(Series of 1990) A RESOLUTION SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF ASPEN, AT A SPECIAL MUNICIPAL ELECTION TO BE HELD MARCH 13, 1990, CONCERNING THE RECALL OF MAYOR STIRLING AND COUNCILMEN GASSMAN, CROCKETT AND PETERS WHEREAS, pursuant to Section 5.7 of the City Charter the city Council desires to submit to the registered voters of the city questions concerning the recall of Mayor stifling and Councilmen Gaesman, Crockett and Peters. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That at the special election to be held in the city of Aspen, Colorado, on Tuesday, March 13, 1990, there shall be submitted to a vote of the registered electors of the City the following questions: CITY OF ASPEN SPECIAL MUNICIPAL ELECTION March 13, 1990 MAYORAL SEAT GROUNDS FOR RECALL 1. Mayor Stirling has supported policies that are placing the City in serious financial jeopardy through litigation. 2. Mayor Stirling's rejection of the Consortium Proposal has placed the existence of the Meadows non-profits at risk. 3. Mayor Stirling has rejected at least four private employee housing proposals. 4. Mayor Stirling has continuously violated City Charter by attempting direct control of city Employees. 5. Mayor Stirling has created a major rift in the Community through advocacy of his personal agenda, threatening the basic economy of tourism to Aspen. 6. Mayor Stirling has forced three city Managers and important, experienced professional and technical staff to resign. JUSTIFICATION FOR COURSE IN OFFICE Serving 4th two-year term, duly elected by the people in May 1989. Have worked hard, discharged duties with diligence and conscientiousness, and acted ethically and fairly. Cannot please everyone, but have always acted in what I believe to best inter- est of my citizens and City of Aspen. Honest and straightforward about my political positions. Recall petition makes unsubstan- tiated, false, libelous charges. Recall should be used for malfeasance, not difference of opinion. Mayor is up for re- election soon: November 1990. It is in the best interest of good government and democratic process to allow me to serve out my term. Shall William L. stifling be recalled from the office of Mayor YES NO You must vote yes or no on the recall question to vote below. If you have voted EITHER yes or no, vote for one below. CANDIDATES NOMINATED TO SUCCEED Terry Butler (Vote for one) Wainwright Dawson SHORT TERM COUNCIL SEAT GROUNDS FOR RECALL 1. Councilman Gassman has supported policies that are placing the City in serious financial jeopardy through litigation. 2. Councilman Gassman's rejection of the Consortium Proposal has placed the existence of the Meadows non-profits at risk. 3. Councilman Gassman has rejected at least four private employee housing proposals. ~IW~ 4. Councilman Gassman has ridiculed citizens during public hearings. 5. Councilman Gassman's denigrating public remarks indicate disregard for the business and tourist economy. 6. Councilman Gassman did not exclude himself from the voting process on the issuance of a building permit regarding land which he and a former Councilman sold to the permittee. JUSTIFICATION FOR COURSE IN OFFICE 1. I have acted prudently in all matters concerning the finan- cial health of the city. 2. It is completely unproven speculation that my rejection of the consortium proposal placed the Meadows non-profits at risk. 3. I have rejected no private employee housing proposals, much less four. 4. I have never ridiculed a citizen during a public hearing. 5. I have never made a denigrating public remark. 6. It is not illegal or unethical to sell real estate. The City Council does not vote on building permits. VOTE NO ON RECALL Shall Michael Gassman be recalled from the office of Councilman of Aspen YES NO You must vote yes or no on the recall question to vote below. If you have voted EITHER yes or no, vote for one below. Candidates nominated to succeed Marcia Goshorn (Vote for one) Stephen F. Smith LONG TERM COUNCIL SEATS (TWO) GROUNDS FOR RECALL 1. Councilman Crockett has supported policies that are placing the city in serious financial jeopardy through litigation. 2. Councilman Crockett's rejection of the Consortium Proposal has placed the existence of the Meadows non-profits at risk. 3. Councilman Crockett has rejected at least four private employee housing proposals. 4. Councilman Crockett has made a mockery of the role of Councilman and has proven himself unworthy of holding an office of public trust. 5. Councilman Crockett has ridiculed citizens during public meetings. 6. Councilman Crockett has violated the City Charter by forcing a City employee to issue a vacation offer to all City employees, superseding the City Manager. Shall Steve Crockett be recalled from the office of Councilman, Aspen, Colorado YES NO GROUNDS FOR RECALL 1. Councilman Peters has supported policies that are placing the City in serious financial jeopardy through litigation. 2. Councilman Peters's rejection of the Consortium Proposal has placed the existence of the Meadows non-profits at risk. 3. Councilman Peters has rejected at least four private employee housing proposals. 4. Councilman Peters has a direct conflict of interest regard- ing Ritz issues due to ownership of two hotels. 5. Councilman Peters has failed to abstain from deliberations and voting on Ritz Carlton Hotel issues. 4 6. Councilman Peters, by filing a suit against the City, has abdicated his fiduciary responsibilities to the People of Aspen. JUSTIFICATION FOR COURSE IN OFFICE The Meadows is currently being planned in public, with the full participation of the non-profits. The only private housing development the Council processed was the Holiday House expansion, which was quickly approved with all fees waived by the city. The charge of conflict of interest is not supported by the facts, the law, nor by my voting record. I voted to: a) Return $1,000,000 cash bond to Hadid b) Allow construction to continue after Ossola's ruling c) Prepare the corrective ordinance d) Allow the electorate the final Hotel decision The charges as a whole are specious and manufactured. VOTE NO FOR REC2~LL. Shall Frank Peters be recalled from the office of Councilman, Aspen, Colorado YES NO You must vote yes or no to at least one question above to vote below. If you have voted yes or no on the question of the recall of both Steve Crockett and Frank Peters, then vote for two candidates below. If you have voted yes or no on the question of the recall of only Steve Crockett or only Frank Peters, then vote for one of the candidates below. The polling places shall be at the following locations: Precinct 1 - St. Mary's Church, Main and Hunter Precincts 2, 3 - Upper Elementary School, 110 E. Hallam Precincts 4,5 - Christ Episcopal Church, 536 North Street Preceints 6,7 - Upper Elementary School, 110 E. Hallam Section 3 The aforesaid special election shall be conducted by the judges and clerks who shall be designated by the City Clerk with the approval of the City Council of the City of Aspen. The provision for the registration of electors and for voting by absentee ballot on the question shall be in accordance with the Colorado Municipal Election Law. The votes at said election shall be registered on electronic voting machines at the polling place. Section 4 Notice of the election on the proposed question shall be published in the Aspen Times, a newspaper published and of general circulation in said City, and the edition of said news- paper dated , 1988, and a copy of such Notice shall be posted in the office of the City Clerk at least ten (10) days before the election. Hallam Those electors who are otherwise fully qualified to vote on said questions at such election, but who are or will be unable to appear at the polling place on the date of the election, may apply in writing at the office of the City Clerk, at the Aspen City Hall, for an absentee ballot, or at any time during business hours, on or before March 9, 1990. The votes cast shall be recorded on voting machines and said election shall be held, conducted and the returns thereof shall be returned, canvassed and declared, as nearly as may be in the manner prescribed by law for the special election of municipal officers.
