A RESOLOTION OF THB CITY CODNCIL OF THE CITY OF ASPBN TO DELETB
46 STROCTORBS FROM THB MORATORIOM ON DBMOLITION AND RBMOVAL OF
STROCTDRES SDRVBYBD IN THE 1980 ASPBN INVENTORY OF HISTORIC SITBS
AND STRDCTORES AS AMBNDED
WHEREAS, on September 22, 1986 the City Council of the City
of Aspen adopted Ordinance 41 (Series of 1986) establishing a six
month moratorium on the acceptance and/or processing of any
application for a building permit for the demolition or removal
of any structure surveyed in the 1980 Aspen Inventory of Historic
Sites and Structures a amended (hereinafter "the Inventory"); and
WHEREAS, Section 3 of Ordinance 41 states that Council may
by Resolution exempt a pending application from the restrictions
of this moratorium if upon special review, after considering the
recommendation of the Aspen Historic Preservation Committee
(hereinafter "HPC") , the City Council finds that the structure
proposed to be removed or demolished is not, in fact, historical-
ly or architecturally significant; and
WHBREAS, the HPC conducted four neighborhood meetings on
January 14, 15, 21, and 22, 1987 to evaluate the historic and
architectural significance of the undesignated structures
surveyed in the Inventory according to the standards for historic
designation in Section 24-9.3 of the Municipal Code, and gave
evaluation ratings to each of the 178 structures considered; and
WHBREAS, HPC considered the structures rated 0 and 1 to not
possess historic or architectural significance; and at a joint
public hearing of HPC and the Aspen Planning and Zoning Commis-
sion held on February 3, 1987 The Planning and Zoning Commission
passed a motion to recommend City Council to delete the forty-six
(46) structures rated 0 and 1, as listed below, from Ordinance 41
(Series of 1986); and
WHEREAS, while the City Council desires to delete these 46
structures from the Moratorium on Demolition, property owners
continue to have the ability to petition to the HPC to be design-
ated or otherwise included in the historic preservation system of
the City of Aspen; and
WHBRBAS, the other 225 structures listed in Ordinance 41
(Series of 1986) should continue to be protected from demolition
and removal while the Aspen Planning and Zoning Commission, HPC,
and the City Council of Aspen, Colorado continue to study and, if
necessary, consider changes to the Zoning Code of the City of
Aspen, Colorado, as they pertain to historic preservation
regulations and incentives for historic preservation.
NOW, THBRBFORB, BB IT RESOLVED by the City Council of the
City of Aspen, Colorado that it does hereby delete the following
structures, as identified by addresses, from the provision of
Ordinance 41 (Series of 1986), moratorium on the demolition or
removal of any structure surveyed on the Inventory.
