This is to give you official notice of the County's intention to relocate the Building and Grounds. Main~enaDce Shed and operation to the Aspen Consolidated,Sal1itation .District property located on lower Mill street. As you know, the Building and Grounds Shed has been forced to relocate from the COMIDunity Center site due to the expansion of the Hunter Longhouse affordable housing complex. We also intend to consummate a land trade with the District such that we would convey to the District Parcel A of.. Collnty Land as shown on the attached Exhibit A and receive in return Parcel B from the District as shown on the. attached Exhibit B. We would like to apply, by way of this memo, for an exemption from subdivision for these conveyances on the grounds that they are being consummated for the purpose of creating parcels for Community Facilities as allowed under Section 4.4.2 of the Land Use Code. We would also like to apply, in conjunction with the District, for an amendment to the District's Master Plan for their property in order t() ins;:orporate these actions into that Plan and thereby conform to the. requirements of the District's Public Zone. The following are the key elements in these proposed actions: 1. ) The Building and Grounds f\lnc:t.iclhs . ..al1d. . the... Sanitation District activities now taking place at the Sanitation District site are compatible in that both are public juriSdictions, engaged in technical support services to the public infrastructure, and semi-indl.lstrial in nature. The activities carried out by the Sanitat.iol1.. . Die.trict an.d . the . . Maintenance. Department will not interfere-iriany way with each, other and may in fact enhance each other's WOrlc by providing opportunities for cooperation between these two entities. 2.) The Sanitation District site is centrally located but is uniquely shielded from other usee or residences which.. might be adversely impacted. It is bounded by the Roaring Fork River, the Rio Grande Trail, .and the Mill street/Puppy Smith Street business complex. It is visible only by Rio Grande trail users. and the nearest house is Marc Friedberg's, which is across the Roaring Fork. This central location is eesential...to the efficient and effective operation of the Building and Grounds Maintenance Department and this location offers the best mix of location, ~ f__\ permanence, operating area and compatibility with surrounding uses of any that we studied while trying to find an appropriate relocation site. Our complete alternative analysis listing the sites studied and the pros and cons of each is available for your information upon request. , 3.) The land that would be transferred from the County to the Sanitation District has recently been tentatively proposed for affordable housing development, a proposal which raised serious questions about floodplain and riparian impacts, the compatibility of a multi-unit development with the Sanitation District activities and functions, and the advisability of converting open space with river frontage to a developed, semi- . private use. It is the conclusion of the Housing Office, the Sanitation District, and the Property Management Office that the best use of this site is to keep it in open space as a buffer between the Sanitation District/county Maintenance and the river and to reserve it for possible expansion of the trail system or riparian recreation facilities (i.e. fisherman access). The Sanitation District, in recognition of the potential conflicts between their operation and intensive development of this parcel, has committed to dedicating the land to open space and has not ruled out discussing possible compatible public uses such as those noted above. 4.) The Sanitation District has noted, in their preliminary discussions with the County, their interest in limiting the size and scope of the County maintenance function to more or less its present size. We anticipate at this point that the permanent facility would consist of the preexisting office, storage and wood shop areas with the addition of a toilet/shower/scrub sink facility and possibly some small amount of additional storage area. We have no plans or intention to expand the size of the maintenance function or to add on employee housing, garage space or other new functions or facilities. 5.) The Sanitation District has said that if and when it pursues further affordable housing development for its employees as per its Master Plan, they will remain open to designing that housing with County needs in mind. That is, if we mutually determine that some County housing for building and grounds maintenance employees is appropriate on site, the Sanitation District will remain open to that possibility and expand their housing proposal accordingly. We have also concluded, with the Sanitation District, that the addition of the County's open space to their holdings will increase their design options for future employee housing and generally enhance the likelihood of such development. 6.) The county will take whatever steps are necessary to shield the Maintenance Facility from the Rio Grande Trail and from any other location identified as being visually impacted by the development. We will be working with the Sanitation District to determine the exact building location so as to take the maximum advantage of all available natural vegetative screening and 1""'\ t'") . preexisting structures but we are prepared to install additional plantings or repaint so as to soften the structure's visual impact. 7. ) No operations will take place from the Maintenance Shed until this application has been acted on and a permanent operating agreement governing hours and types of operations, terms of the land exchange, etc. has been finalized. In the meantime, the County's building and grounds maintenance department is operating out of scattered locations. We would appreciate any action you could take to expedite this application and assure that we can finalize this arrangement before next winter. May 25, 1989 Mr. Alan Richman, Director Aspen/Pitkin County Planning Department 320 South Galena Aspen, Colorado 81611 RE: Maintenance Shed Move Dear Alan, This is in response to your message of May 22 requesting the permitting of the Maintenance Shed move as we have discussed. We are proposing to move the Maintenance Shed from its present location adjacent to the Community Center to the Aspen Consolidated Sanitation District Property on Mill Street. This move is being carried out pursuant to the proposed permanent relocation of the facility to the Sanitation District site. An application for consummating this move on a permanent basis is currently being prepared and will come before you in due course. In the meantime, we are requesting immediate permission to move the building on a temporary basis so that the Hunter Longhouse expansion can occur. Attached please find a site plan showing where we propose locating the building and a document from Tom Bracewell, the Aspen Consolidated Sanitation District Engineer, giving us permission to relocate the building on a temporary basis and to apply for the permanent relocation. It is important to note that no operations will take place out of the relocated shed until the permanent relocation has been fully reviewed and permitted. The building will simply be stored on the site and used as a location for storage of unneeded equipment (mostly snowblowers and other winter maintenance equipment) while the full permitting process is pursued. Yours truly, Mark Fuller, Assistant Manager Pitkin County cc: Lyn Byars Bud Eylar Tom Bracewell this the ~ ~ co pitkin county June 6, 1989 Aspen Consolidated Sanitation District Board 565 North Mill street Aspen, Colorado 81611 RE: Relocation of County Building Maintenance Shed Dear Gentlemen, I am writing on behalf of the Board of County Commissioners to formally propose to you that the County and the Sanitation District enter into discussions aimed at conveying 2.12 acres of county land contiguous to your Mill Street parcel to the Sanitation District in exchange for a parcel of Sanitation District land that would accommodate a relocated County Building and Grounds Maintenance Shop and for other considerations. This letter is also intended to act as a temporary agreement which will allow the county to relocate the existing Maintenance Shed from its current location adjacent to the Community Center to the sanitation District parcel identified on the attached map. The proposed terms of the temporary agreement are as follows: 1. The County will take full responsibility for site preparation, moving and temporary relocation of the Maintenance Shed to the site shown on the attached map. This work will be carried out solely at the County's expense and will be coordinated with Sanitation District staff so as to assure minimal disruption to Sanitation District activities. 2. The exact relocation site will be staked on the ground in coordination with Sanitation District Staff. si te preparation work will be limited to topsoil and vegetation removal, installation of a gravel pad and small concrete footers, installation of cinder block supports, or installation of a concrete pad and footings, whichever is deemed most suitable. All site facilities and materials will be removed and original contours and vegetation restored should the parties determine at any time that this site will not be the permanent location of the Maintenance Shed. All site relocation preparations, as well as site restoration work, shall be accomplished at the expense of the County or the Aspen-pitkin county Housing Authority. 3. The Maintenance Shed will be. used for !;torage purposes only unless and until this Agreement is supplanted by a permanent land-exchange agreement between the parties or such other agreement as may be appropriate. The Sanitation District will permit the County access to the Shed for maintenance and materials and equipment transfer purposes during regular business hours during the term of this temporary agreement. The County will investigate the feasibility of obtaining and construct~ng a separate access off of Puppy Smith Street prior to the execution of any future Agreement and will pursue the construction of such an alternative access if deemed feasible. 5. The term of this Agreement will be until NovE!mber 1, 1989 or until it is supplanted by a permanent agreement between the parties, whichever comes first. This Agreement may be extended at any time and for any period by mutual agreement of the parties. 6. This Agreement may be terminated at any time by either party upon twenty (20) days' prior written notice. Notice of termination will be conveyed from one party to another by certified mail. The County will take full responsibility and bear all expenses for the development and processing of any and all land use permits, utility installation agreements, construction contracts or other actions necessary to complete a permanent development of the Building and Grounds Maintenance building on the identified site, if the parties agree thereto. The County will assist the Sanitation District in any necessary amendments to the District's Master Plan for their property. At such time as the parties may agree to an exchange of properties, the Sanitation District will be responsible for the appraisals of the County Land and the proposed Maintenance Shed site. This letter. will represent the Sanitation District's formal permission to the County to submit and process appropriate land use applications aimed at making this arrangement permanent as mutually agreed by the County and the District. As you know, we have moved the shed to a temporary location on District property based on a preliminary permission issued by Tom Bracewell. We deeply appreciate your cooperation in this matter and we are prepared to remove or demolish the shed if this Agreement cannot be concluded. In the meantime we feel the need to document a formal understanding between us while we pursue a more permanent arrangement and applicable land use permits. We have established a target date of July 1 to submit a completed land use application to the Planning Office.
