SUMMARY: The Applicant requests an insubstantial amendment to a Planning and Zoning Commission Commercial Design Review to accommodate an HC Van space that requires an 8' clearance for access. The Applicant proposes to eliminate the two car garage and construct a carport to gain the clearance space in compliance with Building Department direction and accessibility standards. In order to meet the design standard for parking spaces which is to minimize the visual impact of parking from pedestrians„ the Applicant proposes to install native trees and bushes in a planter that was approved during the 2015 review. STAFF EVALUATION: Pursuant to Section 26.412.080 Amendment of commercial design review approval, of the City of Aspen Land Use Code an insubstantial amendment to a commercial design review approval granted by the Planning and Zoning Commission may be authorized by the Community Development Director if: a) The change is in conformance with the design standards, Section 26.412.060. the change represents a minimal effect on the aesthetics of the proposed development, or the change is consistent with representations made during the original review concerning potential changes of the development proposal considered appropriate by the decision- making body; and b) The change requires no other land use action requiring review by the Planning and Zoning Commission. Vos Caudill, Pitkin County, CO .. standards. In addition. the Applicant has located a lift on the site plan to provide accessibility to the gallery from the on-site parking. The Design Objectives and Guidelines for the Central Mixed Use Character Area Commercial Design consider parking and recommend that parking is located to the rear of the site and buffered from view. The objective is to -minimize visual impacts of parking." Removing the two car garage and replacing this with a carport creates the clearance around the vehicle for a physically disabled person to access in and out of a parked vehicle. To buffer the vehicle parked in this spot from the street the Applicant, in the submittal letter, proposes to add native trees and shrubs to the planter (although the site plan indicates six 2 aspen trees). The vegetation should soften the view of the cars and 9. supports the objective to provide a -visually interesting street edge. The Building Department has confirmed that the carport meets the accessibility requirements of the IBC as well as the location of the lift in the clear space as proposed in the revised plan dated 5/12/16 and attached. DECISION: Staff finds that the Insubstantial Amendment to a commercial design review approval granted by the Planning and Zoning Commission complies with the review criteria of Section 26.412.080 and should be granted with the following condition: 1) The Applicant shall install a mix of coniferous and deciduous plants to ensure visual screening year round. 2) At installation, the plants shall be a minimum of 3 feet in height to provide immediate screening of the parking area. This approval included (2) off-street parking spaces, which were designed within a (2) car enclosed garage space. At the direction of the Building Official and applicable handicap codes, the Project was required to accommodate a HC Van space as one of the approved parking spaces, which by code includes an 8' loading space to one side. Upon further review, this requirement could not be accommodated within the proposed garage space, nor will the site allow for a full additional exterior parking spot to meet this requirement. Therefore, the Application is proposing an amendment to the architectural design which converts the approved (2) car garage into a (2) car carport as described and shown in the attached drawings. This change also requires the west elevation to be modified by eliminating the west wall of the carport. Prior to- issuance of a building permit, the Owner shall also record a new deed restriction for the unit, as approved by APCHA, inclusive of the following modifications: 1. The unit shall be rented to a qualified Category 2 employee, which the Owner may select. 2. I f APCHA determines the Owner is in violation of the rental requirements for forty-five (45) days, APCHA may place a qualified person in the unit and shall send a notice of violation to the Owner. 3. If fifteen (15) days passes after notice of violation without a hearing request or a hearing the Owner of the building will pay a fine of $500 per day until the unit is rented ill compliance with the deed restriction. 4. The unit will not be converted to a sale unit without the consent of the owner, No Certificate of Occupancy shall be granted for the commercial space until the deed restriction is reviewed and approved by APCHA, and a Certificate of Occupancy is issued for the affordable housing unit. Owner and APCHA stipulate and agree that, in accordance with CRS 38-12- 301(1)(a) and (b), the Deed Restriction constitutes a voluntary agreement and deed restriction to limit rent on the property subject hereto and to- otherwike provide affordable housing stock. Owner waives any right it may have to claim that the Deed Restriction violates CRS 38-12-301. If the owner requests the unit to become an ownership unit, the unit shall meet the same criteria as listed above and be sold through Aspen/Pitkin County Housing Authority lottery system. Section 3: Commercial Space A reconstruction credit of 2,439 square feet of commercial net leasable is credited toward the Project's proposed 2,057 square feet of commercial net leasable. Existing and proposed net leasabl-e calculations shall be verified with the Zoning Officer at time of building permit. Section 4: Parking The commercial net leasable generates 2.057 parking spaces. Two (2) off-street parking spaces shall be provided on-site. The remaining 0.057 parking spaces shall be mitigated through a cash-in-lieu payment.
