HomeMy WebLinkAboutresolution.council.020-86 RESOLUTION NO. ,:-2'0 (Series of 1986) A RESOLUTION SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF ASPEN, AT A SPECIAL MUNICIPAL ELECTION TO BE HELD AUGUST 12, 1986, QUESTIONS CONCERNING THE FINANCING OF THE RENOVATION OF THE ASPEN CITY HALL AND THE ENTRANCE OF HIGHWAY 82 INTO THE CITY OF ASPEN WHEREAS, pursuant to Section 5.7 of the City Charter the City Council desire to submit to the registered voters of the City questions concerning the financing of the renovation of the Aspen City Hall, and the entrance of Highway 82 in to the City of Aspen. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That at the special election to be held in the City of Aspen, Colorado, on Tuesday, August 12, 1986, there shall be submitted to a vote of the registered electors of the City the following questions: OUESTION-NO. 1 - Issuance of Bonds to finance City Hall renovation, reconstruction and remodel "Shall the City of Aspen, Colorado issue interest-bearing bonds in an aggregate principal amount not exceeding $2,200,000.00, for the purpose of renovating and reconstructing the present City Hall and constructing additions thereto and paying costs of issuance of said bonds, said bonds to be payable from a pledge of the full faith and credit of the city, said bonds to bear interest at a net effective interest not exceeding 9.5% per annum and to mature not later than December 31, 2002, and said bonds to be issued and sold in such manner, upon such terms and conditions, and with such covenants, agreements and redemption features as the City Council may determine?" Question #2 and # 3 pertain to author iz ing the sale, exchange or other disposition of City-owned property currently in use as open space to facilitate upgrading State Highway 82 to four lanes from the intersection of Main and Seventh Street to Maroon Creek. These questions need to be answered to enable the State Highway Department to prepare an environmental impact statement and to also prepare long range capital improvement plans. Please vote on each question. OUESTIDN NO 2 "Shall the electors approve and authorize the City Council to implement a four-lane highway on a new alignment including the sale, exchange or granting of necessary rights-of-way across those properties acquired by the City of Aspen for open space purposes, this includes portions of the Golf Course, Maroon Creek parcel and the Marolt-Thomas parcels as depicted on the exhibit below. The new alignment for State Highway 82 will be four lanes and divided; extending from Maroon Creek along the existing highway alignment, then traversing the Marolt-Thomas property and connecting directly to Main street by construction of a new four- lane bridge over Castle Creek. To accomplish the above, the City Council shall be authorized to sell, exchange or grant necessary rights-of-way across the City-owned Marolt and Thomas properties, located in the city of Aspen, County of pitkin and bordered generally by state highway 82 on the north, Castle Creek on the south, subject to the following: -The State of Colorado will compensate the City of Aspen for the portions of the Marolt-Thomas, Golf Course and Maroon Creek properties used for the new roadway which is currently held as open space. -The State of Colorado will vacate the existing highway alignment from the intersection of Seventh Street and Main street to the point where the new roadway leaves the existing alignment. -The portion of State Highway 82 between Cemetery Lane and the point where the new roadway leaves the existing alignment will be converted to open space. -The new roadway will be designed with a curved alignment to reduce traffic speed. The present traffic signal at Cemetery Lane and State Highway 82 will be removed and a new signal installed at the new intersection of Seventh Street and Main street to control traffic volume entering Aspen and accommodate side street traffic. The Aspen City Council intends to work with the State of Colorado Department of Highways during the Environmental Impact Statement process to insure that these conditions are satisfied before approving final dedication of the specific alignment. The following exhibit shows the concept of a new entrance to Aspen connecting directly to Main street." (Insert exhibit) QUESTION NO.3 "Shall the electors approve and authorize the City Council to implement a four-lane highway on the existing alignment including the sale, exchange or granting of necessary rights-of-way across those properties acquired by the City of Aspen for open space purposes, this includes portions of the Golf Course, the Maroon Creek parcel, the Bugsy Barnard parcel and the Marolt-Thomas parcels as depicted on the exhibit below. The existing alignment will be four lanes and divided from Maroon Creek to Main street by the expansion of the existing State Highway 82 bridge over Castle Creek. To accomplish the above, the City Council shall be authorized to sell, exchange, or grant necessary rights-of-way across the City-owned Marolt and Thomas properties, located in the City of Aspen, County of Pitkin, and bordered generally by State Highway 82 on the north, Castle Creek Road on the south, subject to the following: -The State of Colorado will compensate the City of Aspen for the portions of the Marolt-Thomas, the Golf Course, the Maroon Creek and the Bugsy Barnard properties used for the new roadway which is currently held as open space. -The two existing 90 degrees turns at Seventh and Hallam and Seventh and Main, will be widened to standards which allow trucks and buses to remain in their own lanes at a maximum speed of 25 mph. -Roadway width east of Castle Creek Bridge will allow a minimum of four lanes of traffic and, if possible, turn 1 ane s, planted dividers, and pedestrian and bicycle movement. -Expansion east of Castle Creek Bridge will be done in a manner which minimizes private property acquisition. The Aspen City Council intends to work with the State of Colorado Department of Highways during the Environmental Impact Statement process to insure that these conditions are satisfied before approving final dedication of the specific alignment. The following exhibit shows the concept of a four-lane to Aspen on the existing alignment." (Insert exhibit) Section 2 There shall be five municipal election precincts for the aforesaid election. The polling places shall be at: Section 3 The aforesaid special election shall be conducted by the judges and clerks who shall be designed by the City Clerk with the approval of the City Council of the City of Aspen. The provision for the registration of electors and for voting by absentee ballot on the questions shall be in accordance with the Colorado Municipal Election Law. The votes at said election shall be registered on electronic voting machines at the polling place. S~ctiun' 4 Notice of the election on the proposed questions shall be published in the aspen Times, a newspaper published and of general circulation in said City, and the edition of said newspaper dated - , 1986, and a copy of such Notice shall be posted in the office of the City Clerk at least ten (10) days before the election. The City Clerk s hereby charged with the duty of giving Notice of the election, the question to be submitted, as hereinabove provided, which notice shall be in substantially the following form: "PUBLIC NOTICE OF THE SUBMISSION OF PROPOSED QUESTIONS TO THE VOTERS OF THE CITY OF ASPEN, COLORADO, AT THE SPECIAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, AUGUST 12, 1986 PUBLIC NOTICE IS HEREBY GIVEN THAT, pursuant to a resolution of the City Council of the City of Aspen, Colorado, a special election will be held in the City on Tuesday, August 12, 1986, between the hours of 7 a.m. and 7 p.m., and there will be submitted proposed question to the registered electors of the City as follows: OUESTIONNO.ul - Issuance of Bonds to finance City Hall renovation, reconstruction and remodel "Shall the City of Aspen, Colorado issue interest-bearing bonds in an aggregate principal amount not exceeding $2,200,000.00, for the purpose of renovating and reconstructing the present City Hall and constructing additions thereto and paying costs of issuance of said bonds, said bonds to be payable from a pledge of the full faith and credit of the city, said bonds to bear interest at a net effective interest not exceeding 9.5% per annum and to mature not later than December 31, 2002, and said bonds to be issued and sold in such manner, upon such terms and conditions, and with such covenants, agreements and redemption features as the City Council may determine?" The votes cast shall be recorded on voting machines and said election shall be held, conducted and the returns thereof shall be returned, canvassed and declared, as nearly as may be in the manner prescribed by law for the general election of municipal officers.
