HomeMy WebLinkAboutresolution.council.020-91 P~ESOLUTION NO. ~ (Series of 1991) A RESOLUTION GPJ~NTING AN EXTENSION OF TIM~ WITHIN WHICH TO RECORD THE SUPPLEMENTAL PLAN~ED UNIT DEVELOFF~ENT AGREEMENT, AMENDMENT TO THE CORTINA AGREEMENT, AND PLAT A/(~NDMENT FOR THE HOTEL JEROME. SfKEREAS, on November 12, 1990, the City Council gave final development approval for the Hotel Jerome PUD A~endment for increasing its outdoor seating by Ordinance No. 70 (Series of 1990); and WHEREAS, Section 7-907 of Chapter 24 of the Municipal Code for the City of Aspen provides that the failure of a development applicant to record its planned unit development agreement and plat within 180 days following approval of same by the City Council shall render the development approvals, plans and plat invalid; and WHEREAS, the applicant Jerome Hotel has signed the PUD amendment as required in Ordinance No. 70 and prepared a corre- sponding plat, but not within the mandated 180 days, and the delay, in part, was occasioned by the negotiations between the city and the Hotel Jerome to satisfy the conditions of Ordinance No. 70; and WHEREAS, the Hotel Jerome has e×ercised due diligence in pursuing its application and the execution of necessary agree- ments; and WHEREAS, the City Council has determined that under the particular circumstances as described above, fairness and equity favor and warrant relief for the development applicant from the 180-day recording re~irements as contained in Section 24-7-907 of the Municipal Code. NOW, THE~FORE, BE IT ~SOLVED BY ~E CITY COUNCIL OF THE CITY OF ASPEN, CO~DO, T~T: The development applicant for the Hotel Jerome PUD amendment be and is hereby granted an extension of the 180-day recordation requirement as contained in Section 24-7-907 of the Municipal Code for the city of Aspen for 60 days from the date of this Resolution, or to and until July 29, 1991, and such extension is hereby made retroactive to May 11, 1991. 1991, by the City Council of the City of Aspen, Colorado.
