(SE~S OF 2003~ A ~SOLUTION OF THE CITY OF ASPEN PLYING ~D ZON~G COMMISSION BEING THE ASPEN HIGHL~S VILLAGE PLANED UNIT DE~LOP~NT (PUD) SIGN GUIDELI~S, CITY OF ASPEN, PITON COUNTY, COLO~DO. WItEREAS, the Community Development Department received an application from Hines Highlands Limited Partnership and the Aspen Highlands Village Association requesting approval for sign guidelines specific to the ASpen Highlands Village PUD; and, WHEREAS, upon review of the application, the applicable code standards, and the Community Development Department recommended approval of the sign guidelines for the Aspen Highlands Village PUD; and, WHEREAS, the Aspen Planning and Zoning Commission has reviewed and considered the development proposal under the applicable provisions of the Municipal Code as identified herein; and, WHEREAS, during a duly noticed public heating on August 5, 2003. the Plarm'lng and Zoning Commission denied, by a 5 to 1 (5 - l) vote, the Aspen Highlands Village PUD Sign Guidelines included in the staff memorandum as Exhibit "C"; and, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF ASPEN PLANNING AND ZONING COMMISSION AS FOLLOWS: Section 1: Pursuant to the procedures and standards set forth in Section 26.310 of the City of Aspen Land Use Code. the Planning and Zoning Commission denies the Aspen Highlands Village PUD Sign Guidelines'that were reviewed by the Planning Commission on August 5, 2003 and were included in the staff memorandum as Exhibit "C." Section 2: This resolution shall not effect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 3: If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
