RESOLUTION NO. 3
(Series of 1988)
A RESOLUTION SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF
THE CITY OF ASPEN, AT A SPECIAL MUNICIPAL ELECTION TO BE HELD
APRIL 5, 1988, QUESTIONS CONCERNING THE SALE OF CITY HALL, THE
SALE OF THE ICE GARDEN FACILITY, AND THE SALE OF 1,597.5 SQUARE
FEET OF BLOCK 47, ORIGINAL ASPEN TOWNSITE
WHEREAS, pursuant to Section 5.7 of the City Charter the
City Council desires to submit to the registered voters of the
City at a special municipal election to be held on April 5, 1988,
questions concerning the sale of City Hall, the sale of the Ice
Garden facility, and the sale of 1,597.5 square feet of Block 47,
Original Aspen Townsite.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That at the special election to be held in the City of
Aspen, Colorado, on Tuesday, April 5, 1988, there shall be
submitted to a vote of the registered electors of the City the
following questions:
QUESTION NO. 1 - Annroval of Sale. Exchanqe or Other Disposition
of City Hall Property
"Shall the sale, exchange or other disposition by the City
Council of that City-owned real property and building
located thereon, commonly known as the Aspen City Hall
located at 130 South. Galena Street, specifically described
as Lots K, Land M, Block 93, City and Townsite of Aspen, be
approved pursuant to Section 13.4 of the City Charter? Such
sale, exchange or other disposition of said real property
and building shall be subject to historic designation and
will be on such additional terms and conditions and in such
manner as the City Council deems appropriate to consolidate
City/County office space."

QUESTION NO. 2 - Approval of Sale. Exchanqe or Other Disposition
of the Aspen Ice Garden
"Shall the sale, exchange or other disposition by the City
Council of that City-owned real property and building
thereon, commonly known as the Aspen Ice Garden, located at
233 West Hyman Avenue, specifically described as Lots A, B,
C, D, E, F, G, H and I, Block 54, City and Townsite of
Aspen, be approved pursuant to Section l3.4 of the City
Charter? Such sale, exchange or other disposition of said
real property will be on such terms and conditions and in
such manner as the City Council deems appropriate for the
purpose of constructing a new ice skating facility."
QUESTION NO.3 - Sale of 1.597.5 Square Feet of Block 47.
Oriqinal Aspen Townsite
"Shall the sale, exchange or other disposition by the City
Council of that City-owned real property comprising
approximately 1,597.5 square feet, specifically described as
follows:
Beginning at the northwesterly corner of Lot H, Block 47,
Original Aspen Townsite, said corner is located on the
northerly boundary of Block 47 and is evidenced by a plastic
cap property corner monument, marked with Colorado Land
Surveyor Registration No. 9l84i thence North 75 09'11" W, 30
feet along the northerly boundary of Block 47 to the
northeasterly corner of Lot F of said Block, thence S 14
50'49" W, 46.5 feet along the easterly boundary of said Lot
Fi thence South 50 55'31" E, 32.9 feet more or less to the
southwesterly corner of the northerly 60 feet of Lot H in
said Block 47, said corner is evidenced by a plastic cap
property corner monument, marked with Colorado Land Surveyor
Registration No. 9184; thence North 14 50'49" E, 60 feet
more or less along the westerly boundary of said Lot H to
the point of beginning. The above described property being
wholly located in the Lot G, of Block 47, Original Aspen
Townsite and containing 1597.5 square feet more or less,
be approved pursuant to Section 13.4 of the City Charter?
Such sale, exchange or other disposition of said real
property will be on such terms and conditions and in such
manner as the City Council deems appropriate.

There shall be one municipal election precinct for the
aforesaid election. The polling place shall be at Aspen City
Hall, 130 South Galena Street, Aspen, Colorado.

The aforesaid special election shall be conducted by the
judges and clerks who shall be designated by the City Clerk with
the approval of the City Council of the City of Aspen.
The provision for the registration of electors and for
voting by absentee ballot on the questions shall be in accordance
with the Colorado Municipal Election Law.
The votes at said election shall be registered on electronic
voting machines at the polling place. The ballot label shall
read as follows:

Such sale, exchange or other disposition of said real
property will be on such terms and conditions and in such
manner as the City Council deems appropriate.
Notice of the election on the proposed questions shall be
published in the Aspen Times, a newspaper published and of

general circulation in said City, and the edition of said
newspaper dated Ylz~ ot"y. , 1988, and a copy of such
Notice shall be posted in the office of the City Clerk at least
ten (10) days before the election. The City Clerk is hereby
charged with the duty of giving Notice of the election, the
questions to be submitted, as hereinabove provided, which notice
shall be in substantially the following form:
"PUBLIC NOTICE OF THE SUBMISSION OF A PROPOSED QUES-
TIONS TO THE VOTERS OF THE CITY OF ASPEN, COLORADO, AT
THE SPECIAL ELECTION TO BE HELD IN THE CITY ON TUESDAY,
April 5, 1988
PUBLIC NOTICE IS HEREBY GIVEN THAT, at the general election
to be held in the City of Aspen on Tuesday, April 5 , 1988,
between the hours of 7 a.m. and 7 p.m., there will be submitted
proposed questions to the registered electors of the City as
follows:
QUESTION NO. 1 - Approval of Sale. Exchanqe or Other Disposition
of city Hall Property
"Shall the sale, exchange or other disposition by the City
Council of that City-owned real property and building
located thereon, commonly known as the Aspen City Hall
located at 130 South Galena Street, specifically described
as Lots K, Land M, Block 93, City and Townsite of Aspen, be
approved pursuant to Section 13.4 of the City Charter? Such
sale, exchange or other disposition of said real property

feet along the northerly boundary of Block 47 to the
northeasterly corner of Lot F of said Block, thence S 14
50'49" W, 46.5 feet along the easterly boundary of said Lot
Fi thence South 50 55'31" E, 32.9 feet more or less to the
southwesterly corner of the northerly 60 feet of Lot H in
said Block 47, said corner is evidenced by a plastic cap

Such sale, exchange or other disposition of said real
property will be on such terms and con~itions and in such
manner as the City Council deems appropriate.
The polling place for said election shall be located at
Aspen city Hall, 130 South Galena Street, Aspen, Colorado.
Those electors who are otherwise fully qualified to vote on
said questions at such election, but who are or will be unable to
appear at the polling place on the date of the election, may
apply in writing at the, office of the City Clerk, at the Aspen
City Hall, for an absentee ballot, or at any time during business
hours, on or before ~ I. /rl?8' .

The votes cast shall be recorded on voting machines and said
election shall be held, conducted and the returns thereof shall

be returned, canvassed and declared, as nearly as may be in the
manner prescribed by law for the general election of municipal
officers.
