A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
CONVEYING THE DESIRE OF THE COUNCIL TO LESSEN SOURCES OF PM-10
POLLUTION
WHEREAS, the City of Aspen has assumed a leadership role in
responsibility for dust control through monitoring and research
of PM-10 related pollution, and
WHEREAS, the City of Aspen has been named by the Environmen-
tal Protection Agency as an area in violation of the federal
health standards for PM-10 pollution; and
WHEREAS, the City Council has adopted a Local Implementation
Plan which might eventually require City property'owners to
conversion of existing stoves and fireplace to the cleanest
available devices within 3 years of EPA approval of Aspen's plan;
and
WHEREAS, the City Council, at this time, wishes to utilize
all less drastic approaches before requiring conversions; and
WHEREAS, the City Council, for the purposes of protecting
the health, safety and welfare of the residents and visitors of
the City of Aspen, desires to lessen all PM-10 pollution,
including wood-smoke and dust particles; and
WHEREAS, the City is desirous of knowing from the Colorado
Department of Health what percentage of the PM-10 particulates is
created by road-dust and what percentage is created by wood-
smoke.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
The City agrees to continue its investigation of cleaner,
less dusty sanding material,s its investigation of harder sanding
material, purchase of the best cleaning equipment, experimenta-
tion with improved street cleaning practices, research into
experimental sanding material, and monitor application rates of
sanding material. Further, city shall monitor excavation
activities within City limits and adopt appropriate measures to
regulate dues from construction sites and construction trucks.
Section 2
That the City Council requests the Aspen/Pitkin Clean Air
Advisory Board, working with representatives of each of the Aspen
Lodging Association, Condominium Managers, Board of Realtors,
Aspen Citizens for Clean Air, and Environmental Health Depart-
ment, investigate the possibility of developing a combination
voluntary/regulatory program that may delay or prevent the need
for mandatory conversions of existing stoves and fireplaces to
cleaner ones. The Clean Air Advisory Board is requested to try
to formulate such a program by September 1, 1988, or as soon as
feasible, and to, at that time, advise Council about the
estimated funding requirements of such a program, both during
the remainder of 1988 and for 1989.
Section 3
In July, 1989, or when available, the Aspen/Pitkin Environ-
mental Health Department and Clean Air Advisory Board shall
present to the Council, a report on air pollution levels and

other data, the results of any estimates of amounts of reduction
in wood use; and estimates of levels of cooperation with no-burn
programs or other measures which it may have implemented. AT
that time the Clean Air Advisory Board shall recommend to the
Council either implementation of the conversion requirement,
continuation of the existing programs, modification of the
existing programs, or other measures.
Section 4
The Council has committed to comply with the EPA deadline of
three years after EPA approval of the Aspen Local Implementation
Plan for requiring conversion of existing stoves and fireplaces
to clean-burning ones unless other measures have solved the
problem or data indicate that such action would not solve the
health problem.
