AND THE CITY OF ASPEN, COLORADO, FOR THE CONSTRUCTION OF A BACKWASH POND BYPASS FOR THE CITY OF ASPEN WATER PLANT FACILITY, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY OF ASPEN, COLORADO. WHEREAS, there has been submitted to the City Council a construction contract between Gould Construction, Inc. and the City of Aspen for the construction of a backwash Pond Bypass for the City of Aspen Water Plant, a true and accurate copy of which is attached hereto as Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: That the City Council. of the City of Aspen hereby approves that construction contract between Gould Construction, Inc, and the City of Aspen, a copy of which is annexed hereto and incorporated herein, and does hereby authorize the Mayor of the City of Aspen to execute said agreement on behalf of the City of Aspen. The CONTRACTOR will commence the work required by the CONTRACT DOCUMENTS within 15 calendar days after the date of the NOTICE TO PROCEED and will complete the same by 60 days unless the period for completion is extended otherwise by the CONTRACT DOCUMENTS. 4. The Contractor agrees to perform all of the Work described in the CONTRACT DOCUMENTS and comply with the terms therein for the sum of $ 74,588.00 or as shown in the BID SCHEDULE. 5. ADDITIONAL SUPPLEMENTARY GENERAL CONDITIONS 1. GENERAL These Additional Supplementary General Conditions amend or supplement the Standard General Conditions and the Supplementary General Conditions of the Construction Contract and other provisions of the Contract Documents as indicated below. All provisions which are not so amended or supplemented remain in full force and effect. The terms used in these Additional Supplementary General Conditions which are defined in the Standard General Conditions of the Construction Contract have the meanings assigned to them in the General Conditions. 2. Amend paragraph 2.2 to replace the word "ten" with the word "three". 3. Delete the last four lines and the last word from the fifth line of paragraph 2.7. 4. Amend second sentence of paragraph 4.2.1 to read as follows: CONTRACTOR may reasonably rely upon the accuracy of the technical data contained in such reports, but not upon non-technical data, interpretations or opinions contained therein or for the completeness thereof for CONTRACTOR's purposes. 5. Amend paragraph 4.2.1 by adding to the end of that paragraph the following: ' CONTRACTOR shall not, by virtue of this paragraph, be relieved from exercising ordinary skill and competence with respect to reliance upon the accuracy of the technical data contained in such reports. 6. Amend the second sentence of paragraph 4.2.2 to read as follows: CONTRACTOR may reasonably rely upon the accuracy of the technical data contained in such drawings, but not for the completeness thereof for CONTRACTOR's purposes. 7. Amend paragraph 4.2.2 by adding to the end of this paragraph the following: CONTRACTOR, shall not, by virtue of this paragraph, be relieved from exercising ordinary skill and competence with respect to reliance upon the accuracy of the technical data contained in such drawings. 8. Amend paragraph 5.11.1 by replacing the first sentence with the following: CONTRACTOR waives all rights against OWNER for all losses and damages caused by any of the perils covered by any policies of insurance which the OWNER may have and any other property insurance applicable to the Work, and also waive all such rights against the Subcontractors, ENGINEER, ENGINEER's consultants and all other parties named as insureds in such policies for losses and damages so caused. Amend paragraph 4.2:2. by deleting last sentence. Amend paragraphs 5.11.2, 5.12 and 6.11 by deleting references to paragraph 5.7. Amend paragraph 5.13 by deleting the last sentence. Amend paragraph 5.14 by adding a reference to paragraph 5.6 following the words, "paragraphs 5.3 and 5.4" in the first sentence. Amend paragraph 5.14 by deleting the second and last sentences. Delete paragraph 8.5. THROUGH: THROUGH: BOB GISH, PUBLIC WORKS DffiECTOR FROM: LARRY BALLENGER, WATER SUPERINTENDENT DATE: OCTOBER 7, 1992 SUBJECT: BACKWASH METERING AND BYPASS SYSTEM SUMMARY: The Water Department must complete construction of the Backwash Metering and Bypass System to be in compliance with the City's Discharge Permit. Engineering has been completed by Schmueser Gordon Meyer, Inc. Bids have been received to facilitate construction. Gould Construction was the most qualified bidder for the Project. Staff recommends the contract be awarded to Gould Construction to effect construction of this Project. PREVIOUS COUNCIL ACTION: engineering design for this Project. purpose. Council previously approved $30,000 to complete $7,000 has been expended from these funds for that BACKGROUND: The City of Aspen has received a Discharge Permit from the State of Colorado to discharge the backwash water from our treatment plants into Castle Creek. The Permit contains stipulations for separation of overflow waters and backwash waters in our system. We are also required to measure the amount of backwash discharges to the receiving stream. CURRENT ISSUES: Bids have been received to effect the construction of the Backwash System. Gould Construction submitted the lowest bid at $74,588.00. Gould Construction is a reputable firm that is qualified, experienced, and capable of performing the requested work. Therefore, the Water Department and Schmueser Gordon Meyer recommend that the Project be awarded to Gould Construction. I .' , \:'" .... '^ e. 0\;,. "'. e IFINANCIAL IMPLICATIONS: Earlier this year, the Water Department requested Council to appropriate $30,000 from the Water Fund to initiate the engineering/bidding work for this !Project. We advised Council that we would return for construction funding when we knew what those costs were. Of the $30,000.00 originally requested from Council, $7,000.00 has been expended on preliminary engineering, project engineering, and bid document preparation. This leaves a balance of $23,000.00 for this Project. The financing for the Project is available in the Water Fund. RECOMMENDATION: Staff recommends that Gould Construction be awarded the Bid to complete construction of the Backwash System. ALTERNATIVES: If the Backwash System is not constructed, the City will be in violation of our State of Colorado Discharge Permit.
