HomeMy WebLinkAboutresolution.council.032-91 R~SOLUTION NO. ~ (Series of 1991) A P~ESOLUTION OF THE CITY COLrNCIL OF THE CITY OF ASPEN, COLORADO, SETTING THE BALLOT QUESTION LANGUAGE RELEVkNT TO TEE SPECIAL ELECTION TO BE H~LD ON SEPTEMBER 24, 1991, PERTINENT TO THE PROPOSED ADOPTION OP A NEW EXCISE TAX. W-HER~AS, Section 12.1 of the Home Rule Charter for the City of Aspen provides that City Council may levy and collect taxes for municipal purposes provided that no income tax, sales tax or excise tax shall be levied until such tax shall have been ap- proved by a majority of the electors of the City voting at a regular or special election; and WHEREAS, city Council has proposed for adoption Ordinance No.__ (Series of 1991) which provides for an excise tax upon the use of com/~ercial ski lifts situated wholly or partially within the boundaries of the City, said tax to be levied at a rate of . percent upon the charge for use of a com~ercial ski lift; and WHEREAS, Section 5.7 of the Home Rule Charter empowers the City Council to submit at a general or special election proposed Ordinance No. (Series of 1991) to a vote of the people; and WHEREAS, City Council has previously called and established pursuant to Resolution No. 30 (Series of 1991) a special election for purposes of submitting to the electorate for its approval or rejection Ordinance No. (Series of 1991). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section l The ballot title, s~ary and submission clause for the ballot at the Septet%her 24, 1991, special election concerning the adoption or rejection of an excise tax to be imposed and collect- ed upon the use of commercial ski lifts shall read as follows: QUESTION NO, 1. AUTHORIZING ThE ADOPTION A/~D IMPOSITION OF A/~ EXCISE TAX ON THE USE OF COMI~RCIAL SKI LIFTS AND SIMILAR DEVICES LOCATED ENTIRELY OR PARTIALLY IN THE CITY OF ASPEN AND DEDICATING THE REVq~NIIE GEhrEP~kTED THEREFROM TO THE FUND- ING OF A SKIER SHUTTLE TRANSPORTATION SERVICE. "Shall Ordinance No. (Series of 1991), which adopts and imposes an excise tax upon the use of commercial ski lifts, gondolas, and similar devices at a rate equal to percent of the amou_~t charged for the use thereof, and w--~ch authorizes the Director of Finance to promulgate rules, regulations and procedures for the collection of said tax, and which provides that the revenues generated by such excise tax be earmarked and dedicated to fund the operation and maintensnce of a skier shuttle transportation service, be adopted. FOR THE QUESTION AGAINST THE QUESTION Section 2 The City Clerk is hereby directed to publish the ballot title, summary and submission clause as provided for herein in a newspaper of general circulation in the City of Aspen. If the Clerk finds it impracticable to make the publication on the tenth day before the election day, she shall make the same on the earliest possible day before the tenth day. Publication in any weekly newspaper shall be in the next to last issue thereof before the day of the election. Section 3 Pursuant to Section 5.6(b) of the Home Rule Charter, the City Clerk shall make available to the public copies of the proposed ordinance referred to the ballot in advance of the election and shall have a reasonable n~her of copies of the proposed ordinance available for inspection at each polling place on the day of the election. Copies shall also be posted in a conspicuous place at the Clerk's office and at each polling place on the day of the election. RESOLVED, APPROVED AND ADOPTED the day of , 1991, John S.
