HomeMy WebLinkAboutresolution.council.006A-98 Series of 1998 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, APPROVING THE EXPENDITURE OF $1,050,000.00 TO FACILITATE THE PURCHASE OF LOTS 1, 2, 3, AND FATHERING PARCEL (FP) OF THE ASPEN MASS SUBDIVISION. WHEREAS, William Landan and Robert Giacinto are the owners of Lot 1, Aspen Mass. Subdivision; Gundaker Real Estate Co., Inc. is the owner of Lots 2 and 3 of this subdivision; Aspen Mass Parmers owns and controls Fathering Parcel 2 in this Subdivision; and all these parties, as current owners of these properties, desire to sell and convey their interests to Pitkin County and the City of Aspen; and WHEREAS, the City Council has determined that it is in the best interest of the City of Aspen to acquire the above referenced property for municipal purposes, including the construction of affordable housing. Additionally, the properties have the potential to be exchanged with the United States Forest Service for the Seventh Street, City of Aspen, Forest Service; and WHEREAS, the Board of County Commissioners of Pitkin County and the City Council have agreed to share in the cost of ayquiring the above referenced properties and to hold title as joint tenants; and WHEREAS, the Board of County Commissioners and the City Council have determined that the City of Aspen should contribute $1,050,000.00 towards the total purchase price of $1,650,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section I. That the City Council of the City of Aspen hereby authorizes the purchase of Lots 1, 2, 3, and fathering parcel (FP) of the Aspen Mass Subdivision, the expenditure of $1,050,000.00 towards a total purchase price of $1,650,000.00, and does hereby authorize the City Manager of the City of Aspen to execute any documents necessary to consummate the transaction on behalf of the City of Aspen. Section 2. That the purchase of the above described property shall be for municipal purposes, including the construction of affordable housing or to be exchanged with the United States Forest .Service for the Seventh Street, City of Aspen, Forest Service property.
