HomeMy WebLinkAboutresolution.council.026-87 RESOLUTION NO. ?G::~ (Series of 1987) A RESOLUTION SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF ASPEN, AT AN ELECTION TO BE HELD DECEMBER 8, 1987, A QUESTION CONCERNING THE FIVE-YEAR SERIAL TAX LEVY FOR STREET IMPROVEMENTS APPROVED BY THE ELECTORS AT A SPECIAL MUNICIPAL ELECTION HELD ON JUNE 3, 1986 WHEREAS, at a special election held on June 3, 1986, the electors of the City of Aspen approved the following question concerning the adoption of a five-year serial tax levy for street improvements: "Shall the City Council be authorized to adopt a five-year serial tax levy at an annual rate of 1.5 mills, the proceeds from which tax levy shall be restricted to spending for street improvements, street repairs, street maintenance, and street related purposes (not including street department operating costs)." and, WHEREAS, pursuant to the authorization granted by the electors, the City Council did adopt a five-year serial tax levy at an annual rate of 1.5 mills for the purpose of street improve- ments, street repairs, street maintenance, and street related purposes (not including street department operating costs); and WHEREAS, since June 3, 1986, the date at which the aforesaid question was approved, the assessed valuation of property has been increased from 1977 levels due to the operation of Section 3 of Article X of the Constitution of the State of Colorado and Section 39-1-104, C.R.S.; and WHEREAS, in view of the increase in assessed valuation, the Ci ty Council desires to submit a quest.ion to the registered voters of the City of Aspen to obtain their intent with regard to retaining the five-year serial tax levy at an annual rate of 1.5 mills or reducing the mill levy to reflect revenues based on the assessed evaluation formula in effect on June 3, 1986; and WHEREAS, it is imperative that the City Council receive input from the electors on or before December 15, 1987, the date prescribed in Section 39-5-128, C.R.S., as the date for certify- ing the mill levy of the City, the City Council desires to call said election for December 8, 1987. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1 The city Council does hereby call an election to be held on Tuesday, December 8, 1987, for the purpose of SUbmitting a question concerning the 1.5 annual mill levy pertaining to the five-year serial tax levy for street improvements. Section 2 That at the aforesaid election there shall be submitted to a vote of the registered electors of the City the following question: QUESTION NO. 1 - Question concerninq tax levy rate for five-year serial tax levy for street improvements "On June 3, 1986, the electors of the City of Aspen approved a five-year serial tax levy for street improvements at an annual rate of 1.5 mills. Due to the statewide property tax re-eva1uation this mill rate will generate for the next four years almost two and one-half (2 1/2) times the revenue 2 SHALL THE CITY OF ASPEN MAINTAIN THE SERIAL TAX LEVY AT AN ANNUAL RATE OF 1.5 MILLS? If the electors fail to approve this question, the annual rate of serial tax levy will be reduced to .7 mills." On each voting machine there shall be spaces which will permit the elector to indicate his or her vote "FOR THE QUESTION" or "AGAINST THE QUESTION". section 5 Notice of the election on the proposed question shall be published in the Aspen Times, a newspaper published and of general circulation in said City, and the edition of said newspaper dated , 1987, and a copy of such Notice shall be posted in the office of the City Clerk at least ten (10) days before the election. The City Clerk is hereby charged with the duty of giving Notice of the election, the question to be submitted, as hereinabove provided, which notice shall be in substantially the following form: "PUBLIC NOTICE OF THE SUBMISSION OF A PROPOSED QUESTION TO THE VOTERS OF THE CITY OF ASPEN, COLORADO, AT AN ELECTION TO BE HELD IN THE CITY ON TUESDAY, DECEMBER 8, 1987 PUBLIC NOTICE IS HEREBY GIVEN THAT, at an election to be held in the City of Aspen on Tuesday, December 8, 1987, between the hours of 7 a.m. and 7 p.m., there will be submitted a proposed question to the registered electors of the City as follows: QUESTION NO. 1 - Question concerninq tax 1evv rate for five- year serial tax 1evv for street improvements "On June 3, 1986, the electors of the City of Aspen approved a five-year serial tax levy for street improvements at an 4 anticipated in 1986. If the electors fail to approve this question, the annual rate of serial tax levy will be reduced to .7 mills." section 3 Subject to the adoption of Ordinance No. (Series of 1987), there shall be one election precinct for the aforesaid election. The polling place shall be at the City Council Chambers, City Hall, 130 South Galena Street, Aspen, Colorado. section 4 The aforesaid election shall be conducted by the judges and clerks who shall be designated by the City Clerk with the approval of the City Council of the City of Aspen. The provision for the registration of electors and for voting by absentee ballot on the question shall be in accordance with the Colorado Municipal Election Law. The votes at said election shall be registered on electronic voting machines at the polling place. Those electors who are otherwise fully qualified to vote on said question at such election, but who are or will be unable to appear at the polling place on the date of the election, may apply in writing at the office of the City Clerk, at the Aspen City Hall, for an abse~tee ballot, or at any time during business hours, on or before M ~Jt.-'_l_A./ ~ The votes cast shall be recorded on voting machines and said election shall be held, conducted and the returns thereof shall be returned, canvassed and declared, as nearly as may be in the manner prescribed by law for the general election of municipal officers.
