APPROVED by the Commission at its regular meeting on January 21, 2003.
