HomeMy WebLinkAboutresolution.council.035A-91 (Series of 1991) A RESOLUTION OF THE CITY COUNCIL OF T~E CITY OF ASPEN, COLORADO, R~SETTING THE DATE FOR A SPECIAL MLrNICIPAL ELECTION. WHEREAS, on July 22, 1991, City Council adopted Resolution No. 30 (Series of 1991) calling and establishing a date for a special municipal election regarding the approval and imposition of a new municipal excise tax; and WHEREAS, City Council previously established and set the date for such special municipal election for Tuesday, September 24, 1991; and WHEREAS, an ordinance establishing and defining the proposed municipal excise tax has yet to be adopted by the city Council for referral to the electorate at the special municipal election; and WHEREAS, City Council will not be able to timely adopt and refer to the September 24, 1991, special election ballot the excise tax ordinance as initially contemplated in the adoption of Resolution No. 30 (Series of 1991); and WHER~S, negotiations directed at determining an alternative to the adoption of a tax to fund the future operation of a skier shuttle transportation service are continuing between City Council and other parties which may result in the elimination of the need for an excise tax. NOW, THER]EFOPdE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1 The date for the special municipal election presently scheduled for September 24, 1991, shall be and is hereby vacated and reset to Tuesday, October 21, 1991. Section 2 The City Clerk shall give written or printed notice of the rsscheduled special election called for herein at least ten (10) days prior to said election and shall include in said notice the date of said election and the hours during which the polls will be open, designating the polling place of each precinct, stating the qualifications of persons to vote in the election and the question or questions to be voted upon. A copy of such notice shall be published in at least one newspaper having general circulation within the City of Aspen. If the Clerk finds it impractical to make the publication on the tenth day before the election day, she shall make the same on the earliest possible day before the tenth day. Publication in any weekly newspaper shall be in the next to last issue thereof before the day for the election. A copy of such notice shall also be posted until after the election in a conspicuous place in the office of the City Clerk. 2 RESOLVED, APPROVED AND ADOPTED this day of , 1991, by the city Council for the City of Aspen, Colorado.
