HomeMy WebLinkAboutresolution.council.039-86 RESOLUTION NO. 5 q (Series of 1986) A RESOLUTION OF THE CITY COUNCIL DIRECTING AND AUTHORIZING THE CITY ATTORNEY TO EXECUTE A STIPULATION FOR DISMISSAL IN THE MATTER OF WALTER B. MILLS V. JAMES L. HALL AND CITY OF ASPEN (CASE NO. 80 CV 208) WHEREAS, there has been presented to the City a Stipulation for Dismissal in the matter of Walter B. Mills v. James L. Hall and City of Aspen (Case No. 80 CV 208) pending in the District Court, County of Pitkin, State of Colorado, wherein Plaintiff Walter B. Mills has commenced an action to quiet title to that real property described in the Complaint, a more accurate description of which is appended hereto; and WHEREAS, the effect of said Stipulation for Dismissal would be to withdraw any and all claims to the aforesaid property, including any crossclaims against the City by the Plaintiff; and WHEREAS, having considered the history of the aforesaid parcel and the legal alternatives available to the City, the City Council desires to approve the Stipulation for Dismissal and direct the city Attorney to execute the same on behalf of the city. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1 That the City Attorney is hereby directed and authorized to enter into the Stipulation for Dismissal of Walter B. Mills v. James L. Hall and City of Aspen, Colorado (Case No. 80 CV 208), District Court, County of Pitkin, state of Colorado, and to execute any and all such other documents necessary to bring the above-entitled action to a conclusion. ~) Dated: ~ , 1986. .~~ William L. stirling, Mayor I, Kathryn s.
