(Series of 1987) A FIRST AMENDED RESOLUTION OF THE CITY COUNCIL OF ASPEN, COLORADO, AUTHORIZING AN ADMINISTRATIVE DELAY IN THE ACCEPTANCE AND/OR PROCESSING OF ANY APPLICATION FOR A BUILDING PERMIT FOR CONSTRUCTION OF STRUCTURES WITHIN THE R-6 ZONE DISTRICT AS DEPICTED ON THE OFFICIAL ZONING MAP OF THE CITY OF ASPEN WHEREAS, the City Council of the City of Aspen, Colorado, deems it in the best interest of the City to review the dimens- ional requirements ~contained within the Municipal Code of the City of Aspen with regard to the construction of structures within the R-6 zone district as depicted on the official zoning map of the City of Aspen (hereinafter referred to as "R-6"); and WHEREAS, the City Council of the City of Aspen has before it Ordinance No. 48 (Series of 1987), providing for the impo- sition of an administrative delay until December 31, 1987, with regard to the processing of building permits for construct- ion, reconstruction or remodelling within the R-6 zone district. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLO~%DO: Section 1 The City Council does hereby dire~t an administrative delay with regard to the acceptance and processing of all applications for building permits in connection with construction, recon- struction or remodelling of structures within the R-6 zone district, and which would be prohibited by the adoption of Ordinance No. (Series of 1987)~ pending a review of the impact of the impact and planning consequences of constru- ction in the aforementioned areas. The administrative delay shall not apply to approved PUD's in the R-6 zone district. This administrative delay may be lifted by resolution of the City Council, either generally or specifiCally, with respect to an individual application upon a finding by the City Council that the application presented is not within the spirit and intent of this administrative delay as reflected by the proposed amendments to Section 24-3.4, annexed hereto and incorporated herein as Exhibit "1", and that approval of the application will not result in a negative impact. Section 2 This administrative delay shall ~emain in effect until the latter of (1) the schedule date of the public hearing and second reading of the proposed delay ordinance, if such ordinance fails, or (2) until the effective date of such ordinance, if such ordinance is passed. Section 3 The City Manager is hereby directed to implement said administrative delay. Section 4 The City Council hereby directs that the Planning and Zoning Commission review the provisions of Sections 24-3.4 with regard to R-6 zone district and Section 24-3.7(e) with regard to calculation of FAR, and make recommendations to the City Council regarding the advisability of repealing or amending the aforementioned Sections, and other zoning regulations pertaining to construction, reconstruction or remodelling of structures within the R-6 zone district. Koch, City Clerk EXHIBIT 1 Section 1 That in the R-6 zone district, the minimum front yard, side yard and rear yard setbacks, as established in Section 24-3.4 of the Municipal Code, be repealed and be re-enacted to read as follows: 4. Minimum front and rear yard: For principal buildings, the front and rear yard shall total no less than thirty (30) feet, and the front yard and rear yard shall each be a minimum of ten (10) feet, provided that the rear yard for that portion of a principal building used as a garage shall be a minimum of five (5) feet. For accessory buildings, the front yard shall be a minimum of fifteen (15) feet, and the rear yard shall be a minimum of five (5) feet. 5.
