Dylan Johns, Jack Johnson, Ruth Kruger, Roger Haneman and Jasmine Tygre were present. Eric Cohen was excused. City of Aspen staff in attendance: Joyce Allgaier, Scott Woodford, Community Development; Jackie Lothian, Deputy City Clerk. COMMISSIONER, STAFF and PUBLIC COMMENTS Ruth Kruger asked how the Pines Lodge prOject was coming along becaUse the work trailer was hazardous; it blocks Aspen Street and was parked in the middle of the Street.. Joyce Allgaier stated the engineering department would take care of it. Jack Johnson asked if the Quadrant Books site was ever discussed. Joyce Allgaier replied that it wasn't really talked about as a group but the memo was informational; if the commission wanted to discuss it she would ask Sarah to come in and explain. Johnson said that the memo only went to the change in use but did not address the demolition and rebuild; he requested whatever what was proposed and documented after June 4, 2002. Allgaier responded that interpretation would not necessarily be written up but they did obtain a building permit. Roger Haneman noted that the change in use criteria was included in the Resolution but nothing regarding demolition. Jasmine Tygre shared Jack's concerns because during the change in use hearing they never spoke of demolition. MINUTES MOTION: Roger Haneman moved approve the minutes from May 6, May 20, and June 17, 2003; seconded by Ruth Kruger. APPROVED 5-0. DECLARATION OF CONFLICTS OF INTEREST None. CONTINUED PUBLIC HEARING (06/17/03): MISCELLANEOUS LAND USE CODE AMENDMENTS Jasmine opened the continued the public hearing for Miscellaneous Land Use Code. Scott Woodford provided the proof of notice. The commission agreed with the Section 1 - Definitions. Section 2 - Design Review Appeal Committee was discussed and had not met since 1999; P&Z and HPC have acted as DRAC and Council has not appointed any DRAC members; this would disband the formal DRAC; the commission agreed. 2 ASPEN PLANNING & ZONING COMMISSION Minutes July 01, 2003 Section 3 - Common Development Review Procedures (Re-Submitting Denied Applications) added "reasonable" was agreed upon. Section 4 Common Development Review Procedures/Submitting multiple Applications) will not be allowed unless there was a public purpose to be served and Section 5- Amendments To The Official Zone District Maps were agreed on by the commission. Scott Woodford stated that this Section 6 - Residential Design Standards (Revisions to the review) clarified that BOA, ?&Z or HPC would review the variances and proposed changes in the criteria for variances taking out how the AACP was complied with. The commission discussed the expansive and vague language and requested more work regarding the language to be more specific and less vague and define "context". The commission discussed the limitations, permissiveness and subjectiveness; the types of good diversity; what was the more appropriate type of design; meeting the intention of the standard. Dimensional was still of concern. Sections 7 - Residential Design Standards (parking, Garages and Carports accessed from an alley or private road) required one change deleting the word "waffle" and replaced it with "traffic". Section 8 - Residential Design Standards (Parking, Garages and Carports that do not have access from an alley) were agreed that as long as they were not visible. The commission agreed that Section 9 Residential Design Standards (One,Story Element) required more work. The discussion of the second floor living space over a deck included limiting the size, access, enclosing, percentage of the space, covered or uncovered, function and architectural interest. Section 10 - Development of Historic Landmark Site and Structure (FAR Bonus); Section 11 - Development of Historic Landmark Site and Structures (Appeals of - HPC Decisions); Section 12- Special Review; Section 13 - Special Review;' Section 14 Stream Margin Review; Section 15 - Wireless Telecommunications; Section 16 - Wireless Telecommunications were accepted by the commission. There were regulations in place for telecommunications but were in the conditional use section and should be in the special review section. The commission requested more discussion on Section 17 Outdoor Lighting (Non-Residential); Section 18- Outdoor Lighting (Residential); Section 19- Outdoor Lighting and Section 20 Outdoor Lighting. There were discussions on 3 ASPEN PLANNING & ZONING COMMISSION Minutes July 01~ 2003 the shielding, light sources, the bulb, lighting heights, cumulative effects of lighting, impacts of lighting, light pollution, being able to see the stars at night, current code definition of shielded, wattage, and the need for special review. Woodford noted that a seminar from dark sky recommended simplifying the code on lighting and to not try to measure foot-candle. The commission requested a sample of that literature. MOTION: Ruth Kruger moved to continue the public hearing on the Miscellaneous Code Amendments with changes to section 6 and 9 and removing all lighting sections to July 15, 2003; seconded by Jack Johnson.
