HomeMy WebLinkAboutresolution.council.054-89 RESOLUTION NO. ~-~ (Series of 1989) RESOLUTION OF THE CITY COUNCIL OF ~HE CITY OF ASPEN, COLORADO, SUBMITTING TO THE ELECTORATE AT THE FEBRUARY 13, 1990 SPECIAL ELECTION A PROPOSED AMENDMENT TO THE SIXTH PENNY SALES TAX ORDINANCE LIMITING THE USE OF SIXTH PENNY SALES TAX REVENUES TO PARKS, TRAILS AND OPEN SPACE PURPOSES WHEREAS, Section 5.7 of the Aspen Home Rule Charter provides that the City Council, on its own motion, shall have the power to submit to the electorate, at any general or special election, any proposed ordinance; and WHEREAS, there has been proposed an amendment to Ordinance 16 (Series of 1970) limiting the use of sixth penny sales tax revenues to parks, trails and open space purposes; and WHEREAS, there has been scheduled a special election for February 13, 1990; and WHEREAS the City Council wishes to submit the proposed amendment to Ordinance 16 (Series of 1970) to the electors for their consideration at the scheduled special election. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aspen, that there shall be submitted to the electorate at the City of Aspen municipal special election scheduled for February 13, 1990 the question as to whether or not Section 7 of Ordinance No. 16 (Series of 1970) shall be repealed and reenacted to read as follows: "Section 7. Expenditures and Ear-marking of Revenues. All revenue from this retail sales tax collected on and after July 1, 1990 shall be set aside in a separate fund entitled "Parks and Open Space Fund." The monies of said fund shall be expended by the City Council solely for the acquisition of parks, trails and open space real property, for the construction of improve- ments on any real property owned or purchased by the City for parks, trails and open space purposes, for maintenance of real property owned by the City and used for parks, trails and open space, and for the payment of indebtedness incurred for acquisition or improvement of parks, trails and open space real property, food tax refunds payable by the City, and for such expenditures as may be necessary to protect real property or the improvements thereon owned by the City for parks, trails and open space purposes. Additionally, the revenue from this tax may be used for the payment of sales tax revenue bonds previously issued by the City of Aspen prior to January 1, 1990 which are secured by or payable out of the sales tax imposed by Ordinance No. 16, Series of 1970." Adopted by the Aspen City Council at its regular meeting held December 18, 1989. William L. Stirling, Mayor I, Kathryn S.
