HomeMy WebLinkAboutresolution.council.006-88 RESOLUTION NO. 0 (Series of 1988) A RESOLUTION AUTHORIZING THE NOTIFICATION TO PROPERTY OWNERS OF PROPOSED ASSESSMENTS FOR UNDERGROUND IMPROVEMENT DISTRICT NO.1; ESTABLISHING A TIME AND DATE FOR A PUBLIC HEARING ON SAID ASSESSMENTS; ORDERING PUBLICATION AND MAILING OF NOTICE OF HEARING TO THE OWNERS OF THE PROPERTY TO BE ASSESSED FOR THE IMPROVEMENTS IN SAID DISTRICT WHEREAS, the City Council of the City of Aspen, Colorado, has established and created Underground Improvement District No. 1, to provide for the relocation of overhead electric and communication facilities to underground location. WHEREAS, the City Council has caused an assessment list to be prepared detailing the total cost to be assessed against aforementioned district, the specific properties to be assessed within the district, and the amount of assessment on each piece of property within the District. WHEREAS, the City Council has considered the special benefits which will accrue to each lot or tract of land within the District as a result of the removal and replacement of utility lines and equipment, and has determined that the apportionment of the assessments for said improvements as set forth in the assessment list is in accordance with such benefits. WHEREAS, the City Council has determined to provide for a hearing on the proposed assessments and to authorize the publication and mailing of the notice of hearing, as required by law. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1 That the City Clerk is hereby authorized and directed to notify the owners of the property to be assessed for said improvements, of a public hearing on the proposed assessments, by publication on time in the Aspen Times, a newspaper of general circulation in the City of Aspen, such notice to be published at least twenty days before the date fixed for the hearing. In addition, a copy of the notice of hearing shall be mailed not less than fifteen days prior to the date fixed for such hearing to each owner of real property whose property will be assessed for part of the cost of the improvement, at the last known address of such owner; also, a copy of such notice shall be addressed to "owner" and shall be so mailed, addressed to the street number of each piece of improved property to be affected by such assessment. Section 2 That the published notice shall be in substantially the following form: PUBLIC NOTICE OF PROPOSED ASSESSMENTS AND THE APPORTIONMENT THEREOF TO PROPERTY OWNERS WITHIN UNDERGROUND IMPROVEMENT DISTRICT NO.1, IN THE CITY OF ASPEN, COLORADO, AND OF A HEARING THEREON TO ALL PERSONS INTERESTED GENERALLY and to the owners of real estate which is hereinafter described, said real estate comprising the District known as Underground Improvement District No.1, City of Aspen, Colorado, notice is hereby given. 1. That at five (5) o'clock p.m. on February 22, 1988, at City Council Chambers, 130 South Galena, Aspen, Colorado, the City Council will hold a public hearing upon the proposed assessments in Underground Improvement District No.1. The owner of any property to be assessed will be heard on the question of whether his or her property will be benefited by the proposed improvement to the amount of the proposed assessment against his or her property and whether the amount assessed constituted more than his or her proportional share of the total cost of the improvements. 2. A copy of the ordinance proposed to be adopted levying the assessments against all real property in the district will be on file for public inspection, at the City Clerks office in City Hall, 130 South Galena Street, in the City of Aspen. Subject to any changes and corrections as may be made by the Council, it is proposed to adopt the ordinance at the conclusion of the hearing. 3. That the extent of the lots within the improvement district includes all the lots as defined in Ordinance 34 (Series of 1987) within the present boundary of the City of Aspen and within the boundaries of "Local Improvement District No.1" as set forth in the aforementioned Ordinance. 4. The method of assessment of cost against the property specially benefited and included within the District is more particularly set forth in Ordinance No. 34 (Series of 1987), and notice of intention to create Local Improvement District No. l, Dated: and approved on A\J<=.u s.T /-:J ^ /'-;ti~L4 ~ _ 10, I~f)'" passed /() , 1988.
