Application for Land Use Review Dear Al, I've been meaning to contact you for several weeks regarding the September 1993 application for annexation, rezoning, and SPA review which is still being held in the Planning Office. The last file notation for this case was in early 1994 regarding processing fees. I have not received any new information regarding this project. Because of the length of time which has elapsed and the number of plan changes which were occurring after it was submitted to us, I intend to direct the Planning administration staff to close the file and do a final billing for the project. If there is continued interest in pursuing this application by A.C.E.S., work needs to resume within the next month. Please contact me by May 10 if this is the case. You would then need to meet with a Planner and go over.the current status of the project. If the case is to be closed, Planning would keep one copy of text and drawings in the retired file. If you would wish to retrieve the extra copies (and rendered presentation board), please do so no later than May 10. Contact Suzanne Wolff at 920-5093 if you want these copies held for you. I am retiring from the Planning Office effective June 2. Therefore, I would like to close out this file in May or pass on a revitalized project to another Planner. I told him we would know more after we get further direction on our water department housing project. What we have on file is so old, I don't think that anything within it could be used for a current review. It was submitted in Sept. 1993. You may recall they wanted to swap land with the City, which this plan indicates. After a certain reasonable time, I think it is best to have them reapply. It isn't a lot of money to worry about for Amend 1 I don't think, so if you want I can pay them the whole amount and you can bill them for the additional fees. Did they waive fees or did they say that they would give ACES a non-profits grant that happened to include the cost of the fees? It doesn't matter to city in general, but matters to our dept. budget. I stressed that due to the specifics issues of this project (ie the "soft housing" concept), it was likely that additional staff hours, meetings, and therefore fee billings would be necessary. We have determined that this application is incomplete and cannot yet be considered for scheduling. Please address the following items in order to complete the application. 1. Submit 12 more copies of the blueprints to replace those used for the HPC review. The rezoning map must show the surrounding zone districts in the City and the County, and the current zoning of the subject properties. 2. APPLICANT has submitted to CITY an application for rezoning, conceptual SPA, conditional review, special review, GMQS exemption, relocation of historic structure, and vacation of street. The name of the structure proposed for relocation is the ACES' Professor House. 2. The structure is a two-bedroom, one-bath, single-family residence which has been substantially altered and remodeled, and is now used by the applicant as housing for visiting professors during the summer season, and for staff housing during the reminder of the year. 3. The architect's report, in the form of a letter to the applicant, is attached. 4. The applicant estimates the market value of the property on which the structure lies to be in excess of $400,000. No formal appraisal of the property has been made. 5. The applicant's Development Application. of which this specific submission is a part, proposes the development of extensive and much- needed faculty housing on this and adjacent properties. The present location of this structure interferes with this proposal. These estimates are very conceptual and should be reconfirmed or bid in the event that you decide to move the residence. The current condition of the structure is marginal to bad. The back bedroom addition would have to be removed and rebuilt if desired and you should expect some damage to the materials and finishes inside which would require repair and/or replacement. S.) summary: Tom Cardamone, Director of A.C.E.S., requests a refund of a Park Dedication Fee of $780.00 which was paid prior to issuance of a building permit for the addition of one bedroom to the principal caretaker unit at A.C.E.S. Also requested is a refund of the $358.50 Water Tap Fee. Planning staff recommends that this Park Dedication fee be refunded to A.C.E.S. upon annexation of the A.C.E.S. property into the City. The Water Department recommends that the Water Tap Fee refund not be granted. Council Goals: In an effort for the City to be fair and sensitive to residents, staff's recommendations support Goal #15. Background: For residential uses, Park Dedication Fee assessments are based on numbers of bedrooms. The primary A.C.E.S. caretaker unit (which is located within City Limits) has received a building permit for the addition of one bedroom. The intent of the Park Dedication Fee is to fund acquisition and development of parks/recreation lands. A.C.E.S. Director Tom Cardamone is requesting that this fee be refunded. His request letter states that "Since the property is deed restricted to conservation and education purposes, it seems inappropriate for the City to collect a $780.00 Park Dedication fee." (Attachment "A") The Water Tap Fee is assessed for "any additional construction or water fixture additions" according to Director of Water, Larry Ballenger. Please see memo, Attachment "B". Staff Discussion: A.C.E.S. is recognized throughout the community as a valuable open space/park asset which in itself embodies the City's goals to acquire quality lands of this type. The Park Dedication Fee was established to provide a funding source for purchase and maintenance of these lands. Planning staff believes that it would be redundant to charge A.C.E.S. this fee as the property has been deed restricted for the "study and preservation of birds, wildlife, and the ecology." However, there is concern among staff that A.C.E.S. has not followed through with the commitment to annex their property as promised during negotiations for the Hallam Lake pipeline which was paid for by the City of Aspen. The Planning Office believes that the annexation should be completed before any fee waivers be granted to A.C.E.S. The Water Department grants tap fee waivers only for the initial connection of 100% deed-restricted housing . Any additional work requires appropriate fee payment. Director Ballenger does not support a refund of the $358.50 assessment. Alternatives: The Council could elect to not approve this request, keeping both of the fees. Council could choose to refund either or both of the fees now, without the contingency of annexation. Financial Implications: This request would lessen the appropriate funds by the requested amount unless Council's contingency fund replaced the monies. Recommendation: Planning recommends refunding the $780.00 Park Dedication Fee contingent upon the annexation of A.C.E.S. into the City. The Water Department does not recommend refund of the $358.50 water tap fee. If one or both fees are refunded, Planning recommends that the City Council contingency fund replace the monies into the appropriate fund(s). Proposed Motion: I move to approve the refund of the $780.00 Park Dedication Fee paid by A.C.E.S. at the time that the annexation of A.C.E.S. in complete. Dear Council, ACES is adding a 190 square foot bedroom addition to its principal caretaker unit at 100 1/2 Puppy Smith Street. Since the property is deed restricted to conservation and education purposes, it seems inappropriate for the City to collect a $780 Park Dedication fee. This fee has already been paid in order to pull a building permit to start construction. We hope the City can refund this amount. The water tap fee is less clear to me, as we are not adding any water fixtures and we are making an undersized (10' x 12') existing bedroom for two into a single bedroom, then constructing another single bedroom approximately 12' x 12'. The number of water users is not increasing. I hope this fee can be refunded as well. At present, these fees constitute 10% of the project cost so I hope you will be able to refund both the Park Dedication Fee and the Water Tap Fee. I appreciate your attention to this matter. We refer you to our assumptions in the body of this letter as they are critical to our value conclusion. We must also emphasize that we have not been provided with detailed legal descriptions of either of the subject parcels and their exact sizes are unknown. We understand that the function of this assignment is to assist you and the City in determining value estimates for trade purposes. We also recognize that the value conclusions shawn below may not in fact reflect what is actually traded. Rather, portions of the two properties may be traded in order to facilitate the needs of ACES and the City. On this basis, we have shown the value conclusions for the two parcels both as a lump sum and on a per square foot basis. We are providing our analysis in the form of a "limited Appraisal Assignment." As such, it does not contain a complete description of the subject properties nor does it include a detailed discussion of zoning, highest and best use, the neighborhood, or our analysis of comparable sales typical of our formal appraisals. However, while this document is abbreviated, our analysis has been in depth, and we PFRAISALI N5TITUTE~ do not feel we have departed from any of the requirements of the Uniform Standards of Professional Appraisal Practice. Given the assumptions we have made, we do not feel that our valuation would change based upon the more detailed reporting standards of our formal appraisals. We refer the reader to our discussion in "Approach to the Valuation Problem" on page 8 of this report which details our methodology used in analyzing the subj ect pmperties for the trade. It is the City's intention to acquire additional land from ACES/Paepcke to build a house for the City electrician. In order for this take place, it is our assumption that a 15,000 square foot site will be deeded to the City with a building right in place. We also recognize that 15,000 square feet is currently part of a larger parcel, and that in order to effect its division, approvals and costs are necessary. These are reflected in our valuation of this parcel. Currently, the City owns approximately 11,000 square feet improved with a dilapidated single family residence. This lot is a non-conforming, but legal lot of record which could be developed with a new single family home. The approval process is straightforward for this site with only relatively minor costs involved with obtaining a building permit. With respect to this parcel, however, as we have noted, the specific size is undetermined. We have assumed that the parcel is approximately 11,000 square feet, although any minor deviations (which we would view as approximately 1000 square feet in either direction) would not affect our conclusion. The parties involved have agreed that the "dated" improvements on this site have only nominal value. We concur, but have considered their minor contribution in our analysis. Based upon our analysis of the accumulated data, it is our opinion that the subject properties have the following Market Values, as of September 23, 1993: ACES/Paepcke Parcel (15,000 SF): $300,000 or $20/SF City of Aspen Parcel (11,000 SF): $450,000 or $41/SF Please note that our final value estimates include real estate commission and reflect cash or cash-effective transactions. Our valuation is based upon the assumption that both of the subject properties will have one inherent building right. We have also assumed that the ACES/Paepcke Parcel will be at least 15,000 square feet in order to effect its division fram the larger parcel which The Aspen Appraisal Group, Ltd. it is currently part of. Group, Ltd. 1 ABOUT THE APPRAISAL Function of the Appraisal: The function of this appraisal is to assist ACES/Mrs. Elizabeth Paepcke and the City of Aspen in determining the Market Value of two pieces of land which are to be traded. Scope of the Appraisal: This report is a "limited Appraisal Assignment" confonning to the reporting requirements of the Uniform Standards of Professional Appraisal Practice and is intended to arrive at the Market Value for the subject properties. This appraisal is limited in the sense that we have abbreviated our discussion of the neighborhood, highest and best use, zoning, and our comparable sales analysis, etc. In addition, this appraisal focuses only on the Sales Comparison Approach to value, utilizing the most comparable sales of vacant land throughout the Aspen area. Although currently the City parcel does have an old residence, in our estimation this structure contributes no value to the property, and in essence, this is really a vacant site as well. Neither the Cost nor Income Approaches to value is considered relevant in the appraisal of vacant land. In the course of verifying the comparable sales data in our analysis, we have discussed the transactions with either the seller, buyer, or seller's agent (the real estate broker or salesperson) and have also verified data where possible with the records of the Pitkin County Clerk and Recorder's Office. We have personally inspected each of the comparable sales discussed in our analysis. We have not reviewed an environmental study for either of the subject properties. Neither site is likely to contain any known hazardous materials, though the structure on the City Property is old enough to have same asbestos insulation. We know of none, but have not inspected the interior. We have no evidence that the land was ever used for purposes other than residential development. However, we note that we have only performed a cursory visual observation of the properties. We have not researched the title, interviewed current or prior owners, nor have we done any research beyond that normally associated with the appraisal process. The reader should be reminded that these comments are being provided by Tlle Aspen Appraisal Group, Ltd. 2 appraisers who are not trained or qualified to identify potential environmental problems; therefore, it should only be used to assist the users in their awn determination of whether or not an environmental professional is required for further study. Since the appraisers are not environmental professionals, they cannot be held liable for the lack of detection or identification of possible environmental problems. The appraisal report must not be considered an environmental assessment of the pmperty, as would be performed by an environmental professional. Purpose and Date of This Appraisal: The purpose of this appraisal is to estimate the Market Value of the "fee cwnership" of the subject properties as of September 23, 1993, the date of our inspection. Fee ownership of any property is the highest form of ownership where in there are no restrictions on title other than easements of recond and the four normal limitations: taxation, eminent damain, police power and escheat. Market Value is defined as: - "The most probable price which a property should bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller, each acting prudently, knowledgeably, and assuming the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of title from seller to buyer under conditions whereby: a. buyer and seller are typically motivated; b. both parties are well informed or well advised, and each acting in what he considers his own best interest; c. a reasonable time is allcwed for exposure in the open market; d. payment is made in terms of cash in U.S. dollars or in terms of financial arrangements camparable thereto; and The Aspen Appraisal Group, Ltd. 3 e. the price represents the normal consideration for the property sold unaffected by special or creative financing or sales concessions granted by anyone associated with the sale." The Aspen Appraisal Group, Ltd. 4 PROPERTY IDENEFICATION Legal Description: We have not been provided with precise legal descriptions for either of the subject parcels. The City Property is located at 220 Puppy Smith Street. This parcel will be described by metes and bounds. The ACES,/Paepcke Property is located in Iakeview Addition. Currently, the Paepcke holdings include lots 6-11 and part of Lot 12 in Block 1 and Lots 1, 2 and 5-11 plus part of Lot 12 in Block 12 of the Lakeview Addition. At one time, this property was divided by an extension of Lake Avenue, though that thoroughfare has been vacated. With that vacation, these parcels have merged into a single developal:~le site of approximately 53,672 square feet. From this parcel, as we will discuss, we have hypothesized a 15,000 square foot building site adjacent to the City-owned electric switching station which will be traded to the City for the property at 220 Puppy Smith Street. Present Owner of Record and Sales History: Title to the property at 220 Puppy Smith Street is held by the City of Aspen. Title to the 15,000 square foot trade parcel is held by Mrs. Elizabeth Paepcke. There have been no arms-length sale transactions involving either of the subject properties within the past 5 years. Neither property is listed for sale. About the Properties: The subject properties are located approximately 7 blocks north of the Hyman Avenue Mall, the focus of cammercial Aspen. Both properties have access from Puppy Smith Street which services the Mill Street shopping area including the U.S. Post Office which is located just east and adjacent to the ACES/Paepcke Parcel. Separating the subject properties is the Aspen Electric Department switching station which is an earth sheltered structure and one which has minimal visual appeal. The Aspen Center for Environmental Studies and the Hallam Lake Nature Preserve of approximately 21 acres is located just west of the subject properties. The character of the surrounding neighborhood is primarily cammercial in orientation to the south and east, while the open space of ACES dominates to the west. It is located at the northwest corner of the intersection of Puppy Smith Street and the Rio Grande Trail. It is the northernmost parcel outlined in blue on the facing page. It is currently improved with a dilapidated structure of less than 1000 square feet. We did not complete an interior inspection of the single family residence as we feel it will be demolished to make way for new single family construction. The site is level to sloping in topography, running generally downhill from south to north. Views from the site are very good, primarily south toward Aspen Mountain. Although there is some impact from vehicular traffic on Puppy Smith Street for this property, berming and landscaping could help to minimize that influence. We feel that construction will take place in the middle to north portions of the site as far removed from Puppy Smith Street as possible. We have approximated the size of this parcel at 11,000 square feet. As we have discussed, we have not been provided with a detailed legal descri_ption of the property, however. Our value conclusion is not particularly sensitive to size, however. Any minor deviation from our approximated size will not affect our valuation. We have arbitrarily determined that 1000 square feet on either side of the 11,000 square feet we have estimated would not affect our valuation. ACES/Paepcke Parcel: This property currently consists of 53,672 square feet located in Blocks 1 and 2 of Lakeview Addition to the City of Aspen (outlined in yellow on the facing page) . The site is level to sloping in topography, running generally uphill from north to south. The west portions o f the lot adj oin a steeply rising bank which extend up to a mesa comprising Aspen's prestigious West End. South of the site on the ridge top is the "Red Brick School," originally the upper elementary school. This parcel is mostly level, however, and relatively open with large mature cottonwoods scattered throughout. Views from the site are average to good, primarily south toward the Aspen Mountain ski area. However, as one moves south on the property toward the most probable building envelopes, views of Aspen Mountain are obstructed by rising topography. Tlie Aspen Appraisal Group, Ltd. 6 This parcel is divided on the attached plat map by an extension of Lake Avenue. We understand Lake Avenue in this location was vacated in the distant past. A "driveway" still extends across the property in the approximate location of original lake Avenue and provides access to parking now used by ACES on this parcel. Plat maps we reviewed suggest that there may be a storm sewer easement through the original lake Avenue right-of=way. There also appear to be some utility easements crossing the property. Above-ground utility lines do not appear to affect the west portion of this site, although they do have more impact on the east portion. It is our understanding, however, that these utilities have in fact been undergrounded by the City, and that the above-ground poles and lines are to be reinaved. The Paepcke Property includes a small, dilapidated structure of approximately 400 square feet. It does not appear to be on the list of historic structures compiled by the City. Clearly, the structure is at the end of its economic life. We do not consider this structure to impact the value of this property. As we will discuss in the Highest and Best Use section which follows, it has been our approach to evaluate this parcel based upon a division of the site through the Lot Split Exemption process to result in a 15,000 square foot building site for trade to the City. The location of the proposed 15,000 square foot site is in the northeast comer of this parcel adj acent to the City of Aspen Electric switching facility. This portion of the site is essentially level and open in character with one large spruce located in its southeast corner. View orientation from this portion of the site is average, obstructed by rising topography to the south and irrpacted easterly by the adj acent post of f ice. Although berming and landscaping could help to minimize impact from the post office, this is still an important consideration in our analysis. Zoning/Highest and Best Use: Both of the subject properties are zoned R-15, a City of Aspen zoning category requiring a minimum lot size of 15,000 for single family construction. The City Property of approximately 11,000 square feet would be viewed as a non-conforming, although legal lot of record, substandard in size. Single family construction would still be allowed. The allowed floor area ratio in the R-15 zone is based upon sliding scale. For a lot of approximately 11,000 Sgtiare feet, a single family dwelling of just under 4100 square feet would be allowed. The lot resulting from the division of the ACES/Paepcke The 1 Aspen Appraisal Group, Ltd. 7 Parcel would be 15,000 square feet, in full conformance with underlying zoning. A single family dwelling of approximately 4500 square feet would be allowed on that site. Two zoning issues are important in our determination of value of the ACES/Paepcke Parcel. First, the City Code states in Section 5-502 that: "Vacated land shall be excluded from the calculation of allowable floor area, density, or required open space. " It would appear then, that the Lake Avenue right-of-way vacation must be excluded from the raw size of the site to determine allowable density and floor area ratios. According to the plat map, the right-of-way measures approximately 280 feet by 40 feet or a total of 11,200 square feet. 'Ihus, the "effective" size of the Paepcke holdings would be 42,472 square feet. Second, Section 7-1003 of the Land Use Code allows as an exemption from subdivision under Grawth Management Quota System restrictions "The split of a lot for the purpose of development of one detached single family dwelling on a lot formed by a lot split granted subsequent to November 14, 1977 where. . .the following conditions are met: b) No more than 2 lots are created by the lot split, both lots conform to the requirements of the underlying zone district and the applicant commits that any lot for which development is proposed will contain an accessory dwelling unit. . . d) The subdivision plat is submitted and recorded after approval indicating that no further submission may be granted for these lots.... The Aspen Appraisal Group, Ltd. 8 Approach to the Valuation Problem - Methodology: As we have discussed, it is our intention to evaluate two properties which are to be traded by the City of Aspen and ACES/Mrs. Paepcke. The valuation of the City-owned pmperty is straightforward. This is an approximate 11,000 square foot single family building site Which we will compare to other comparable lots which have recently sold. The valuation of the ACES/Paepcke Parcel is, however, not as simple. Currently, the parcel which is to be traded is part of a larger 53,672 square foot site and subdivision will need to be effected before the separate 15,000 square foot parcel could be transferred to the City. In our estimation, the highest and best use of the ACES/Paepcke Parcel is to subdivide through the Lot Split Exemption process, resulting in two single family building sites. Each would have to be deed restricted against further subdivision and both would require development of an accessory dwelling unit along with a single family home, although neither of these issues is unusual in our market. One of the sites would be approximately 15,000 square feet, and as we have discussed, it will be located in the northeast corner of this parcel, adjacent to the City switching station. The remaining portion of the lot will be a very desirable single family building site. Although it is not our intention in this appraisal to estimate the value of this remaining approximately 38,000+ square feet, clearly this property would be much more desirable than the 15,000 square feet which would be divided for trade to the City. In our approach to the valuation o f this 15, 000 square foot parcel resulting fram the lot split, we have considered not only the time and costs necessary to effect the Lot Split Exemption procedure, but also a measure of profit to compensate a developer for risk. Though the lot split process itself is relatively straightforward, the reader should recognize that there are few guarantees in Aspen when it comes to zoning and development approvals. In addition, the process involves time delays and if one or both of the sites are sold, real estate commission would also have to be paid. Valuation of the City's parcel is straightforward as it already constitutes a separately buildable building site. The valuation of the Paepcke/ACES Property is more convoluted. We have hypothesized a 15,000 square foot site and will estimate its value as if it were a separately developable property. In fact, it is part of a larger parcel owned Mrs. Paepcke. The most simplistic process to separate the site to carry a building right would be by lot split. Thus, our approach to the valuation of that parcel is to estimate its gross sellout once division is achieved and then to deduct some portion of the amount of costs necessary to achieve a lot split and profit for undergoing time delays and risks of lot split. The result is an "as is" value o f the land for trade, prior to legal separation tcward highest and best economic use. On the facing page is a a chart of the most recent comparable sales to which we have given greatest emphasis in our analysis. Sales range substantially in size. However, the reader should understand that size is rarely of primary importance to purchasers. They react more strongly to the prestige of the neighborhood, views, proximity to the central core and ski slopes, topography, availability of utilities, and other physical characteristics. Per acre or per square foot value comparisons in our market are not made by purchasers and to do so would be misleading and inaccurate. Small differences in lot size are not significant. On the following facing page, we have selected six of the sales we consider most appropriate for direct comparison with each of the two subj ect properties. We have made "broad bnishstrokes" of comparison on a percentage basis for location/prestige, size, view, and privacy. We stress the difficulty in deriving these adjustments. Buyers in our market rarely make definable market adjustments between properties and this situation is aggravated by a normal scarcity of supply. Our adjustments are drawn from our experience in the market and are intended to allow the reader to see the degree of difference we perceive between properties. The following is a brief discussion of the sales which we feel warrant greatest attention. The first portion of our discussion will center on the City's parcel and its comparison to our sales. It appears to us from plat maps available to be appmximately 11,000 square feet. Any small variation should not be material to value, hawever. The property is improved with a small single family residence. We did not inspect this home, and it seems to be the concurrence of the parties involved that it has nominal if any value. From our exterior inspection, we concur. It is probable this structure would razed for new home construction on a site of this value. We have not given any specific weight to the impruvements, but they would tend to direct us near the upper end of our value range for their interim income-producing use and the fact that some tap fees have been paid. We expect these features to at least outweigh demolition Costs. Sale 4 is a lot located in Aspen's south West End, a much superior neighborhood. It is slightly smaller at 7500 square feet. Views are more dominant toward Aspen Mountain ski area from this corner lot and privacy is superior, despite the proximity of a small project used for employee housing. The total adjustment is -30% for a value indication of approximately $470,000. Sale 5 is located in the same block, and is a small 3000 square foot corner site running east and west along the block. At the time of sale, it included a small, outdated detached residence which was razed for new home construction. Again, this location is more prestigious, well away from the commercial impacts of Puppy Smith Street. The much smaller size of this site will limit build out to 2400 square feet above grade and makes architectural design difficult. We feel a relatively large adj ustment for size is justified. This is a north-facing site and views are somewhat limited. However, the privacy of this location is better without any impact from the post office. Our total adjustment is +5% for a value indication of approximately $420,000. Sale 7 is a 16,500 square foot site located near Cemetery Lane and averlooking the Castle Creek drainage, approximately 1 mile west of the central core. This is an inferior location farther from skiing and Aspen's amenities. The property sold for $440,000, but it included an 1133 square foot single family hame with three bedroams and two baths which we understand the buyer intends to keep. We The Aspen Appraisal Group, Ltd. 11 felt the improvements contributed between $50,000 and $75,000, leaving roughly $375,000 to the land. The greater distance of the this property from central Aspen warrants an upward adjustment. It is slightly larger than the City's site. Views are less commanding toward Aspen Mountain ski area. The privacy of this property is affected by its nearness to Highway 82, Cemetery Lane, and overlooking Aspen' s city maintenance facility. We consider this similar to the subject's situation. Our total adjustment is +15% for a value indication of approximately $430,000. Sale 8 is a 7800 square foot site with a small cabin adjacent to Park Avenue a short distance east of the subject. This neighborhood is somewhat crowded, inferior even to the subject's location. The site is smaller, though views are comparable. Privacy from neighboring hamesites is also similar. Our total adjustment is +10% for a value indication of approximately $420,000. Sale 11 is the most recent Aspen Highlands transaction (we have shown two other sales in 1992 and 1993). This site is much farther from central Aspen, approximately 2 miles southwest. It is a much larger site and warrants a negative adjustment for size. The prestige of Highlands and its proximity to a ski area, in our opinion, offsets the subject's central location. Views fram the site are good toward Highlands ski area, similar to the subject's. Privacy is much superior. Our total adjustment is -25% for a value indication of approximately $435,000. Sale 12 is a 2-acre lot located at the base of Smuggler Mountain north of the subject. This is an inferior neighborhood, though the much larger size of this site warrants a more than offsetting adjustment. The privacy of this site is impacted by its proximity to two large employee housing projects, but is nevertheless superior to the City's property. Views are reasonably similar. The property sold for $593,800, but included a single family home, and the effective price including full commission was $625,000 according to the broker. $350,000 was carried by the seller, but at a market rate and at the seller' s request. Our discussions with the purchasers indicate that they gave significant value to the im~rovements, despite their "dated" character and are in the process of remodeling them. The home contained 2412 square feet laid out as three bedroams, one bath, and two powder rooms on three levels. The layout was extremely awkward and quality only fair. We felt the improvements contributed roughly $50,000 to $100,000, leaving approximately $550,000 to the land. Adjusting for differences suggests a value indication of approximately $440,000. The Aspen Appraisal Group, Ltd. 12 We have a severe scarcity of available single family properties in this sub-$500,000 price range. This alone would tend to direct us to the upper end of our range. There are same listings which are relevant for discussion. The Newfoundland Claim on Ute Avenue is available for $425,000. This is 10 acres, but most of the land is steep and unusable. The building envelope presents same severe construction problems and is next to an avalanche zone. The property was under contract for near its list price, but we understand it may have fallen through. There are certainly same "trade offs" between this and the subject site. This listing has limited ski accessibility, much better privacy, and is heavily wooded with conifers. It is a similar distance to the central core, but its hazards, increased construction costs, and limited sun exposure, in our opinion, are offsetting. The Lavigino Property is available in Oklahoma Flats at 270 North Spring. This 14,375 square foot site is located 4 blocks east of the subject in a neighborhood similar in distance fram the central core and its amenities and in a neighborhood of reasonably comparable prestige, but better single family character. The site has average views, inferior to the subject's. It is level and usable and is comparable in size. The list price of $695,000 would, in our opinion, establish the upper range of value. The Lacet Subdivision is a new approved development located a short distance east of the central core and adjacent to Riverside Subdivision. Some of these lots are under contract in the $400,000 range, but three lots have been available at prices ranging from $430,000 to $495,000. 'Ihey fall in the 9000 to 11,000 square foot size range. The best lot is Lot 1 with good views toward Aspen Mountain ski area; it is one of the most private sites in the development. Its listing at $495,000 would establish the upper range of value for the subject. Our sales reflect a range of value fram approximately $420,000 to $470,000. Most of the sales cluster at the lower end of this range, but we feel the middle to upper range is better justified given the scarcity of available oampetitive properties in this price range and the fact that the subj ect's improvements, though of naminal value, would tend to direct us near the middle to upper end of our range. OCt -203 ...2-03 2330,200 -lut J 13 Valuation of the ACES/Paepcke Parcel: As we have discussed, the ACES/Paepcke Parcel does not yet exist as a building site separate from the entire Paepcke holding. The property is zoned R-15, and it seems reasonable to us that the minimum lot which could be created by subdivision would be 15,000 square feet. The logical process for creating that separately developable site is by lot split. Once divided, the property would have the disadvantages of looking east directly at the rear of the Aspen Post Office and north at the Aspen electric facility. All the traffic to the post office exits on the road directly adjacent to this lot. Views from this location south of the City's parcel are more obstructed by rising topography to the south and are much less dramatic taard Aspen Mountain ski area. On the facing page is a chart showing our adj ustments to the ACES/Paepcke Parcel of 15,000 square feet. The same sales are utilized, and all the same adjustments are appropriate in terms of location/prestige. This is a slightly larger site than the City Parcel, and all our sales are adjusted +5% relative to those made to the City Parcel for size. The views from this site are much inferior to the City Parcel, and the difference between our adjustments to our comparable sales are -10% across the board. Privacy on this site is much inferior to the City Parcel because of the proximity of the Aspen electric facility, the post office, and post office access. Each of our sales show an additional -15% adjustment relative to those we made for the City Parcel for privacy. Adjusting our sales results in a range of value from approximately $320,000 to $355,000. The supply of available land near the central core under $400,000 is non-existent. This severely limited supply would direct us to the upper end of the value range for this site at $350,000. The "gross sellout" of the ACES/Paepcke Parcel is not the conclusion on its value "as is," haever. In order to create this parcel, some subdivision from the larger Paepcke Parcel will be necessary. The Growth Management Quota System could be explored, though the expense and cost of that process can be so astronomical that property developers have consistently avoided its risks in deference to more straightforward subdivision exemption alternatives like lot split. The larger Paepcke Parcel appears ripe for such a division as we have discussed. The costs of such division are relatively low in comparison with full GMQS application and include planning, survey work, legal fees, and application fees. From our discussions with local planners, we expect lot split costs to range between The Aspen Appmisal Group, Ltd. 14 approximately $20,000 and $30,000. We have selected $25,000 as an appropriate adjustment. A portion of that would be attributable to the other lot resulting from the division, and thus we have applied half as an appropriate deduction for this 15,000 square foot lot. The developer undergoing a lot split will also want and deserve profit for the process. Part of that profit allocation should be an adjustment for the time delay involved in gaining lot split approval, which can take a year, and in some cases more. We feel a profit and time delay allocation of 10% of the gross sellout of this site is appropriate. Thus, the following value conclusion for the 15,000 square foot site "as is" prior to receipt of divisi on is suggested: Gross Sellout: $350,000 Less 1/2 Development Costs: ($ 12,500) Less Profit (10%): ($ 35,000) Resulting "As Is" Value: $302,500 Rounded: $300,000 Estimated "As Is" Contributory Value of a 15,000 SF Parcel created from the Paepcke/ACES Property: $300,000 The Aspen Appraisal Group, Ltd. 15 SUBQAARY Property Value City Parcel ( 11, 000 SF) : $450,000 Property Value "As Is" ACES/Paepcke Parcel: $300,000 The value conclusions above are contingent upon all assumptions outlined in this report and integral to the value conclusion. Lacking a survey, we have estimated the size of the City Parcel at 11,000 square feet. If it proves to be materially different than that, it could affect our value conclusions, though small variations are not relevant to value. We understand that the City and ACES/Paepcke plan to trade properties. In this regard, we have tried to analyze both properties in an "apples to apples" analysis in which we compare sites each with a development right. The Paepcke/ACE:S Property requires division to create a separately developable site for trade. Our hypothesis of this 15,000 square foot parcel requires division from the larger Paepcke site and have chosen the lot split process to hypothesize that division. We understand something less than total site square footage may be traded. If that is the case, the City and Paepcke/ACES may decide to trade property based upon a dollar per square foot analysis of our final numbers. We caution that if such a trade is performed, that each traded property should be carrying a building right in order to this "apples to apples" trade to be fair. If lot split of the Paepcke Property is effected prior to trade (at ACES/Paepcke's expense), the site should be valued as above, before deduction for profit and cost. We also stress that a minor variation in size of this parcel above 15,000 square feet would not affect its value, though it would affect its value per square foot.
