HomeMy WebLinkAboutresolution.council.006-89 RESOLUTION NO. ~' (Series of 1989) A RESOLUTION GRANTING A COMMERCIAL ALLOTMENT TO 516 EAST HYMAN COMMERCIAL SPACE THROUGH THE 1988 CC/C-1 GROWTH MANAGEMENT COMPETITION WHEREAS, in accordance with Chapter 24 Section 8-106. of the Municipal Code, September 15 of each year is established as a deadline for submission of applications for commercial development allotments within the city of Aspen; and WHEREAS, in response to this provision, two applications were submitted for evaluation in the CC and C-1 competition category, entitled 516 East Hyman and 309 East Hopkins, requesting a total of 2,805 square feet, 1,571 square feet (excluding the basement area which is restricted to use solely by the tenants of the building) was requested by the 516 East Hyman project, and 1,234 square feet was requested by 309 East Hopkins; and WHEREAS, a duly noticed public hearing was held by the Planning and Zoning Commission (hereinafter "Commission") on November 22, 1988 to consider the CC and C-1 GMP Competition, at which time the Commission did evaluate and score the 516 East Hyman project; and WHEREAS, the 309 East Hopkins project remains to be scored. The City Council has agreed to allow the project to be indefinitely tabled until the applicants determine the approach they wish to take concerning the preservation of the historic structure. WHEREAS, the 516 East Hyman project met the minimum threshold of 26 points by scoring 32.5 points; and WHEREAS, there was no competition in any other zone districts for commercial allotments in 1988; and WHEREAS, the Commission considered the representations and commitments made by the applicant in scoring the 516 East Hyman project and granting special review approvals for a waiver of the employee unit parking space and for cash-in-lieu for the required number of parking spaces with the following conditions: 1. The applicants shall move the bench onto the site. It shall not be located within the public right-of-way. The site design shall be revised to reflect this change and shall be submitted to the Planning Office prior to review by the City Council. 2. The applicants shall provide a storm drainage system which is approved by the City Engineering Department. This system shall be approved in writing by the Engineering Department prior to issuance of a building permit for the project. 3. The applicants shall commit to allowing the additional dumpster space to be utilized by other occupants of the alley with first priority given to pre-existing structures which do not have the ability to provide on-site dumpster space. 4. The applicants shall be responsible for a cash in lieu payment for 2 parking spaces, to be paid at the time of issuance of a building permit. WHEREAS, the Commission also recommended approval of a Growth Management Exemption requirement for a 400 square foot employee unit with the following conditions: 1. The payment-in-lieu for 2.09 employees shall be made at the time of issuance of a Building Permit for any portion of the proposed development and indexed to the then current Employee Housing Guidelines Moderate Income Category. 2. That a deed restriction approved by the Housing Authority be recorded for the on site Studio Employee 2 dwelling unit before an issuance of a Building Permit for any portion of the development. Said unit shall be restricted to the then current Employee Housing Guidelines and indexed to the Moderate Income Category. WHEREAS, the Aspen City Council having considered the recommended Aspen Planning and Zoning Commission scoring for this project does wish to grant the requested allotment to 516 East Hyman. NOW, THEREFORE, BE IT RESOLVED by the City Council of Aspen, Colorado that 1,571 square feet of the CC/C-1 zone district commercial quota is hereby allocated to 516 East Hyman. BE IT FURTHER RESOLVED by the city Council of Aspen, Colorado that pursuant to Chapter 24, Section 8-108. of the Municipal Code, this allocation shall expire on the day after the third anniversary of the date of approval of a site specific development plan unless a building permit is obtained and the project is developed, or unless an exemption from or extension of the approval is obtained.
