RESOLUTION NO. 15
(Series of 1991)
A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF ASPEN, COLORADO,
CONTINUING A MORATORIUM ON MUNICIPAL WATER SYSTEM EXPANSIONS
AND/OR CAPITAL IMPROVEMENTS.
WHEREAS, on March 14, 1991, the City council for the City of
Aspen did adopt Resolution No. 12 (Series of 1991) for the
purpose and intent of imposing a moratorium on capital improve-
ments to and/or expansion of the City'S municipal water system
regardless as to whether such capital improvements or expansions
were to occur within or without the municipal jurisdictional
boundaries of the City of Aspen; and
WHEREAS, the moratorium as imposed by Resolution No. 12
(Series of 1991) was to take effect on March 14, 1991, and
continue until such time as the City Council approved a compre-
hensive water conservation policy, or until such time as the city
Council otherwise voted by resolution to discontinue such morato-
riu.m; and
WHEREAS, since the adoption of Resolution No. 12 (Series of
1991), the City Council has approved and adopted comprehensive
water conservation ordinances; and
WHEREAS, since the adoption of Resolution No. 12 (Series of
1991), city Council has been apprised of significant and continu-
ing problems relevant to the operation and proposed expansion of
the municipal water system; and
WHEREAS, the City Council has determined that the continua-
tion of the moratorium on the expansion of or capital improve-

ment to the municipal water system would be in the best interests
of the public health, safety and welfare and will afford the city
council time to investigate, study and resolve problems and
policy issues associated with the operation and expansion of the
municipal water system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
1. The moratorium on expansion of or capital improvement
to the municipal water system, regardless as to whether such
expansion or improvement is to occur within or without the
territorial limits of the City of Aspen, as originally imposed on
March 14, 1991, pursuant to City council Resolution No. 12
(Series of 1991), is hereby reaffirmed and extended until such
time as the City Council votes by subsequent resolution to
discontinue and lift same.
2. The moratorium as continued hereunder shall not apply
to or restrict service connections to the municipal water system
by individual residences or businesses, or the undertaking of
necessary repairs, and shall likewise not apply to expansions,
improvements or repairs currently funded and under actual con-
struction.
3. The city Manager is authorized to bring to the atten-
tion of City Council for its approval any water system capital
improvement or expansion project which she deems must be excepted
from the moratorium and City Council may, within its discretion,

grant exceptions to the moratorium upon good and sufficient
cause.
