RESOLUTION NO. 1:1" Series of 1994 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, CORRECTING AN APPARENTLY ERRONEOUS GRANT OF AFFORDABLE HOUSING REVIEW AUTHORITY OVER PROPERTY OUTSIDE THE ASPEN CITY LIMITS. WHEREAS, certain real property in pitkin county, commonly known as the W/J Ranch, has been developed for affordable housing purposes; and, WHEREAS, the W/J Ranch has at all times been outside the city limits of the City of Aspen and the development has never been subject to review or approval by the City of Aspen; and, WHEREAS, certain deed restrictions related to the W/J Ranch create certain rights in the city of Aspen to enforce affordable housing commitments at the W/J Ranch; and, WHEREAS, the pitkin county Board of County commissioners is the appropriate body to review, modify or .grant land use approvals for any redevelopment of the W/J Ranch; and, WHEREAS, the city of Aspen desires to assign to the Pitkin County Board of County commissioners all its interests, if any, in the W/J Ranch. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF AS~EN, COLORADO: 1. The Mayor of the City of Aspen is hereby authorized and directed to execute and deliver a release, assignment and quitclaim deed, in the form attached hereto as Exhibit A, to the Board of county commissioners of Pitkin county. ~ . . \. Galena street, Aspen, Colorado 81611, for the consideration of One Dollar, in hand paid, hereby releases, assigns, sells, and quitclaims to the County of pitkin, Colorado, whose address is 506 E. Main street, Aspen, Colorado 81611, all of its rights, title and interest, if any, in and to the real property described in.the attached Exhibit "A" and all rights of any sort whatsoever, including but not limited to any rights of enforcement, contained in or arising out of those certain instruments entitled "Occupancy Deed Restriction and Agreement, Affordable Dwelling Unit" dated May 21, 1990 and recorded at Reception No. 323070, Book 621, Page 585, and Reception No. 323079, Book 621, Page 589, in the records of the Clerk and Recorder for pitkin County, Colorado. the signed and acknowledged by the Mayor of the city of Aspen on .::?5 day of ~.I , 1994. ~-y, {~-= John s.
