A RESOLUTION OF THE CITY COUNCIL OF ASPEN, COLORADO,
AUTHORIZING AN ADMINISTRATIVE DELAY IN THE ACCEPTANCE
AND/OR PROCESSING OF ANY APPLI(~TION FOR A
BUILDING PERMIT FOR THE DEMOLITION OR I~q~AL OF
ANY STRUCTURE SURVEYED IN THE 1980 ASPEN INVENTORY
OF HISTORIC SITES AND STRUCTURES AS AMENDED
WHERE~S, the City of Aspen is in the process of a~opting the
Aspen Area Comprehensive Plan: Historic Preservation Element
(hereinafter "Element")~ and
WEEREAS, on August 25, 1986, the City Council adopted
Resolution No. 25, Series of 1986 endorsing the Element and
identifying as its highest priority implementation action a Code
amendment to provide for a public review procedure prior to
issuance of a demolition permit for any historic structure~ and
WHER~S, the courts are sensitive to the inequities involved
in requiring local governments to meet certain time-consuming
procedural requirements prior to the a~option of amendments to
zoning codes during which time applicants may defeat the intended
effects of any amendment by applying for approvals prior to the
effective date of the amendment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Aspen, Colorado, that it does hereby authorize an
administrative delay on the acceptance and/or processing of all
applications for Building Permits for the demolition or removal
of any structure surveyed in the 1980 Aspen Inventory of Historic

Sites and Structures, as amended, until the date of the public
hearing and second reading of the proposed moratorium ordinance.
