HomeMy WebLinkAboutresolution.council.008-89 RESOLUTION NO. r; (Series of 1989) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, RELATIVE TO THE NOMINATION OF ELECTION COMMISSIONERS FOR THE CENTENNIAL/HUNTER CREEK/LONE PINE ANNEXATION WHEREAS, on or about January 13, 1989, an annexation elec- tion petition was filed with the City Clerk for property known as "centennial/Hunter Creek/Lone pine annexation (hereinafter "the petition"); and WHEREAS, on January 23, 1989, the City Clerk certified the signatures as sufficient and forwarded the petition to the City Council for the setting of a public hearing ; and WHEREAS, on February 27, 1989, the City Council held a public hearing with respect to the petition and set forth in Resolution No. 7 (Series of 1989) its finding of fact and its conclusion based thereon with reference to the matters set forth in Section 3l-l2-ll0, C.R.S.; and WHEREAS, the City Council directed the City Attorney's office to prepare and submit to the District Court of Pitkin County a petition to appoint Election Commissioners and hold an annexation election with regard to the petition; and WHEREAS, Section 3l-l2-ll2(4), C.R.S., provides for the appointment of three commissioners to conduct the annexation election, one of whom shall be nominated by the City; and WHEREAS, the Assistant City Manager, Ron Mitchell, is a resident of the State of Colorado, familiar with municipal election and annexation procedures which govern the annexation election and is willing to serve as an election commissioner; and WHEREAS, members of the petitioners' committee responsible for circulating the petition, have identified Michael Kinsley, who is a resident of the State of Colorado, a landowner of land in the area proposed to be annexed and wiling to serve as an election commissioner; and WHEREAS, Ron Mitchell and Michael Kinsley have agreed that, if appointed, the third commissioner proposed to the Court shall be Debbie Ayers, who is a resident of the State of Colorado and willing to serve and familiar with the petition; and WHEREAS, the City Council accepts both Michael Kinsley and Debbie Ayers as proposed commissioners with respect to this annexation election and request their appointment as election commissioners by the District Court of Pitkin County. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1 That the Assistant City Manager, Ron Mitchell, is hereby nominated by the City Council as an election commissioner with regard to the Centennial/Hunter Creek/Lone pine annexation and the City Council hereby accepts nominees Michael Kinsley and Debbie Ayers as the Centennial/Hunter Creek/Lone Pine election commissioners, and hereby requests their appointment by the District Court of Pitkin County. 2 Dated: ~ttL/L.e1 I , 1989.
