'/3 (Senes of 1991) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, PURSUANT TO THE COLORADO UNDERGROUNDING CONVERSION OF UTILITIES ACT, 29-8-101, ET SEQ., C R S DECLARING THA.T IT FI1\'DS THE FORMATION OF A LOCAL IMPROVEMENT DISTRICT WlLL PROMOTE THE PUBLIC CONVE.c"UEKCE, :'ffiCESSITY At'ID WELFARE; AND ORDERING ALL PUBLIC UTILITIES SERVING SAID DISTRICT BY OVERHEAD ELECTRIC OR COMMU1\lCATION FACILITIES TO MAKE A STUDY OF THE COSTS OF CONVERSION OF THEIR FACILITIES TO UNDERGROUND SERVICES, WHEREAS, the City Council of the City of Aspen, Colorado, deems It Ul the public Ulterest to form a local improvement distnct wholly WlthUJ the temtonallirmts of the City of Aspen, as depIcted in the attached map appended hereto as Exlubit "A" and by this reference Ulcorporated hereUl as if fully set forth here, for the purpose of converting overhead electrical and co=unicatlOn seIVlce lines to underground seIVlce in accordance Wlth the Colorado . Underground Conversion of Unlities Act, 29-8-101, et seq" C.R.S , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT Section 1 Pursuant to 29-8-101, C R.S., the City Councll hereby determmes that the formation of a local unprovement d.1strict for the purposes set out Ul the Colorado Underground Conversion of Ul1l10es Act will promote the publ1c convenience, necessity and welfare Secllon 2 The City of Aspen hereUl requests each public unlity seIV1l1g the above menlloned d.1strict by overhead electncal or co=unicaoon facilities to make a study of the costs of conversIon of Its facllloes Ul such area to underground seIVlce e Section 3 Each public utility ul1l1zmg overhead electric or co=unicaoon facilities WIthin the e proposed district shall be provIded by the CIty Engmeer Wlth the name and address of the owner of each pan::el or lot Wltlun the proposed unprovement mstnct, if known, and If not known, the descnpllon of the property and other such matters as may be reqUlIed by the public utility Ul order to perform the work Involved and the cost study SecOon 4 A report of said study shall be filed Wlth the CIty Clerk WlthU1 one hundred and twenty (120) days from the adopOon of this resoluoon and shall be made available in the offices of the City Clerk and the affected utilities to all owners of land WlthUJ the proposed unprovement dIstrict. Section 5 In accordance with SecOon 29-8-106, C R S, the CIty Counc1l, by thIS resoluOon, e expresses Its Ultenllons that the costs and expenses of undergrounmng such unlities shall be levied and assessed upon the property benefited.
