SUMMARY: Planning staff recommends approval of Stream Margin
Exemption for the reconstruction of a deck and stairway on Unit 25
of the Riverview Condominiums, 1028 E. Hopkins.
APPLICANT: Richard and Peggy Krigel, represented by John Cahill,
Managing Agent for the Riverview Association
BACKGROUND: The applicant seeks Planning Office approval for a
deck and stairway which was rebuilt in June of 1991. The previous
deck was deteriorated and rebuilt apparently without a building
permit. The Krigels have since applied for a building permit. The
Zoning Officer requires approval of Stream Margin Exemption prior
to approval of the building permit (Attachment "A"). According to
the application, the deck was replaced exactly where the previous
deck was located and is the same size as the old deck (Attachment
"B") .
REFERRAL COMMENTS: On 7/22/92, staff from Planning, Engineering
and Zoning reviewed the application and forward the following
comments:
Zoninq: (Bill Drueding)
1. No setback violations occur wi th the reconstructed
deck/stairway.
2. The 5/7/92 drawing submitted in the application indicates a
proposed pool reconfiguration. This is not a part of the
Krigel application/review.
3. Replacement of the previous deck does not affect FAR, site
coverage, etc.
Enqineerinq: (Chuck Roth)
1. The deck is not in the trail easement.
2. The new deck allows high water to flow through, but does not
retain more debris than other deck.
STAFF COMMENTS: Exemption from full Stream Margin review is
possible when the following standards are met:
1. The development does not add more than 10% to the floor area or
increase exempt floor area by more than 25%.

RESPONSE: The development replaced an existing deck structure.
No expansion occurred according to the managing agent of the condo
association.
2. The development does not require the removal of any trees
requiring a removal permit.
RESPONSE: No trees were removed by the reconstruction project.
3. The development is located such that no portion of the
expansion, remodeling or reconstruction will be any closer to the
high water line than is the existing development.
RESPONSE: The replacement deck is described to be on the same
footprint as the original deck. The drawing shows the deck
approximately 10' from the bank of the river.
4. The development does not fall outside of an approved building
envelope, if one has been designated though a prior review.
RESPONSE: The deck replacement does not fall outside of the
footprint of the previous deck.
5. The expansion, remodeling or reconstruction will cause no
increase in amount of ground coverage of structures wi thin the
Special Flood Hazard Area.
RESPONSE: The deck replacement causes no increase to the amount of
ground coverage within the flood hazard area.
STAFF RECOMMENDATION: Staff recommends approval of Stream Margin
exemption for the Krigel deck and stairway replacement at Unit 25,
Riverview Condominiums with the following conditions:

Dear Mr. Cahill:
As per our phone conversation, I am rejecting Building Permit No.
2-13, 1028 East Hopkin~, #25. As my investigation indicates and
you confirmed, the work applied for has already been completed
without the necessary building permit. The real problem is that
this construction requires a Stream Margin Review, or an exemption
from full review, as the work is within 100 feet of the Roaring
Fork River.
I appreciate your willingness to cooperate and bring this work into
compliance with City of Aspen Building and Zoning codes. Please
contact a city planner to start in motion the necessary Stream
Margin Review process. Kim Johnson or Leslie Lamont, at 920-5090;
are the planners who can help you proceed with this process.

Re: Riverview #25 Deck Rebuild
Dear Gary.
I am representing the owners of Riverview #25 - 1028 East Hopkins,
Aspen, Co. in the mattel of an exterior ground floor deck which they
rebuilt last June. Please see attached letter authorizing me as the
owners agent in this matter.
I also am the managing agent for the Riverview Condominium
Association which has an interest in the deck in question. In 1989 the
Krigels, (#25 owner) requested permission from the association to
replace the deteriorating deck which serves only their unit and to add a
set of steps from the deck to the yard below. Permission was refused
until such time as a proper set of plans and permit could be presented
by the Krigels. In June of 1991 a new deck with a set of stairs to the
yard miracous1y appeared,' This work was not, to the best of the
Associations knowledge, done with a permit. The Krigels have informed
the Association that the party who performed the work first checked with
the city an no permit was required. Supposedly the work was performed
by tne Kreigels Kansas contractor while vacationing here.
Of course my inquiries into the situation to your department
suggest that a permit would be required. Since the deck has already been
constructed and no plans are available from the owner I have included
several pictures of the structure.

Dear John:
Rebuilding our porch, which was falling apart, has really turned into much more of a problem
than we ever dreamed. I do hope that you will continue to assist us in getting our problem
resolved.
As I told you in my previous letter. We were told that this was a rebuild of an existing struc-
ture. Unfortunately, my contractor did not get any written documentation on this matter.
Please proceed, on our behalf, in getting the necessary pennit and proper inspection from the
city. I have called Ron Gay and left a message for him that I need the plans, however, he is
out of town working and his office felt that it would be toward the end of the month when he
returned. If you can draw a facsimile that would be satisfactory please proceed.

DESCRIPTION OF PROPOSAL
The scope ow work that has been undertaken at the Riverview Condominium
Association - Unit i25, (exterior), includes the removal of an existing
deteriorating deck and replacement of that deck with new and
structurally sound deck. The new deck is an exact duplicate of the
original deck and no square footage has been added to the building to
which it is adjacent. That being Bldg i3 of the Riverview Condominiums.
The proposed (completed deck) complies with all of the stream margin
review standards as set forth in attachment 4 (1-5) with the exception
of i5. The deck in question lies within 100 ft. of the high water line
of the Roaring Fork River. However, all the proposed construction,
(completed) lies within .,the foot print of the original deck, which this
deck has replaced.
Please note that I do hereby verify that the deck in question did
replace a previously existing deck of questionable safety and that the
new deck has not increased in size or alignment. I have managed the
Riverview Association since 1982 and am not aware of the date at which
the original deck was constructed. .
Also be advised that the Riverview Condominium Association has given
its' approval for this construction contingent upon the owners
compliance with City / County standards and requirements.

Review standards: Development Application
for Exemption from stream Margin Review
The expansion, remodeling or reconstruction of an existing
development shall be exempt from stream margin review if the
following standards are met:
1. The development does not add more than ten percent
(10%) to the floor area of the existing structure
or increase the amount of building area exempt
from "floor area calculations by more than twenty-
five percent (25%): and
2. The development does not require the removal of
any tree for which a permit would be required
pursuant to section 13-76 or the applicant
receives a permit pursuant to said subsection: and
3. The development is located such that no portion of
the expansion, remodeling or reconstruction will
be any closer to the high water line than is the
existing development: and
4.
