A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
CALLING FOR A_ND ESTABLISHING A DATE FOR A SPECIAL MUNICIPAL
ELECTION.
WHEPd~AS, Section 2.2 of the Home Rule Charter of the City of
Aspen provides that any special municipal election may be called
by resolution or ordinance of the City Council at least sixty
(60) days in advance of such election; and
WHERMAS, any resolution or ordinance calling a special
municipal election shall set forth the purpose or purposes of
such election; and
WHEREAS, the City Council desires to call and establish the
date for a special election so as to allow the electorate the
opportunity to vote upon the establishment and imposition of an
excise tax as required by Section 12-1 of the Home Rule Charter.
NOW, THEREFORe, BE IT R~SOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO~ THAT:
Section 1
A special municipal election shall be and is hereby called
and established for Tuesday, September 24, 1991, for the purpose
of submitting to the electorate an ordinance establishing and
imposing an excise tax upon the use of commercial ski lifts,
gondolas, chairlifts, ski tows and other devices used to trans-
port persons up or down a slope, hillside or mountainside for
purposes of skiing, sightseeing or other recreational purposes,
the proceeds of such excise tax to be used to defray the cost of
skier transportation services.
Section 2
The City Clerk shall give written or printed notice of the
special election called forth herein at least ten (10) days prior
to said election and shall include in said notice the date of
said election and the hours during which the polls will be open,
designating the polling place of each precinct, stating the
qualifications of persons to vote in the election and the ques-
tion or questions to be voted upon. A copy of such notice shall
bs published in at least one newspaper having general circulation
within the City of Aspen. If the Clerk finds it impractical to
make the publication on the tenth day before the election day,
she shall make the sa~e on the earliest possible day before the
tenth day. Publication in any weekly newspaper shall be in the
next to last issue thereof before the day of the election. A
copy of such notice shall also be posted until after the election
in a conspicuous place in the office of the City Clerk.
Section 3
The City Council finds and declares that the adoption of
this Resolution presents an emergency and is necessary for the
preservation of the public health, safety and welfare. Specific-
ally, City Council finds that the enactment of the s×ciee tax as
described hereinabove is essential to provide for the continued
operation of skier transportation services within the City, that

such excise tax must be adopted and effective prior to the onset
of the 1991/92 skiing season and that, hence, the election
determining whether such excise tax shall be adopted must be
conducted as soon as permitted pursuant to the provisions of the
Home Rule Charter and the Colorado Municipal Election Code.
RESOLVED, APPROVED AND ADOPTED this 22nd day of July, 1991.
