A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
AUTHORIZING THE CITY OF ASPEN PARKS DEPARTMENT TO PURSUE
ACQUISITION OF PEDESTRIAN AND BICYCLE TRAIL EASEMENTS OVER THOSE
CERTAIN PARCELS OF REAL PROPERTY COM/~ONLY KNOWN AS THE ANDERSONAND
KASTELIC PARCES; AND TO PURSUE ACQUISITION OF CERTAIN REAL PROPERTY
ADJACENT TO GARRISH PARK
WHEREAS, the the city of Aspen has historically been actively
engaged in obtaining and developing bicycle and pedestrian trail
easements through the City of Aspen; and,
WHEREAS, the Parks Department has identified pedestrian and
trail easements over the Anderson and Kastelic parcels as important
and vital links in the City's trail system, the acquisition of
which is necessary to preserve and maintain the quality of the
city's trail system, reduce vehicle traffic, improve air quality
and promote public welfare, and;
WHEREAS, the city Council has determined that acquisition of
the property known as the Procktor property adjacent to the City's
existing Garrish Park is an important and necessary addition to the
City's park system; and,
WHEREAS, the city of Aspen posses~ the power to condemn
private property for public purposes if good faith negotiations for
the acquistion of necessary property are unsuccessful;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ASPEN,
COLORADO:
1. The appropriate staff of the City of Aspen Parks
Department and other appropriate city personnel are authorized to
enter into negotiations for the acquisition of pedestrian and
bicycle trail easements over the Anderson and Kastelic parcels and,
if such negotiations are unsuccessful, and following a report of
such lack of success to City Council, to initiate proceedings to
obtain such easements through the exercise of the City's powers of
eminent domain.
2. The appropriate staff of the city of Aspen Parks
Department and other appropriate City personnel are authorized to
enter into negotiations for the acquisition of Procktor property
adjacent to Garrish Park.
