HomeMy WebLinkAboutresolution.council.026-92 RESOLUTION NO. f~ (Series of 1992) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, CALLING FOR AND ESTABLISHING A DATE FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD AUGUST 11, 1992. WHEREAS, the City Council is authorized by Section 2.2 of the Aspen Home Rule Charter to call a special election by resolu- tion provided that it do so at least sixty (60) days in advance of the same; and WHEREAS, a resolution calling a special municipal election shall set forth the purpose or purposes of such election; and WHEREAS, the City Council desires to call and establish the date for a special election so as to allow the electorate the opportunity to vote upon a question concerning the acquisition by the City of Aspen of real property, as well as such other ques- tions as the city Council may hereafter deem appropriate. NOW, THEREFORE, BE IT RESOLVED BY.THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1 A special election shall be and is hereby called and estab- lished for Tuesday, August 11, 1992, for the purpose of submit- ting to the electorate a question concerning the acquisition by the City of Aspen of the building owned by the Aspen School District formerly used as the Aspen Middle School and commonly known and referred to as the Red Brick School Building, as well as such other questions as the city Council may hereafter deem appropriate. Section 2 The City Clerk shall give written or printed notice of the special election called for herein at least ten (10) days prior to said election and shall include in said notice the date of said election and the hours during which the polls will be open, designating the polling place of each precinct, stating the qualifications of persons to vote in the election and the ques- tion or questions to be voted upon. A copy of such notice shall be published in at least one newspaper having general circulation within the city of Aspen. If the Clerk finds it impractical to make the publication on the tenth day before the election day, she shall make the same on the earliest possible day before the tenth day. Publication in any weekly newspaper shall be in the next to last issue thereof before the day of the election. A copy of such notice shall also be posted until after the election in a conspicuous place in the office of the city Clerk. Section 3 The city Council finds and declares that the adoption of this Resolution presents an emergency and is necessary for the preservation of the public health, safety and welfare. Specifi- cally, City Council finds that due to various provisions of the Colorado Municipal Election Code and the City of Aspen City Charter a delay in adopting this Resolution beyond May 26, 1992, 2 would prevent the City from holding an election prior to Septem- ber 15, 1992. Such a delay could jeopardize the City's ability to purchase the said Red Brick School Building, hence, the election determining whether the City should expend the necessary funds and determining other related matters relative to said purchase must be conducted as soon as permitted pursuant to the provisions of the Home Rule Charter and the Colorado Municipal Election Code.
