HomeMy WebLinkAboutresolution.council.023-90 'a I. ,41 ,e RESOLUTION (Series NO. ~3 of 1990) A RESOLUTION SUBMITTING A PROPOSED AMENDMENT TO THE CITY OF ASPEN HOME RULE CHARTER TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY AT A SPECIAL ELECTION TO BE HELD ON JULY 10, 1990 WHEREAS, pursuant to the Municipal Home Rule Act of 1971, specifically section 31-2-210, a charter amendment to the City of Aspen Home Rule Charter may be initiated by a petition circulated and signed by registered electors of the City; and WHEREAS, a duly certified petition calling for a charter amendment by special election to be held on July 10, 1990, has been submitted to the City Council by the City Clerk, such charter amendment seeking to move the general municipal election from November to the first Tuesday following the first Monday in May of each odd numbered year and eliminating the primary elec- tion to be held on the second Tuesday of August; and WHEREAS, Colorado Revised Statutes Section 31-2-210(4) of the Municipal Home Rule Act of 1971 requires the City Council to publish notice of such special election within thirty (30) days of the filing of such petition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That at the special election to be held in the city of Aspen, Colorado, on Tuesday, July 10, 1990, there shall be submitted to a vote of the registered electors of the City the following question: e Ie 'e QUESTION NO. 1 - REPEALING AND REENACTING SECTION 2.2 OF THE MUNICIPAL CHARTER OF THE CITY OF ASPEN TO ESTABLISH A GENERAL ELECTION IN MAY: "Shall section 2.2 of the Municipal Charter of the City of Aspen, Colorado, be repealed and reenacted to establish the general municipal election on the first Tuesday after the first Monday in May, and eliminating a primary election, such that section 2.2 as repealed and reenacted would read as follows: A general municipal election shall be held on the first Tuesday after the first Monday in May of each odd numbered year. Any special municipal election may be called by resolution or ordinance of the Council at least 60 days in advance of such election. The resolution or ordinance calling a special municipal election shall set forth the purpose or purposes of such election. Polling places for all municipal elections shall be open from 7:00 a.m. to 7:00 p.m. on election days." section 2 There shall be seven municipal election precincts at one polling place for the aforesaid election which shall be located at Red Brick Elementary School, 110 East Hallam. section 3 The aforesaid general election shall be conducted by the judges and clerks who shall be designated by the City Clerk with the approval of the City Council of the city of Aspen. The provision for the registration of electors and for voting by absentee ballot on the question shall be in accordance with the Colorado Municipal Election Law. The votes at said election shall be registered on electronic voting machines at the polling place. The ballot label shall read as follows: 2 (. -~ . I. On each voting machine there shall be spaces which will permit the elector to indicate his or her vote "FOR THE QUESTION" or "AGAINST THE QUESTION". section 4 Notice of the election on the proposed question shall be published in the Aspen Times, a newspaper published and of general circulation in said City, and the edition of said news- paper dated ~ 2~'~ 6' , 1990, and a copy of such Notice shall be posted in the office of the city Clerk at least ten (10) days before the election. The City Clerk is hereby charged with the duty of giving Notice of the election, the question to be submitted, as hereinabove provided, which notice shall be in substantially the following form: 3 '.
