A RESOLUTION OF THE CITY COUNCIL OF ASPEN, COLORADO, RECOMMENDING
TO THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF PITKIN,
COLORADO, THAT iT ACCEPT CERTAIN LAND AND EASEMENT DONATIONS TO
WIDEN AND IMPROVE A PORTION OF THE SOUTH 7TH STREET EXTENDED
RIGHT OF WAY.
WHEREAS, South 7th Street extended from its intersection
with West Hopkins Avenue extended is a narrow public right of way
within the jurisdiction of Pitkin County but by agreement main-
tained by the City of Aspen; and
WHEREAS, the Board of County Commissioners of Pitkin County
declared its intention to widen and improve South 7th Street
extended and for that purpose adopted its Resolution No. 88-97 on
September 27, 1988, which is attached hereto as Exhibit "A"; and
WHEREAS, the proposed widening and improving of the South
7th Street extended right of way to a uniform width is only
possible through the acquisition of additional lands or easements
from private landowners abutting said right of way; and
WHEREAS, it has come to the attention of the City Council of
the City of Aspen, Colorado, that two landowners have offered to
donate land and easements to Pitkin County in order to create a
public right of way of a uniform width.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Aspen, Colorado, that it is the City's recommendation to
the Board of County Commissioners of Pitkin County, Colorado,
that it should accept the land and easement donations from the
landowners abutting the South 7th Street extended right of way.

true and. accurate copy of that resolution adopted by the City
Council of the City of Aspen, Colorado, at a meeting held on the

warranty deed from James S. Adams and Florence p. Adams to Pitkin
County, dated }lay 7, 1973, ' and covering approximately 2939.6
square feet of land iq the Adams subdivision was prepared~ and
~{EREAS, the unrecorded original of this deed is held by
Holland & Hart in escrow, pursuant to the ~ubdivision approval
and the plat recorded in compliance therewith, "until such time
as the County issues a declaration of intention to widen and
improve ?th Street into this area, at which time the deed will be
delivered to the County for recordingl,, end
WHEP~EAS, with the completion of the }larolt pedestrian
bridge last summer non-motorized vehicular and pedestrian traffic
at the intersection of South 7th S£reet end Hopkins Avenue has
increased creating potential conflicts between pedestrians and
motorized vehiclesl and
W]~RF2~S, site distances at the above-referenced intersection
have been limited by the growth of trees end the recent
construction of e wood fence on the east side of south 7th
Streetl and
W~EREAS, in response to the problems referred to above the
Board of County Commissioners desires to improve 7th Street and
requires the use of the lands that are the subject of the above-
referenced deed held in.escrow. ,
c .NOW T~{EREFORE BE IT RESOLVED by the Board of County
ommissioners of. Pitkin County, Colorado, that it does hereby
declare its intention to widen and improve 7th Street extended so
~- as to require use of this land for such right-of-way, such lands
" being more fully described in a ~pecial warranty deed from James
S. Adams and Florence p. Adams to Pitkin County or it~ nominee
dated May 7, 1973, covering 2939.6 ~quare feet in the Adams
subdivision, which deed is held in escrow by the law firm of
Holland & Hart. Accordingly the Board requests the release to it
of the above-referenced deed.

SEPTEMBER, 1988.
