RESOLUTION NO. 51- (Series of 1994) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, CALLING FOR AND ESTABLISHING A DATE FOR A SPECIAL MUNICIPAL ELECTION TO BE CONDUCTED ON NOVEMBER 8, 1994. WHEREAS, Section 2.2 of the Aspen Home Rule Charter authorizes City Council to call special municipal elections by resolution so long as such special elections shall not be held less than 60 days from the date of the resolution calling for same; and WHEREAS, the City Council wishes to place before the Aspen electorate certain ballot questions relevant to extending the existing real estate transfer tax earmarked for affordable housing; and WHEREAS, pursuant to Section 20 of Article X of the Colorado Constitution, elections addressing taxes, spending and/or public debt may be conducted on the date upon which general elections are held; and WHEREAS, the City Council may add such additional questions to the ballot as it may hereafter deem appropriate, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1 A special municipal election shall be and is hereby called and established for Tuesday, November 8, 1994, for the purpose of submitting to the electorate a question concerning the amendment of Ordinance No. 13, Series of 1990, to extend the expiration date of the real estate transfer tax earmarked for affordable housing from December 31, 1994, to December 31,2004, as well as such other questions as the CIty Council may hereafter deem appropriate. ie.. \\\ '. e. %, Y', ~~ ~ ~. Section 2. Should the City Council determine within its discretion and for any reason to withdraw the ballot question(s) and cancel the election thereon established for November 8, 1994, it shall do so no later than twenty-five (25) days prior to said election. However, in the event citizen- initiated or other non-tax, non-spending, or non-debt questions have been added to the ballot for said special election, such election shall not be cancelled but shall proceed on these ballot questions only. Section 3. The City Clerk shall timely prepare and mail all election notices and information as required by Section 20(3)(b) of Article X of the Colorado Constitution and shall give written or printed notice of the special election called for herein at least ten (10) days prior to said election and shall include in said notice the date of said election andd the hours during which the polls will be open, an identification of all polling places, the qualifications of persons eligible to vote in the election, and the question or questions to be voted upon. A copy of such notice shall be published in at least one newspaper having general circulation within the City of Aspen. If the City Clerk finds it impractical to make the publication on the tenth day before the election day, she shall make the same on the earliest possible day before the tenth day. Publication in any weekly newspaper shall be in the next to last issue thereof before the day of the election. A copy of such notice shall also be posted until after the election in a conspicuous place in the office of the City Clerk. Section 4. The City Clerk shall also coordinate with the Pitkin County Clerk and Recorder the preparation and mailing of the election notice package as called for in Section 20(3)(b) of Article X of the Colorado Constitution and negotiate a reasonable and fair cost allocation to be paid by 2 - ~- \- "ei. \" "~ ~. ., the City of Aspen for the assistance as provided the County Clerk and Recorder for such services.
